    Q. Is it possible for the owner of a vehicle to not be aware that there is a lien on the vehicle?

    Powered by
I recently purchased a motorcycle but when i went to transfer the title the dmv told me there was a lien on it. i confronted the seller about the lien and he says that he doesn't have a lien on his motorcycle but he does have a lien on his car. i don't think i am getting scammed because the seller has kept in contact with me throughout this whole ordeal and is trying to help me but i don't understand how the dmv can say there is a lien on it and the seller has no knowledge of it. on the title for the motorcycle where it says "number of lienholders" there is no number. is it possible the dmv made a mistake and saw a lien on the car and thought it was for the motorcycle or is it very easy to tell if a vehicle has a lien on it from looking at the title? could a bank put a lien on a property without your knowledge if you owe them a debt?

No, he would know and the title would show a lien. I think you are correct when you suggest the DMV made a mistake

    Q. Stopped paying collection agency?

    Powered by
In 1988 myself and one other were sued. i was the registered owner of the car and the other person used the car without my permission. other person was personally served and apparently i was served via publication and had no knowledge of it until 1992 when out of the blue a collection agency contacted me and advised a default judgment had been entered against myself and the other party. i made an oral agreement over the phone with collection agency to pay 1/2 of the debt before the other party filed bankruptcy, etc. to date the other party has not filed bankruptcy nor paid a single dime towards the judgment. i'm a responsible person and started making payments on it and have continued to do so. it no longer shows up on my credit reports because its so old (can it show up again since i quit paying?) and the collection agency proved up the judgment at some point over the past several years. during all these years i have repeatedly asked for our oral agreement in writing and have sent the collection agency numerous correspondence stating what our oral agreement is. bottom line, they are awful, liars, won't stop calling my work after i told them not to call me there, etc. several months ago they told me they would not provide me anything in writing regarding our oral agreement. needless to say at this point i stopped sending payments in. the judgment is in ca and i now live in another state. i have been told that the state i live in will not allow them to pursue garnishment against me and its unlikely the collection agency would hire an attorney to place a lien on property i may own if they can even do that. can they place a property lien, tax lien, etc. on me? i have almost paid my 1/2 of the original judgment as agreed and feel they are trying to get me to pay the entire amount because the other party hasn't stepped up to the plate. i'm tired of the harassment and i don't want to pay them anymore since i held up my end of the original agreement. i should mention they changed names at one point because of some trouble they were having. what should i do or better yet is there anything i can do to rid myself of the hell collection agency and prevent a lien being placed out there something or ruining my credit. there is a statute of limitation for my scernio? if so, what is it? statute of limitations has expired for me to sue the other party for indemnity and the collection agency won't settle for anything less than that total amount which is much more than our original agreement.

Your oral agreement isn't worth the paper it's written on. Unfortunately, the judgment probably was against you and the other person together and separately. They can and will come after you for the whole thing. You should have insisted on a written agreement before you started paying anything. The judgment has aged off your credit report and can't be re-aged. But the actual CA judgment was good for 10 years and is renewable. If you stop paying at this point, the collector could file to domesticate the judgment in the state you are now living. Then attach your bank account or other assets. Depending on the balance, it might be worth their while to do so.
