    Q. The property i wish to buy has a septic system is this a problem?

"I also have a well on my property so i got a water quality..."

I got a home with septic system and had no problems. I also have a well on my property so I got a water quality certificate for the bank, thats all they asked for.

    This answer closely relates to:
    • Cedar tree by septic bed
      • If my property use to have septic tank and well water shouldn t it been discolsed when i bought my property in pa?
      • What if a septic system fails on a property you are trying to buy?

"Septic systems are not a problem for the banks..."

Septic systems are not a problem for the banks. The bank may ask for an inspection of the system, but that is something you will want as well. No point finding out after you buy the house that it will cost thousands to repair.

    Q. How much spacing do cedar trees need for planting? how deep/wide is their root system? ok to put near septic?

    Powered by
I have approximately 5 to 6 feet width along a neighbor's property line to plant a privacy row of trees or hedges. the area is also next to a raised septic bed. are cedar trees ok to plant in this area? will their root system harm my septic system? i live in ne indiana.

"Any roots from any tree can harm your septic bed..."

When planting a cedar hedge with 4 ft to 7 ft trees try to space them about 1ft apart. Larger trees will need a bit more room. Any roots from any tree can harm your septic bed. When roots find an area they "like" they will thrive there. You can root prune them about every two years. Just simply push a sharp shovel into the ground as deep as you can. Best would be able to go down 2ft or so and just cut all the roots growing in that direction. Hopefully there is enough room between the cedars and septic to establish a healthy root system. About 6ft will do. It will be about 5 or 6 years before the roots from newly planted trees get any farther. So root prune about 5 ft away from the trees in about 5 years from now. Cedars would likely be best there root system is generally shallow Happy Hedging

    Q. Neighbor's drain field encroaching over 5 feet on our property. health dept. checked and they are not legal?

    Powered by
Letter was sent to the owners and they have not responded to resolve issue. what do i need to do to get it removed. do i have to pay for a survey along with attorney fees? these are people who rent out this second home as a lodge and they have many people at on time. lots of water usage. they purchased this dwelling after the septic system was installed. is it still their responsibility to financially have this removed or the previous owner who built the dwelling. we had no idea that this was on our property until we were digging to put a tree in and found a rock bedding. let me know what you think? health dept says they do not get involved in removal. they are the ones who sent the letter of violation. problem being, they have no room to put another septic system on their property. health dept stated they do not get into legal battles or provide any legal counsel. i told them they were the one who inspected it for approval and evidently gave them a permit to put it there. they said they do not require a survey , it only has to be put on the owners lot. hmm...i don't get it? now, i think i am going to have to sue for removal which i am not the one in violation. i don't think it's fair i have to peel out money for neighbor's responsibility to be in compliance...ugh!

I think for the time being I let the health department handle it. They have good lawyers and they aren't costing you anything untill you see their result. Someone is going to need a survey; he'll probably be ordered to get one at some point. There is such a thing as a perscriptive easement; I'd review my title policy for any appurtenant easements for a drainfield.
