    I loaned someone $5000 to buy a utility trailer. a verbal promise was made that it would be paid back within 2 weeks - the person moved to another state right after the loan - its been 3 years - can i file a lien on his property even tho he lives in another state now?

    Verbal contracts ARE valid, IF you can prove that the contract occurred and its terms. No, you can't "file a lien". There is no such thing. You have to sue him in court, and then win your case. THEN you can execute your judgment by placing a lien on his property, or taking other measures permitted BY THE LAW.

    I am currently living on property owned by a family member. i have been told that their are liens on the property. (1) how do i find out what liens are on the property and for what amount and (2) if the person who owns the land that i am living on (in a mobile home owned by me) becomes deceased do i have a set time to vacate the property they own that i am living on, and (3) would it be best to try to settle these liens now before the property owner becomes deceased?

    You would contact the county assessor's office to find out about the liens. They may have a website where you can get information about it. Many county assessors do. If the person who owns the land dies, whoever inherits the land also inherits the lease you have and has to abide by its terms. If he wants to kick you off the land, he would have to give you as much notice as your lease requires for a change of terms, or if the lease doesn't mention it, the minimum required by state law, typically 30 days. Liens always complicate dealing with an estate, so yes, it would definitely be best to take care of it before he dies.

    Q. How to place a lien on someones property by buying their debts?

    I was wondering if anyone could answer this for me. i know that you can legally purchase another persons debt and then file a lien against their physical property. i'm wondering if anyone knows how exactly you go about this? how would you go about searching and finding debt someone owes? are there only certain debts this can be done with? for example if someone owes a utility company could you buy a debt like that? i live in new york state if it varries by state. when i purchased my home it was a forclosed property. unfortunately the way the neighborhood is set up it has 2 physical addresses and when the home was foreclosed on only the one address was listed. meaning my yard wasn't part of the purchase. i wouldn't come to know this till a year after i bought this house. when taxes came out previous owners realised it was theirs and sold it . so i want to purchase debts of the current owner and place a lien in hopes of just getting the property back.

    You can buy a debt; but the only way to get a lien is by bringing suit on the debt. So you've gotta pay the lawyers' fees & court costs & then you've gotta be successful in the suit.

    We live in ca. i notice some foreclosures have a tax lien, but most don't. i have heard that if the property has a tax lien, then the person's credit is affected for 15 years. i have tried contacting the tax people in the county, but they are useless. we are just curious if we don't pay our property taxes b/c we are facing foreclosure (because of a job loss and an illness, so please don't judge us) when will the taxes become liens against the credit, if ever?

    All Real Property Taxes are liens in first position on real property &; are in default when not paid by their due dates. After foreclosure, or during any property transfer (refi, sale, etc.) for that matter, all unpaid property taxes, whether due, in default or a tax sale, will be paid when the property is refinanced, sold, etc. On the other hand, Default of Personal Property Taxes (such as on a boat or motor home) will be referenced on Owners Real Property (refi, sale, etc) but are attached to owners name and not to their real property. Any Unpaid Income Taxes (IRS, Franchise Tax Bd) will show on the credit report for a period of up to 10 years & then can be renewed if not paid off at that time. At any rate I feel for you and hope everything works out for you & your family :)

    Q. Legal question about a motorcycle/property?

    Im in texas. i recently was offered and given a non operational motorcycle from a tenant (personally owned the bike) who was evicted due to back rent. i didnt know his situation at the time and the bike is now in my posession. the landlord of that property saw the bike in my garage and approached me claiming it was his due to a property lien. is this plausible? could he actually file a lien on another persons property and should i have to give him the motorcycle back? he also claims im holding stolen property (the motorcycle) because the tenant who gave me the bike was not supposed to be on the property at that time and was breaking and entering. am i liable for any of this? without knowing this guys situation i moved the bike to my garage from his driveway (i live 2 houses down). i talked to a police officer who claimed he had no legal action against me, but im trying to find out to ease my mind about all this because im about to trade it for another motorcycle. any help would be greatly appreciated. will definately pick a best answer. need a professional on this one.

    He might be bluffing! If he didn't have the court papers at the monent of you getting the bike then he has no legal right over the property . It's too late for him. Now if he has a court order dated before you got the bike then he might have a valid argument. But to avoid complication hide the bike somewhere else until this is solved just in case he might try to steal it. And keep your mouth shut until talking to a lawyer just in case he might decide to go to court. Unless he hit you with a court order you are free to do whatever you want with that bike. His world alone has no legal value. If I were you I would trade or sell it as fast as possible; then the landlord would have a lot of trouble to prove his claim BUT that's just me.

    Lien was placed. person only rented. landlord unaware of her not paying her medical bills. now she owns her own property should the lien be placed on her own property and not someone elses just because she lived there? i am just the neighbor to the landlord.

    The first and simplest thing to do is just write a letter to the lien holder appraising them of the facts and putting them on notice that the debtor does not have a interest subject to lien in the property . If they ignore this or otherwise act like jerks then sue them for "slander of title."

    How to find some one that has moved and get information on to where they moved to and/or works at? i got into a car accident! the person that hit me fled the scene i called the police and the police have to come out and go into the person house to get the person information. the person was driving with a suspended license and no car insurance. i took the person to court but the person never showed up. i won the case. when the accident took place i know where the person lived but since the incident the person has moved with in those few weeks so now i can't take the person to court again because i don't have no information on where the person lives i only have the person driving license number and the vehicle license numbers (but the person by now might have gone a new car or new license plates). my question, how i can find this person and where the person works at or any information that would help? i need for the person 2 pay 4 the car damage and does the dvm help? i would like 2 file a lien on their property or wage garnishment!

    Yes, DMV can help for a small fee. Amount depends on the State where you are residing.

    Q. Where do you find info regarding loans (liens?) against a property?

    I am receiving many solicitations in the mail from mortgage companies (i've called them, they are no help) that are offering a mortgage loan for our property but listing another person's name as owner. we have lived in the home over 14 yrs. and we know what the previous owner's name was (they lived here over 20 yrs.). we get at least 5 solicitations a week. where would i start looking to determine if this is mortgage fraud or just a simple mistake? thanks...

    City and County records departments, usually called Registry of Deeds, have this information. Before you buy any property, always have a lawyer do a title search. It doesn't cost much, and if you try to do it an screw up you can be out a lot of money.
