    "That the lien is removed from your property..."



    Do not forget to register the discharge with the registry office as this is your responsibility not the bank. The discharge comes from the bank but to make sure that the lien is removed from your property , it has to be registered. You now own the propery fully without any mortgage. Hope this helps.

    Ask for a discharge from the lender and register the discharge with the land registry to erase this lien holder from the title . Your title is now clean of the 2nd mortgage lender.

    The place was paid in full last month. the final payment was sent with a letter asking for them to send us the title, which we will need in order to pay the taxes on the house. the people we bought it from have not sent the title and now all of the phone numbers for them that we have no longer work. are we going to have to hire a lawer to take care of this?

    It sounds like you bought this property from a private individual. If you bought this through a loan from a bank, the bank should be holding a lien on your property. When everything is paid in full, the bank will release the lien and redraw a title to reflect your name only. If you bought this property from a private individual, that individual holds a lien on that property. It should be in the purchase agreement. If you cannot contact the person that holds the lien, try to contact a title company in your area. they should be able to trace the title and lien holder's contact info. The tile company should also be able to assist you about the transfer of title, their is a minimal fee for both parties. If you did not close with a title co. and no purchase agreement, then you can consult an atty and spend your hard earned money... be prepare for a lengthy process... Hope this helps! good luck

    In California: The "title" and the "mortgage" are two separate things. Adding someone to title does not add them to the mortgage. You would just fill out a quitclaim deed granting from you TO you and the new person. The bank would still have first interest in the property since their documents were recorded first.

    I have a house paid in full. my former boyfriend is a real-estate agent & mortg. broker. he's not a ethical professional, and has played me very well. many people are concerned about "identity theft" but i'm conserned about "real property" theft. what can i do to make sure my property is secure? i don't get statements on it like i do my brokerage accounts. so, how do i monitor it?

    Q. If a parent conveys house title to child, can medicaid take to pay for nursing home?

    Elderly parent has no liquid assets, but house is paid for. father is already enrolled, and receiving in-home assistance, but needs to enter full time care. will medicaid make mother sell the house? or can they convey title to one of the children? i know we need an attorney - but they are so expensive - any advice from someone who has lived it would be great? time limits? details? they are in florida. thanks so much for any help.

    It is now federal law that the house has to have been transferred at least FIVE years before the elderly person needs welfare/medicaid assistance to pay for the nursing home. It's called the lookback period. Since mother will still be living in the home, the government will not require her to sell the house. at this time to pay for father's care She will be able to live there until she dies or goes into a nursing home. At that point, the government will go after the value of the house and the children will be required to give that money to the government. There is no way around this since father will need medicaid/welfare to pay for his care in the nursing home. If mother transfers the house into the name of the children, the government will NOT pay for any of the nursing home until the family has spent the value of the house for the nursing home. Let's say that the nursing home costs $5,000 a month, and the house sells for $100,000. If mother transfers the house, then the family will have to pay for 20 months of care before the government pays for anything. Even if mother doesn't go into a nursing home within five years, or even if she lives longer than five years from now, it is too late to transfer the house into anyone else's name at this point in time.

    Q. When someone buys a house on contract, pays it off, but no title/deed?

    The house is paid for and the buyers have reciepts, paid in full. but the seller will not give the title/deed to the new owners. they have had a lawyer send letters and all but with no results. what can they do? they have a lawyer. wouldn't the lawyer do whatever necessary and legal??

The court will look at all the evidence and make a decision as to who the legal owner of the property is. Before filing a law suit and going to court, perhaps you should make one last attempt at speaking with their attorney to find out if there are things that they think you might owe, that you think you don't owe. In other words a meeting of the minds to settle any possible problems. After the meeting and you still have unresolved problems, then you might consider court action against the former owner.     I have a single family home in los angeles, ca. it is paid off in full already. i recently married in nevada and now want to add husband's name to the title, so that in case i pass away, he can keep the property without going to probate. anyone know how to do that without using an attorney or title company?

    Although I agree with the other posts that you may want to reconsider adding him to title . All you need to do is complete a Interspousal deed. For a Free copy go to http://www.fidelitysd.com/ There is a "Interspousal Deed" in the forms/docs section To properly fill out... You will need a copy of your old deed to complete the new deed properly. The new grantor will be "Jane Doe, a married woman who acquired title as (copy exactly as your grantee reads on the old deed) The new grantee will be the "Jane Doe and John Doe, husband and wife as joint tenants" Copy the legal description from your old deed Write "NONE" in the doc stamp tax section and put a check on the "creation, transfer or termination solely between spouses or co owners interest" You will be the only party to sign (sign with your new name) and have it Notarized. You will need to take this down to the LA county recorder along with a completed "Preliminary change of ownership form" - this is also available at the same sight Fill out the top and section I, putting a check in box "A", sign page 2 and your good to go. Hope this helps. It should be under $20 to record. FYI - The "Joint Tenants" status indicates that the property will go to him automatically upon your death.

    Q. How can i add my name to a home title?

    Long story. my grandparents took a mortgage out on their home to buy my husband and i a home since our credit is less than stellar. we pay their mortgage fees as "rent to buy" on the house we are in now. my grandmother wants to transfer the deed of my house (paid in full) into mine and my grandfather's names now rather than on her death. is there any way to do this without having to pay a ton of money??

    You don't say where you live or how long ago the house was purchased. If the purchase was recent or if the house was purchased for more than the current value, you are probably ok tax wise but if this was done some time ago and the house is worth more than the purchase price this is not the best idea. You might be subject to a gift tax and you would lose any "stepped up" basis that you would receive if you inherited the house. Without the stepped up basis you might owe capital gains taxes when you sell the property . You should have a lawyer or go through Virgin Money and draw up a purchase agreement between you and your grandparents for your house. This agreement should spell out all of the terms so that it would be a real mortgage so that you will actually own your house (subject to you making the mortgage payments), should your grandparents pass away. Otherwise, that house becomes part of your grandparent's estate and subject to their will or trust. In that case, you may find that you wouldn't actually own your house, it may go to Uncle John or Aunt Jane under the terms of the will. It is less than $5K to set up a mortgage through Virgin Money. Your Grandparents would hold the mortgage on your house and that way you pay your grandparents your mortgage payment for your house and then your grandparents can pay the mortgage on their house. You can all deduct your own interest payments and you will be covered legally in the case of their deaths.

    Q. What can i do if i paid my mom in full for my car & she won't sign title over to me?

    I'm sorry this is a little long but any advice would be appreciated very much. my mother bought me a 2007 pontiac g6 in october, 2007. she got the car from my brother in law's family who deals in used cars and this one was previously wrecked but they fixed it. she said she would pay for half of the car as a christmas present and the other half i could make payments to her and not be charged any interest on the loan. sounded great to me. i made my monthly payments and then in february of 2008 when i got my income tax check i just gave it all to her and paid the whole amount left. i trusted her but she never gave me a bill of sale or the title to the car. i have talked to her a couple of times about this because if i wanted to trade it in i can't because she has the title written with my name on it and her name as the lien holder. she told me that she didn't trust me and that i may go to title max and pawn my car title!!! i'm like wtf? that is my only set of wheels and i've been working at the same company since 1993 and have a 9 year old son. i would never do anything like that to risk losing my car. when i mentioned the fact that i could not trade the car in if i want to one day (which i don't plan on doing anytime soon because it's paid for) she told me she didn't buy me that car to trade in on a gas guzzling pick up truck. that's another issue. my father died in 2005 and i was driving his dodge dakota and she sold it for a little of nothing to my brother in law to make money off. now i do need a truck just to haul stuff in and she's remarried so her new husband has a truck. i would have bought it from her. it's real tough for me because me and my son was living with my mom & dad when i got a divorce and when he died me and my son found him. when she got married 2-1/2 years ago, she told us we could move into his town home and pay all the bills but they wouldn't let me pay any rent. they claimed the stock market causing the real estate to drop was the reason he didn't sell it but i have had to spend alot of money to fix that place up to be "livable" for me and my son because it was just nasty. he didn't even get his stuff out and she wanted me to hurry and move our stuff in.now, all the tools and things that my dad worked hard to get all his life belongs to my step father now. i had to borrow my dad's pressure wash the siding on the house which was moldy. i feel weird having to ask him to borrow my dads things. all he left as far as tools at his place was a hammer, screwdriver, some nails, tape measurer and an empty little tool box. weedeater is broke and after dad died my boss gave us a john deere weedeater and edger because i was doing all the yardwork and he felt sorry for us so now that belongs to my step dad i guess. i wondered where his tools were but he lucked up and moved into a quarter million dollar house that has a whole big basement full of tools and equipment that belonged to my father. when i got the pressure washer, he was telling me stuff like "don't break it...make sure you turn the water on before you crank it or it will blow up the motor" etc... i'm not that stupid. i'm starting to get scared that when i get that place looking real good on the outside, they may decide to sell it then we will be out in the street trying to find a cheap apartment. like i said i have tried talking to her about the title in a nice friendly manner and she always ends up getting defensive on me and totally refusing to give up the title. does anybody know what i can do? also, when a person dies in alabama and everything goes to the wife and they get married, am i right by saying that whatever is hers is his? she even gave hers and my fathers bed and dresser drawers that they always had as far as i can remember and i'm 38 to her husband's brother. i got stuck with step-dad's bed with a warped mattress just like the couch me and my friend tried to haul to goodwill and they wouldn't even take it so that i could put one i wanted in there. my ex husband kept most everything i had bought for his house so i'm having to start from new.

    Sure. Your posting is not clear, nor are your questions. Is this cash purchase? Is house to be titled in his name or yours or both? Is there a written agreement between you two? You need the money in your bank for some time before applying for the loan, if it's to be in your name. And you will have to account for where it came from. If HE is buying house in his name, he will be on title and you won't, and there's no problem.
