    Q. Does a landlord have to give notice of selling the property in ontario?


    We applied for an assignment due to ongoing issues with our rental unit. We are also being heard at the Rental Tribunal as part of the issues in the home. The other day the owner put the house up for sale. That is obviously going to make assigning the home that much more difficult for us......any direction on how we should proceed with this?

    Hi there, i've had a bad landlord for a year(from september 2008) and since i am moving out soon, i want to make sure i will be able to protect myself by legal rights. she said she "needed the property" but we are sure they are looking for a new tenant. we agreed to sign up for two years (verbally though) and also agreed to their offer of paying additional 50$ just because she said we could stay for a very long term if we wanted. she also lied about the people next door- she said it was a single lady, but in fact, it was a son of the lanlord's and his 7months pregnant wife. yes, we dealt with a screaming baby for the most of our stay at the place and now the baby is finally maturing and less-crying, they are kicking us out! moreover- she did not install some stuff by the fixed date, tried to kick us out for whatever didn't make sense with "two weeks notice", and she ignored our emails every time when we asked something or when we explained that she had no rights/reasons to kick us out. we have an absolute barkless dog, the landlord hates dogs like crazy but she could not find a reason to complain about our dog. now we know that they are going to find every single "damage" to claim, because that's all they can do... what kind of damages am i responsible for specifically?? small scratches(only noticeable with sunshine) on the hardwood floors? holes from nails/screws on the walls? we are not going to sue them for how they treated us because we simply do not like fighting, but do we have to pay for the cost if they do argue about those "damages"? if so, are we going to be able to argue back in court for what's listed above? since even this time they did not give us notice of period properly, we really do not have time to do repairs and do not wanna pay for that anyway, and we just want to move out and not see them again... additional question is: is it legal or illegal to register residential building as commercial? (we had to go to public garbage because there was no garbage collecting for us, which we had no idea when we signed up...) the front of the building is a convenience store, and our apartment unit was added by expansion just before we moved in. i live in ontario, canada. it will be more than helpful if you can give me an answer or advice.

    It sounds like normal wear and tear, which you are not responsible for. The Ontario Residential Tenancies Act (section 34 I believe) basically says a tenant is responsible for the wilful or negligent damage caused by the tenant(s) or their guests. Take photos of damage. It may even be helpful to have a walk though with the landlord prior to leaving, and each sign off a check list of the condition of the apartment. If you do get sued in small claims court, I suggest you hire a good licensed paralegal to represent you.
