    If you are on Ontario Works and you are the support recipient, and your court ordered child support payments ( or payments laid out in a legal Domestic Contract such as a Paternity Agreement or Separation Agreement) are in pay, you will continue to receive them directly. Ontario works will deduct any support you receive dollar for dollar from your OW cheque. If you are not receiving all of your support as ordered by the court ( or as per a Separation Agreement that has been filed with FRO for enforcement), Ontario Works will have you sign a legal document "assigning" the support order over to them while you are in receipt of OW. They will pay you your support. When you go off OW, they will canel this assignment. In the interim, any money owing during the "assigned" period" will hen owe OW the money.

    Lucky for you I'm quite familiar with Ontario Works ... I'd been subsidized by them for just over a year until recently. They take dollar for dollar. If you get 300 dollars in support, they take 300 dollars from your assistance. Edit ...... the amount doesn't matter. If you get 600 in support, they take 600. AND, if the amount you are getting for support is not deemed satisfactory, they will seek to up the amount. They automatically investigate the support paying parent, checking his work stubs, information, etc .... then make a judgement based off his income of how much he has to pay. They will attempt to get him to sign an out of court contract that THEY file with the courts, but if he won't, they pursue court action on your behalf for higher support. If you don't cooperate, you lose your assistance.

    How would the courts in ontario calculate a monthly child support payment for our 2 children, if their father is only working on a casual/ on call basis? the father is only guaranteed 16 hours every 2 weeks, the rest of the hours are, on an on call basis. (health care). the monthly earnings are never the same. (i realize that they base it annually, but in order to come up with the initial payment amount, they need to know how much he makes per paycheque... which is never the same).

    The Court will not accept an on call position as it will not be considered gainful employment. They will essentially take what you could make hourly and compute it out to full time and take a percentage of that and instate it as support. A Court may order you to attain full time (40 hours) of employment and become gainfully employed or they could default to the job you worked before the on-call position and use that as your wages for support.

    Why go to court, their his children. He should pay whatever she pays towards the children. 50/50 Give him the receipts. Stop asking this question. Get help.

    Q. Ex-wife applying to courts to raise child support payments?

    I live in ontario. after 9 years, my ex-wife is applying to the courts to have the child support raised to reflect my current salary. what are my rights, if any, in this case? she has been living with another guy for about 7 years, they both work, she's doing this simply because she got mad at me. also, in our original separation agreement, it is stated that i will pay until our daughter finishes her schooling. how enforceable is this now, nine years later? i would really like the payments to end when she reaches 18. she is 13 now. any help would be appreciated!!!

    Ontario - 12 years married - without children husband 43, wife 40 husband's income $60000/a both healthy with no mental infirmities. wife never worked outside home, but owns small business husband pays all expenses including wife's business expenses wife training to be a hair stylist wife cashed in spousal rrsp multiple times totalling over 15k both before and after separation.

    expect about $1000 permonth for 6 years.

    Q. Is canadian tax benefits considered income in providing support issues?

    I am a citizen of canada so is my x-wife. we got seperated mid this year. according to my income, i am paying $866/month for two child's support and $98 for daycare. i am also paying interest of loan of $30000. i am paying $200 over the rent i get for an appartment for mortgage + maint in a ontario.( i live and work in alberta). i am also paying car payments of $400/month. she filed a case for spousal support and got approval by court of $300/month.now i am paying $1250 for total support payments. i pay $825/month for my apt rent and about $500 for my own expenses. she works part time and makes $1300/month. now according to my calculation, her income is more than my income. which includes total of $800/month in canada tax benifits, 1250 for my support payments, $1300 her own income from work. she has not much expenses. my question: is canada tax benifits of $800 is considered as income or not? providing that raising two kids does not cost $1650/month. my financial position is getting worst day by day. i have showed my concern to my lawer but she is taking time to research. i think this should be fairly common situation for couples separating. please help me..

    I wouldn't think taxes get accounted into the income equation but you never know. I think you are on the right track - your lawyer will know best.

    Q. How much spousal support should be in my case? marriage lasted 7 years, i did not let her work as i wanted her?

    I live in edmonton, alberta, canada.i make $60000/year. take home income/month is like $3200. i pay for the car ($407/month),i pay for gas $200, insurance $85, this car has to be sold and divided equally. i own an apt in ontario (it is rented out for $900- so total monthly net income $4100. it has to be sold and divided equally) and i pay extra $200 on top of rent for mortgage and mantainance. i pay $400 for interest on the loan which is in my name but was used for family expenses.i pay $825 for my apt rent in edmonton.i pay $866 for two kids (7 and 2), $96 for child care, $300 for spousal support. lawyer fee goes from credit card so i pay minimum payment of cards ($100), i have paid over $5000 to lawyer already. after all expenses $621 is left. i have not included my expenses like eating, cigrets, laundry, etc. my credit card balance is building up day by day. my ex-wife works part time two places, dental office where she makes $20/hr for7 hours 3 days a week (about $1400 as dental assistant after tax/month)(she works intentionally part time here i think) and a&w two days/week where she makes (minimum net$500/month). she probably gets about $700 or more from gov for universal and ctbt.$1262 form support payments. so according to my calculation her net income is $3862. after all expenses she probably saves $20000/ month. she got financial aid from gov so did not pay much to lawyer. there is no loan on her as i paid all her credit cards when in marriage. now, my question to all readers is: is she entitled to $300 spousal support what judge ordered without looking my expenses. it has been 7 months since we separated. she asking for my share for her computer repair expenses and my lawyer says that i must pay it. and i say why? is she entitled to spousal support ? should i change lawyer? is gov support for kids considered income in this case? please help i am in deep pain. she pays $1200/month including electric, cable tv. may be $40 for cellphone, $35 for laundry, max $500 for grocery because she cooks home, she used to buy a bus card for $60. medical is provided by my company to all of them. she recently baught a car. these are her details, i did not forced her not to work, she could work in a call center but i supported her to go school and take a dental assistant course. $1200 (is apt rent) here in canada, child support is according to non custodial parent's salary, here in alberta for two kids is $866 child support, its like cast on stone. no one can change it, unless i am able to take more than 40% custody and kids start living with me some of time.

    You neglected to mention how much her rent/mortgage is, How much she spends on food and clothes for her and your children, vehicle expenses. Medical bills (if this applies) utilities, phone, insurance and anything. once you calculate what she has left over i could answer weather she deserves $ 300 dollars from you.

    Q. Girlfriend left me (without telling me) with our son and rarely lets me see him, we have no custody arrangment?

    We split up about 8 months ago, it started with me taking a oilpatch (she said i should) job to pay for her to go back to school, and when i was gone to work (15 days on 6 off) she'd stay at her mothers, over time she just stopped comming home when i came back to town and moved out. she said "she needed space", and i figured the poor girl just gave birth, and i was gone alot, so i decided to let her have space. as time went on, she started dating a guy (while i thought we were still together) and applied for welfare without telling me. now, 8 months later she wont let me see my son, (maybe every other week for 10 minutes if im lucky), she wont let me have him over for my week off, and i found out she told our sons daycare that im not allowed to pick him up. we were engaged but never got married, and when we split up, i thought it was on good terms and it was temporary so we never went to court for custody arrangments. does anyone know what my rights are? can i go to the daycare and demand my son? can i have him for a few days without her permission? can she refuse to let me spend time with my son for weeks at a time? can i take him home to ontario (from alberta) to visit his family (its been 8 months and shes refused to let me take him to meet my side of the family) without her permission? i know i need to get a lawyer but ive been spending all my money trying to pay for her new car and to give my son what he needs so i have to save a little before i can afford one. i dont know if its relevant but she used to be a coke adict, has health issues, has never held a job, lives with her mom, and had had much therapy over the years. do i have a good chance at getting full custody if i change jobs to daytime work? she says she doesnt want me to have my son overnight cause i dont know how to be a parent... i ask to see him literally every day but shes alwayse with friends, ive missed the first 9 months of my sons live because i was trying to give her the space she said she needed, and i dont want get bullied out of my rights because i was trying to do the right thing. if i never signed over my rights (obviously i never would never do that, and we have no custody arrangments whatsoever) can the dayhome refuse to let me have my son? i know he has lived with her for 8 months but i thought we were working our problems out which is why i kept working in the oilpatch thinking i was supporting them. also i never signed anythign saying what i was giving her for child support cause she said "i took care of it, they think your giving me 500 a month", but last week she called me and told me she told them "your making my car payment and insurance payment" (about 995$ a month which i have been) instead of child support, and having found out she is dating a guy in jail who she left me for, i dont much want to pay that much, can i take the car back and just start making child support payments? is it even legal to have a car and insurance payment instead of child support? can she tell them i have to pay that without my permission? i never signed anything saying i was doing that, heck, i havent signed anything at all since the birth certificate. any help would be great, i know i crammed alot of questions in there but thanks alot :)

    First, you should know that you voluntarily gave up your right to see the child the moment you stuck your pecker in her. And no, ignorance of the laws is not an excuse. You know have the right to petition the courts to see your child, and to grant you parental rights. This does not mean you are not on the hook for child support, as that is a completely separate issue, which so far you have paid none. Anything provided her, without a court order, is a gift. In a California case, the children of David Bren, (age 18 & 22) were allowed to sue their father $134 million dollars in retroactive child support. The parents were never married. However, since 1988 the father paid the mother $18,000.00 a month in child support, without a court order, so it was a gift. They lost the case, but only because he had the money to fight it. What you need to do now is to learn how to prepare before talking to any attorney, but first, and presuming you are the father of the child, you need to set up a voluntarily child support order. You can do this on your own at Child Support Enforcement. However, if you are not the father, once an order is in place, you cannot have it stopped later if it turns out you are not the father. Over 30% of paternity tests come back negative. These links will teach you what to do. It is not going to be easy, and if you are loaded with money, you could just skip the hard work and go straight to hiring an attorney.
