IF YOU ARE STILL RENTING THE SUITE OR APARTMENT AND THE LANDLORD NEEDS TO SHOW IT TO PERSPECTIVE OR FUTURE TENANTS OR HE/SHE HAS TO DO SOME REPAIR OR JUST NEEDS ACCESS FOR SOMETHING TO YOUR SUITE, YES THE LANDLORD NEEDS TO GIVE A MIN. 24 HOUR NOTICE AND THAT HAS TO BE IN WRITING AND NEEDS TO BE POSTED ON YOUR DOOR OR GIVING TO YOU PERSONALLY. HOWEVER, IF THERE IS AN EMERGENCY SUCH AS A FLOOD, OR SOMETHING ELSE THAT REQUIRES IMMEDIATE ACCESS LIKE SMOKE IS SEEN OR SMELLED IN SUITE, THE THE LANDLORD DOES NOT HAVE TO GIVE A 24 HOUR NOTICE. ALSO, JUST SAY YOUR STILL RENTING, BUT YOU HANDED OVER THE KEYS BEFORE THE LAST DAY OF YOUR LEASE, THE LANDLORD CAN ENTER THE UNIT OR SUITE. ANOTHER TIME, HE CAN ENTER WITHOUT A 24 HOUR NOTICE IS WHEN THE SUITE APPEARS TO BE ABANDONED, BUT HE MUST BE POSITIVE OF THIS FIRST.

I'm moving out of my property at the end of the month. we had cleaned our apt to a point where it was cleaner than when we moved in. we had paid our last months rent & moved out early just due to convenience and we thought it would be nice since the landlord had treated us so well that we'd have the place empty for the month so he could try to find new renters for september. we got a call on the day we were supposed to do the walk through that he said the apt was still dirty and we had to do extra work. we didn't think we missed anything but agreed to postpone the walk through until a later date so we could get the cleaning done he was talking about. i got phone calls from my friends/family asking if i was still living in the apartment b/c lights were on and there were people inside. we called our landlord to see what was up and he said that he'd been cleaning for 10 hrs and was automatically deducting $500 off of our damage deposit. we stated that we had said we were coming back to clean it still and had until the end of the month and we were under the assumption that he had to give us 24 hrs notice before entering our property. he got really rude and angry and said that he'd give us the whole damage deposit back but is going to tell everyone how "disgusting tenants and people" we were. i'm not sure where's he's coming from b/c we had an agreement that we would be back to clean the property (even though it was already better than when we had moved in). what i'm not sure about is.. if he decides to keep some of our damage deposit anyways is this legal? plus, is the threat of slander something we could report to the landlord tenant act people? i'm really not sure where to go or what to do from here. i live in alberta, canada.

Leaving a place cleaner than when you moved in is good, but not necessarily clean. You're right if you had another month left on lease, LL was out of line going in and cleaning without notice to you and after your conversation that you would come back and clean. You've already moved, so apparently don't need a LL reference. Not sure who he is going to tell what. Suggest you put the whole in writing in nice businesslike letter to LL stating the lease term, the fact that you cleaned, the fact of your discussion and your promise to come back to clean, the fact that you paid rent for that month, the fact that he entered without notice to you. State that you have fulfilled all parts of your lease and respectfully respect a walk-through on X date and a full return of your deposit.
