    Yes, but they have to give sufficient time for you to move or If your new owner wants to rent the lease can be transffered.

    I signed a lease for june 1st to may 31st. during this time the landlord whom i signed the lease with sold the apartment which i am living in to a different landlord. at this time a new lease was not signed between me and the new landlord. is the other lease void or can they transfre the lease without my approval or knowledge?

    Approval? You are not involved. Your lease was sold to the new landlord and is still binding. The landlord can not change it until it expires.

    I am leasing a commercial free standing building for my pizzeria business. i am in my third year of my first five year lease and have 2 five year lease options left. if he sells the property does my lease become void?

    no, it is not void, your entire contract was sold too and is binding to the present owner and any future owner.

    I am looking at buying a property that has renters occupying the property who have signed a lease with the current owner. if i decided to buy the property is that lease still in affect or is it null in void at that point? this is in wa state.

    If you buy it the lease is not void. The lease goes with the property. You will be required to let them stay through the end of their lease or buy them out of it. This is general law nation wide.

    My tenant is 1 month behind in his payment. i did not evict him. in the mean time, i am thinking of sell the property. am i bound by the 1 year lease, or the lease is null and void because he missed a payment? if i find a buyer, is it ok to sell it?

    No, you'll have to evict him in order to terminate the lease. As far as selling the home, you can sell the home regardless of whether you have a lease or not. The new owners would have to honor the lease until it's expiration date or until they come across a reason to evict the tenant.

    Q. If i signed a new apartment lease when my old lease was still in effect, would that void the new lease?

    I live in california. the thing is i signed a lease with the landlord on june 30, 2006 for a 12 month term. on july 5th, 2006 this landlord sold the property to a new owner. this new owner sent me a lease renewal in december 2006 when my lease still had 6 months to mature. i signed the new lease because of the concession that they had at the time. now, the new lease runs until dec 30th, 2007. now i'm up for renewal again, but there is no 6 month lease option and i have to move in about 6 months! (actually the owner said he would let me sign a 6 month lease but will increase the rent by 50 dollars!) i don't wanna pay 50 dollar increase each month so i told them about the lease error and they would ask the owner what to do. now, the question is shouldn't the new lease void because it violated the old lease? shouldn't i be able to keep my current lease without signing a new 6 month lease because technically, i already signed a total of two 12 month leases. experts only thank you.

    As I understand your question, the lease that you signed has a termination date of December 30, 2007. After that date there is no valid lease. Your landlord has offered you an option of 6 months at a slightly higher rent, which is normal. The new lease did not violate your old lease in any way. You apparently signed it voiluntarily. If you had objections you should have made your objections known at that time It appears to me that you voluntarily agreed to have the lease terminate on December 30, 2007 rather than June 30, 2008

    Usually the lease would transfer to the new owner....unless the lease states otherwise.

    We lived in the same apartment complex for 2 years with three different leases with the same landlord. then the property was sold in the middle of our last lease. we gave notice but unfortunately did not have enough time to clean the carpets. trust me, i'm not stupid and i was able to clean the carpet in spots with a wet rag. it was just dirty from living in colorado, with snow and dirt. it would have cost $100 to clean the carpet, i got a quote. new land lord sent out bill for replacement of carpet. she will not send us a copy of the bill from the company who replaced the carpet. we don't think it was replaced. we have a copy of the lease and it was not signed by the old landlord. i looked up the law and it states that the contract is void if both parties do not sign, but if terms of contract are carried out it is valid. we carried out our part but they did not do theirs. the never fixed the cabinets, sinks, or the shower, and the air conditioner was broken for most of the summer. i just don't know how to deal with this. i have contacted a lawyer and have talked and talked and left message after message but htis lady is impossible.

    YOUR copy of the lease may not be signed, but I'd venture management's copy is signed. As long as the landlord has a copy of the lease signed by you and by the former landlord, you're out of luck here. There is no requirement that YOU have a signed copy. You do have a right to see the bill for the replaced carpet, and I'm sure one will be provided. Meanwhile, you're going to learn a very expensive lesson for cheaping out on a $100 carpet cleaning job.

    Q. Can i break my rental lease?

    I signed a year lease with the property managment company i am about 4 months in. i am looking at moving but to move you have to give your 30days and pay your months rent plust an additional months rent. now the property recently was sold to another managment company and have yet to sign any lease with the new company so does that void my previous rental contract since the company i signed with no longer has any holding here?

    I'm not sure what state you live in (or country) but... if you don't get a signed note releasing you from the terms of your lease agreement, they can come after you for the total sum of the lease agreement. Meaning even if you give 30 days notice (which generally is expected a month prior to the end of the lease) you are still liable for payment to the end of the lease term. You have only 4 mos in so you would still be liable for 8 more months payments on a years lease. So make sure you have been released from the terms of the agreement.
