    IF YOU ARE STILL RENTING THE SUITE OR APARTMENT AND THE LANDLORD NEEDS TO SHOW IT TO PERSPECTIVE OR FUTURE TENANTS OR HE/SHE HAS TO DO SOME REPAIR OR JUST NEEDS ACCESS FOR SOMETHING TO YOUR SUITE, YES THE LANDLORD NEEDS TO GIVE A MIN. 24 HOUR NOTICE AND THAT HAS TO BE IN WRITING AND NEEDS TO BE POSTED ON YOUR DOOR OR GIVING TO YOU PERSONALLY. HOWEVER, IF THERE IS AN EMERGENCY SUCH AS A FLOOD, OR SOMETHING ELSE THAT REQUIRES IMMEDIATE ACCESS LIKE SMOKE IS SEEN OR SMELLED IN SUITE, THE THE LANDLORD DOES NOT HAVE TO GIVE A 24 HOUR NOTICE. ALSO, JUST SAY YOUR STILL RENTING, BUT YOU HANDED OVER THE KEYS BEFORE THE LAST DAY OF YOUR LEASE, THE LANDLORD CAN ENTER THE UNIT OR SUITE. ANOTHER TIME, HE CAN ENTER WITHOUT A 24 HOUR NOTICE IS WHEN THE SUITE APPEARS TO BE ABANDONED, BUT HE MUST BE POSITIVE OF THIS FIRST.

    Q. Getting evicted in edmonton alberta. need some help!?

    I got a 14 day notice of eviction and i immediately gave the landlord a notice of dispute. now we have a court date of june 7 so i am wondering, 1. if the court says i have to move out before the end of the month will i get the remaining days worth of rent back for june? 2. will i get my damage deposit back? there is no damages in the place.

    If there is no damage, you will get your deposit back. However, consider this. Since it is you taking your landlord to court, you will have to pay court fees. It isn't cheap.

    (alberta, canada) i am living with a tenant, but i have not signed the lease agreement. i am 20 years old and the age requirement for the housing is 21. my roommate was informed that although the min. age is 21, it would be okay for me to live there, just as long as the lease was co-signed when i turn 21. the representative told my roommate when the manager asks "is there anyone else living with you?", to say that "i am looking for a roommate, but i have not found one yet" . he is not a manager, but was representing housing at the time. my roommate told the manager what he was told to say stated above. 3 months after the lease was signed, my roommate received a phone call from the owner of the apartment complex asking "is 'that girl' living with you?". my roommate said yes. the owner said "she can't live here because she is not 21". although my roommate was notified of the age requirement, he was assured it would be okay if i lived there. nowhere in the lease does it state that i have to be 21 to live there. i researched a bit and came across "notice to vacate" under the residential tenancies act - applicable to "people who are not tenants and who are living in the residential premises with the tenant, and who are not authorized by the landlord to live in the residential premises (14-day notice)." (http://www.servicealberta.gov.ab.c a/pdf/vcop/code_of_practice.pdf) although i have not violated the lease agreement, can i still get evicted?

    "You can't just move into property you do not own..."



    You are living there illegally. There is no lease agreement. You can't just move into property you do not own. You have got some balls, I will give you that.

    My landlord gave me a 14-day eviction notice because by june 23 the rent for june was not yet paid, as i lost my job. i am starting a new job, but will not have enough money saved to move out in 2 weeks. if he takes me to court, how long does that process take in alberta?

    usually they are suppose to give you a 30 day notice....

    I was issued an 14 day eviction notice the other day, claiming that i have been smoking marijuana on my premises and a neighbor got sick (east indians) ( i do smoke it but not on the property) he has no written complaints from any tenants in my building only phone calls... i'm relatively confident we will win this dispute, as the lease has the wrong address, the wrong name of my roommate ( since has been corrected, but was never given an updated copy of said lease) the clause under which he is evicting is states that if local police involvement occurs they are to investigate to see if said activities are actually being conducted (since recieving the notice and quitting smoking it ive seen 10 times the police force around my home)... like i said, noone has followed up on these complaints!!! not police or landlord... my appeal hearing is hopefully tuesday, btw im in alberta canada thank you, lol he has no proof of this, everything is all hearsay, which will not stand up in court, like i stated noone ever followed up on any of the complaints

    If there is proof that you have been conducting any illegal activity at or in the rented premises, you can be evicted. But, there must be proof.
