My landlord gave me a 7 day notice in august since than i gave him money but now he is threating eviction does he need to give me a new 7 day notice

    I live in a one bedroom appartment with my fiance and we are expecting our first child within the next 2 months. my landlord is a b*tch. when i first moved in, she told me that she does not tollerate: drugs alcohol or loud music and that if she hears of us doing any of this we will get a eviction notice. but recently i found out that she plans on coming around to all the apprtments to check if they are clean. (vaccuumed and dishes done clean.. not clean of drugs/alcohol) but she has not told anyone about this. i had to hear it from a friend of mine who also lives in my building. and if your apparment is not clean, you get a 24 hour eviction notice. i know its illegal for her to come to your appartment un-anounced. you have to give at least a 24 hour notice before you show up at someones appartment, and even after that, you have to give a 30 day eviction notice. i live in alberta canada and i want to know if there is anything i can do about this landords dictorial ways.

    Tenants have so many rights its frightening. In your nearest metro city there is a Ombudsman who deals with nothing but rental issues. Call the office state your claim and wait for your landlord to appear. It is always best to be for armed. To hell with the dishes its none of her business, I would probably leave them i the sink just out of spite. You may have to do some research to find the office of the Ombudsman- it may be county, city, provincial- but my best guess would be county. Either way make the call and ask for some directives.
    Someone said: In Alberta, she still requires more than dirty dishes or an unmade bed to evict a tenant. If she did provide an eviction notice for not being clean you would need to provide a letter of objection to her to nullify the eviction and then from there she could proceed to either a court hearing or an RTDRS hearing where her eviction would likely get thrown out.     My landlord gave me a 14-day eviction notice because by june 23 the rent for june was not yet paid, as i lost my job. i am starting a new job, but will not have enough money saved to move out in 2 weeks. if he takes me to court, how long does that process take in alberta?

    usually they are suppose to give you a 30 day notice....

Barring that you could meet with your landlord and explain the situation to see if they would give you an extension. If you pay the rent before the eviction date comes due it is null and void. If you don't and she ends up taking you to an eviction hearing they may, and I state may put you on a payment plan to catch up if you have shown you have tried to cooperate.     Two questions, please help! need advice and now everything is closed for the weekend, so i cannot call anywhere. i am in a bit of a bind and would love some help on anyone that might know about this. i was behind on my rent and wasn't served an eviction notice by my landlord, instead it went straight to civil court. my hearing is on tuesday. what i am wondering is, i took over the lease of this apartment from the previous renters, they paid their lease break fee and everything was transfered to me. including a new lease which took effect august 1. 2010 when theres was up. the court papers that were served to me 3 days ago, do not have my name anywhere on them, the previous tenants names and lease that they had etc are attached to the paperwork, nothing of mine, i read online that if there is a discrepancy in names that are on a court hearing, that the whole thing could be throw out because of the dumb mistake on their part, is this correct? also i was told by alberta landlord tenant act that if i paid the amount due in full, no eviction would take place and it would be null and void, this was said when there was no court date set, just the threat of it. my question is because court is now happening, if i pay the full amount due still with court going ahead, can they still kick me out or is that null and void as well like it would have been before? serious answers only please. thanks would it be in my best interest to keep the money and find somewhere else to live? i'm scared that if i pay them then they are gonna kick me out anyways and then i will have no money for a new place. hmmm

    It is your choice of course , but I would not pay them. Sounds like you have a case for civil court. If you lose , you pay so hold on to it now and see what happens. Good luck. PS Get all your info and paper work in order. Explane things simply to the judge. Don't go on and on. :)

    Q. Eviction - do i have to pay if i had already given my notice anyway?

    Here's the story - it's my boyfriends apartment. money's been tight, and we gave our notice to move out may 31st/08. we put a stop payment on the rent (rather than getting an nsf) and our plan was to let them use the damage deposit and then whatever was left owing, square up when we left. well, our one landlord, who's a bit of an ass, showed up tonight, yelling at us demanding rent and then threatened to call the cops cuz my boyfriend closed the door when he was yelling. he put an eviction notice on the door for the 21st of may saying we owe our rent of $550, plus $35 (for what it doesn't say) plus $2.50 a day (also, for what it doesn't say) until we are gone. he has $475 of a damage deposit (and no damage in the apartment at all). do we have to pay all that crap or can we just say screw it and leave? it can't affect our credit if it's just direct deposit, and who would sue someone for $100?? any help would be great... thanks ps we live in alberta canada if that makes a diff

    You need to consult an attorney that knows landlord tenant law in Alberta. You also need to show him or her the lease. Barring that since it seems you are quite tight on money be aware that it is quite possible your lease has a clause that entitles the landlord to the $35 and $2.50 a day. You should not assume that the landlord will not pursue this. If the landlord decides to pursue it as an abandonment then he might be able to get a default judgment against your boyfriend and that wont help your boyfriend's credit history. If your boyfriend can afford it he should pay it, especially if the landlord is legally entitled to it under the lease. The last thing your boyfriend needs is to apply for another apartment down the line and have that landlord run a credit check on him and see a default judgment for non-payment of rent.

    Q. Getting evicted in edmonton alberta. need some help!?

    I got a 14 day notice of eviction and i immediately gave the landlord a notice of dispute. now we have a court date of june 7 so i am wondering, 1. if the court says i have to move out before the end of the month will i get the remaining days worth of rent back for june? 2. will i get my damage deposit back? there is no damages in the place.

    If there is no damage, you will get your deposit back. However, consider this. Since it is you taking your landlord to court, you will have to pay court fees. It isn't cheap.

    I was issued an 14 day eviction notice the other day, claiming that i have been smoking marijuana on my premises and a neighbor got sick (east indians) ( i do smoke it but not on the property) he has no written complaints from any tenants in my building only phone calls... i'm relatively confident we will win this dispute, as the lease has the wrong address, the wrong name of my roommate ( since has been corrected, but was never given an updated copy of said lease) the clause under which he is evicting is states that if local police involvement occurs they are to investigate to see if said activities are actually being conducted (since recieving the notice and quitting smoking it ive seen 10 times the police force around my home)... like i said, noone has followed up on these complaints!!! not police or landlord... my appeal hearing is hopefully tuesday, btw im in alberta canada thank you, lol he has no proof of this, everything is all hearsay, which will not stand up in court, like i stated noone ever followed up on any of the complaints

    the court will throw it out since it is incorrect but the landlord will just resubmit new paperwork. show up for that court date and have a bank check for the amount you owe. the landlord can refuse payment and continue with eviction. Get the full amount you owe to them quickly
