We put down a deposit to get a house built and I lost my job and I can`t afford the new house, can I get out of the contract or do I lose my deposit if I back out?

I am buying a piece of real estate and the lawyer as well as the real estate agent say there is no need to sign a "representation contract" with the lawyer, for her to deal on my behalf is this legal and safe? the woodlot is located in nb canada

Not sure about Canada, but in the USA I wouldn't let anyone represent my interests without a Representation Contract.

Toronto, ontario, canada. just purchased a older house (everything newly redone but house is 40yrs old) in july. suppose to move in on monday. lawyer calls and tells me about our neighbours water and sewage pipes run underneath our front lawn (real estate agents leave this out of the details). lawyers tells us to not close on monday until this is resolved. if we don't close the deal on monday then the owner will sue. if we close on monday and the neighbours pipes burst its "our" fault and they can sue. what to do? lawyers knew this in july and didn't inform me until today. real estate agents left this out of the details. my lawyer tried to contact the owners lawyer and they haven't responded because its not their problem anymore. help!!! i'm homeless and i'm supposed to be moving in on monday! don't know what to do! real estate agents are also leaving out stuff in the contract (signed in washer and dryer, water softner as is, etc.)

What to do? ........Lawyers knew this in July and didn't inform me until today. Real Estate agents left this out of the details. My lawyer tried to contact the owners lawyer and they haven't responded because its not their problem anymore..... walk away. Contact the bar; get his atty censored. same with the agent. RE agents have a minimum duty to be HONEST. available to help further

680 sq ft house in point douglas nice area across from community center and near schools. house had a fire by can be fixed or torn down and new house put up. nice lot. there asking for 12,000 dollars canadain ( this is canada ) i've been reading on real estate for some time now and i have a steady full time job but i'm not experienced in real estate investing yet. i took a look at the house on my way home from driving and its a small house, the area is great, really great, for a second i thought the house was a shack because it was so close to the ally and had a huge front yard (theres tomato plants and stuff becuase its a communtiy lot) so the house only has the back lot i guess...any way i have 2000 dollars only, my plan was to put a 2000 down payment and get financing from the seller, as in : 2000 down payment, then i get a certain time to pay it all ( 3 years = 300 dollars per month ). the thing is i'm 20, would the seller even take me seroius? i'd have to pay money to get a lawyer to draw a contract, so i may not even have 2000 for a down payment, only 1000. the house is okay ( my friend said it looks like a shack and thought it was ugly), it needs new windows though thats for sure. i'm going to fix it up and live in it as soon as possible. i haven't called the guy yet either, i just wanted to get advice from people first. and assume i'm the perfect, hard working handy man person, even though i'm not saying i am.

It doesn't sound like you have the resources to tackle this project. Without going into detail I think your idea to purchase real estate is good, but you need to build up your savings, do some shopping, educate yourself about real estate and set some goals. Perhaps in a couple of years you will be in a position to buy real estate. Sorry.

Hi, i have recently ventured into the housing market to buy a new house. the builder has recently put out a marketing campaign for 1% off the price of the homes. i was wondering if i would be eligible for this promotion even though i already signed the contract? is it legal for them to change the price and not offer some sort of discount for people who have signed the contract earlier? i personally think that 1% is alot as it would potentially save me $5000 or more. i live in ontario by the way. i'm just mad because after all it's the same house except cheaper for new purchasers i'm not sure why? i thought there was some kind of law in canada that if something goes on sale the seller must sell it for the cheaper price. i'm not sure about real estate law has this type of law. any help would be appreciated.

I don't know about Canadian law, but a contract is just that. I would suggest speaking to the builder to see if they might be able to offer some other incentive to you of comparable value. Since you committed to your amount, I doubt that they will offer you a refund. You might get them to throw in something else, like an extended warranty or some landscaping. Good luck!

I'm not sure about Canadian Real Estate law, but a lawyer can represent you in his/her capacity as an attorney without a real estate contract. If you have a retainer, that should suffice. The attorney should not be entitled to a real estate commission, if you are also paying fees for the representation as an attorney. Good luck!
