    Q. What happens when your bank won t renew your mortgage?


    Did you speak to a mortgage specialist in that bank to see why the mortgage renewal was declined? You should shop around using a mortgage broker to see what you are qualifying for.

    Q. Can the bank refuse to renew your mortgage?


    ON Canada - would you know why they do not want to deal with you? Did you have a run in with them in the past?     Q. My landlord has defaulted, and the house is being foreclosed..?

    My landlord stopped paying the mortgage in january 2009, and it wasn't until march of 2009, that we got a visit from the bank he took the home loan from showed up at our door assuming that the landlord lived there, and the bank rep explained about the home going into foreclosure. well, we've been trying to get a hold of the landlord for some time now.. he won't return our calls, but will e-mail us responses. as far as the rent, the bank stated that he stopped paying the mortgage, so we aren't require to pay him the rent money anymore, since the home is going up for auction on the 17 aug 2009. so since he's aware of the date that the house it going up for auction, and we're still living in it, he decided to call us a couple of nights ago, requesting that we allow him to enter the home so he could remove some items (ex: the blinds, and home fixtures). we've been trying to contact the bank, but because we are the renters and do not have any information to the loan and are not on the loan, they do not really give us any information on what to do. is he legally able to come in, even if we refuse him access, is he still in ownership of his home? (he wrote on an e-mail that he will not be purchasing the home back). i do not feel comfortable with him entering the property especially after the constant run around and how shady he has been (we confronted him on the foreclosure issue, because the bank rep showed up at the door step--and he never even called back--until the other night! and we kept paying rent the whole time, so he had no reasons why he couldn't afford to pay his mortgage--and we originally got a hold of him to try and renew our lease agreement for another year). so if anyone could please tell me if he has rights to enter the premise to remove items from the home (home fixtures--lights, ceiling fans, blinds and etc). i've contacted our local sheriff dept, which said he because he let the home go into foreclosure that he is not allowed access, but he with held that information, so they told him as long as he presents a twenty-four hour notice, that he is able to enter the premise, but it's not for emergency reasons, for maintenance reasons, or to show the home to a prospective buyer or tenants, it's to remove things from the house that belongs to the house. (we live in california). thank you so much for any advice--because i do not know where to go from here, and he's suppose to come by tomorrow. we're still paying rent, even though he's not paying mortgage, so we can let him in, what do we do when he wants to remove the items from the home? the bank said we can live there til the home gets auctioned off, and then we're given a 60 day notice to leave the premise, unless the new owners wants to rent out the property to us, and create a new contract with us, and if the home does not get sold, then we can stay in the home. so this whole time, we are still paying rent, but we're not so sure how we will explain it to the bank when they come over and see that the blinds are missing, and the light fixtures and other things he wants.

    The house belongs to him until Aug 17th. You can not legally deny him entry. What he takes from his property is between him and the bank. You may want to take some pictures of him removing it though, so you are not later accused of theft.

    Q. How should i approach my husband about his hiding a notice of foreclosure from me?

    We received a notice of default; we havent paid our mortgage in 4 months. it was my husband's responsibility to ensure payments were made, he said it was bank error-he had made attempts to pay. he had confirmation #s- i found no evidence of payments on his bank statements. he was withdrawing the $$$ i'd put into our joint account for the mortgage into his account. by looking thru his stuff i found old mortgage statements, as well as notice of default sent last nov-all hidden from me! he never told me about his trip to court in feb of this year to pay $33,000 to save our home. $12,000 was $ he got from our joint, the rest from his father. he was supposed to renew our home ins in jan. he claims he did but the bank is charging us excess fees b/c we dont have home ins.i suspect he never even renewed it. we searched the house and went to the ins place-nothing turned up. wehn i asked him why he didn't tell me he responded "why should i have?" and he avoids me. what do i do?

    Ummm... how bout taking over paying the bills and managing the money? Get insurance on the house, have a talk with the bank and make arrangements to get caught up. Most banks would rather work with you on the payments then forclose on the house.

Is he in debt because of gambling, drugs, etc. You can get caught up on the mortgage payments and what next? You should handle all finances and get his share of the expenses. He has to come clean as to why. If he answered back "Why should he tell you there is a problem", tell him I am your wife !!!

    According to the national realtor association home sales are up 17.4% in the last two months. --quote-- november home sales leap - new york (cnnmoney.com) -- after surging 10% in october, sales of existing homes jumped again in november, growing 7.4% compared with october to an annualized rate of 6.54 million units, according to the national association of realtors. "this clearly is a rush of first-time buyers not wanting to miss out on the tax credit," said nar's chief economist, lawrence yun. november was originally going to be the last month in which sales to first-time homebuyers would qualify for a federal tax credit of up to $8,000. however, that deadline was extended through june. in addition, the tax credit was expanded to cover people who already own a home. they can qualify for a $6,500 tax credit if purchase a new house before the end of june. that should encourage "trade-up" buyers. the strength of sales in november surprised the industry. a panel of experts compiled by briefing.com had forecast month-over-month sales growth of just 2.5% to 6.25 million from 6.1 million a month earlier. the sales total was also a huge improvement over a year ago. sales rose 45.7% over the paltry annualized rate of 4.49 million units during november 2008. the contribution made by first-time buyers is evident in a separate survey nar conducted of its members. they estimate that 51% of sales in november were by newcomers to the market, up a point from 50% in october. normally, first timers account for about 40% of sales. also propelling sales higher were rock-bottom interest rates. the average for a 30-year, fixed-rate loan during the month was just 4.88%, down from 4.95% in october and 6.09% a year ago. with rates that much lower, homebuyers can save more than $150 a month on a $200,000 mortgage. the industry expects home sales to slacken december, partially because of the tax credit's originally scheduled demise. that caused some buyers to push up their closing, stealing sales from december. however, sales will not fall off a cliff, though, according to walter molony, a nar spokesman. "the psychology seems to be turning around," he said. "potential buyers, who had been staying on the fence, now believe we're at or near the market bottom." one x-factor, however, is the vast numbers of homes that may come to market over the next few months. there is a large "shadow inventory" -- homes owned by banks and mortgage companies -- that have not yet been put up for sale. it could be as many as 1.7 million units, according to first american corelogic. in addition, another spate of foreclosures could be hitting the market as a number of option-arm mortgages are set to default. all that may drive prices down, according to shari olefson, author of "foreclosure nation: mortgaging the american dream." and the impact of these renewed price declines could again alter the market psychology. "people think that prices have bottomed," she said. "i don't think they have. people will see price declines and that will discourage them from buying." mike larson, a real estate analyst with weiss research has preached all through the bust that price declines are what will "fix" the housing crisis. "we needed to see prices fall to make ownership competitive with renting again, and to restore the normal relationship of house prices to income," he said.
