    If there is a lean on the house you can still sell your house. But whoever has the lean on it gets their money before you. if the cost of the house is equal to or less than the pay out to the bank you cannot sell it

    I bought a car from a used car dealer. it was towed one day and when i went to go get they said it was not legally mine. i called to the dmv and they said that four transactions had been attempted to get the title. the dealership wasnt even the lean holder it was still in the previous owner name. an officer said they were breaking all kinds of laws. when i went to trade it in two weeks earlier the owner wanted my car repossed. i want to know if i can take them to small claims court to get reimbursed of all my monies??!!

    As long as you have bill of sale you can sue, as you paid for the car "in good faith". No idea how much you can get back though.

    I have a guy that i'm possibly buying a car from, and he says that the car's title has a lean on it set by the bank, and that i can buy the car, but i would have to wait for him to get the title afterward (by using the money i give him to pay the bank off so he can get the title) so he can send it to me with his signature notarized and everything. here is some background info on the deal. i know the guy's name, where he lives, and i have his cell number. i checked out the car in person already, and he is planning on bringing it to my house this saturday so a mechanic can check out the car. at that point, if i want to buy the car, we are wanting to write a legal contract that would say that he has to send me the title once he gets the lean off the title. can a notary make that document a binding legal contract where he has to, by law, send the title to me once he gets it from the courthouse or be at risk of going to jail? thanks. also, is it legal to pay more money under the table than what is written on the title when it is sold between private parties? like, for example, johnny sells a car to sally for 5k, but they put 1k on the title when it's sold so that the tax isn't so high. is that ok? i don't see how it couldn't because you can legally give money to someone for free without a contract, so how could they prove that it wasn't a gift?

    A notary only confirms the identity of the persons signing the contract. It would not become a legal issue unless the other person claimed it was not him that signed the contract. Paying money under the table would be a violation of state law, as it affects the amount of state tax you pay. It would, however, be difficult to prove as the amount is only negotiated between the two of you.

    Q. I may be getting scammed but i cannot figure out why?

    Ok so here is the setup. i come home from work one afternoon to find an express mail envelope leaning against my front door. upon opening said envelope i find only one thing; a completely legitimate check with water markings, security stripe and all the other security measures utilized on your standard business check stationary or whatever. anyways, this check was from a business called sand dollar auto out of galveston, tx. address, phone numbers and all your necessary contact information was included and plainly exhibited on the front-top-left-corner of the check. as well as the check numbering which read 1205. 2 things stood out at me as odd right off jump street. #1. besides the $3,100 dollar check made out to my full including middle name, there was not a thing in the envelope. this was a big fedx or ups type envelope and there was not even a post it note explaining either why i am owed this money, how and why i won this money or why i was chosen to be loaned this amount of money. which if i am not mistaken are your two most common reasons for receiving an unexpected "check" with a large sum of money written out to you. there was nothing on the check stating that if you cash this check you are obligated to payoff the loan blah blah blah. #2 now this may not even matter. this could very well have something to do with the postal service but i found it odd. as i mentioned above, the check supposedly originated from sand dollar auto out of galveston. but the return address on the front pointed to one kurt markham out of los angeles, california. why? does it matter? maybe not. i know this post is getting long and i like it even less than you but there are 2 more aspects that i must convey to describe the whole situation properly. #1. a decade ago i was a dumb, naive 18 kid out on his own with no guidance what so ever. i had just purchased a 1999 (brand spankin' new) mercury cougar. i put about $12,000 dollars down on this car that sold for $24,000 dollars approximate. i paid for half the car up front bottom line. i made about 6 months of payments and then one night i let a friend use it, he wrecked it. not totaled, not even really serious. but the car was not drivable. i had a one way ticket to oahu, hawaii departing 2 days from the wreck. i had my car towed to the nearest car dealership, planning on dealing with this over the phone, having them fix it and sell it for me. i never did talk to that car dealership. over the years i never forgot the car but i did become wiser and i started to realize that i had equity, for the most part, in that car. but i had no idea how i would go about getting any money from it at that late in the game. oh and i was in south padre island, tx at the time of the wreck and the towing to the dealership. spi is maybe an hours drive from galveston. maybe longer than that the point is it is close. so is it money from the sell and profit of that car that they are obligated to pay me before the dealership can receive their funds or something? some kind of title law maybe? this is what i hope against hope it is because my family desperately needs this money. but...... #2 i was laid off from my job about 5 months ago and have not been successful in the job hunt. therefore, i decided to try and drum up some work by placing an ad on craigslist and several other similiar sites under their services heading. it professional, computer guru and network specialist, i proclaimed in my ads. a few days later i recieved an email from a lady who supposedly lived in the uk. she had 20 laptop computers that she needed cleaned, a list of 5 to 6 software programs installed and updated to current status. she would have a shipping company send them to me and pick them up all paid by here. she stated they had just lost their guy who used to do this for them and was in need of someone badly. she made it even more sweet with the promise of a profitable future relationship and other friends who need similar things done and the introduction. i actually had no clue what to charge her and came here and posted my question on how much i should charge per computer. i'm sure you can find the question around here somewhere. with answers in tow i shot her an email stating that i could do what she asked for $50 per unit. long story short she made everything beliveable, i had won the bid and that all she needed was my name number and mailing address and what form of payment i would take. i wrote it all out nice and neat and stated that i would only take a certified cashiers check, no personal checks. i never heard from her again, until about a week later when she must have accidently sent the exact same beginning email seeking a bid on 20 computers, the guy they used to have left and blah and blah and blah. so i ask could she have something to do with this check that mysteriously arrived on my doorstep? if so why the hell would anyone send a check like that. i am not a dumb 18 year old a i know about scams. my wife thinks it is like a computer virus. the creator of the virus can not witness the pain he causes first hand but still he gets off on it somehow. she thinks that someone probably did it to get our hopes up and then send them crashing when we realize the check is fake. to that i argued, why would someone pay the 5-10 $ for the express envelope just to send us a fake $3,100 check. now i called the numbers listed on the check and reached a legitimate sounding answering machine stating that sand dollar auto was closed for the weekend of the 4th. so i took the check to my bank and deposited it, the teller told me an 8-10 day hold would be placed until availability of funds could be determined. the bottom line is that this $3,100 check could literally buy me time to find a job. our home is one step away from foreclosure and this check, if really mine, could keep a roof over my children's heads. but regardless of the answer, i just need an answer. thanks in advance

    Usually these checks have language on the reverse side in the endorsement area written in faded small point type that will limit your options or bind you to some agreement that is more fraudulent than legal. I've gotten similar checks from car dealers where the fine print says the check amount is good for a discount on a car purchase at the particular dealership. If you look into it,you may be getting $3,100 off your car purchase on a car whose price has been inflated to more than $6,000 over the blue book recommendation. You can inquire with the consumer protection department of your state attorney general, but I would not do anything until I was absolutely sure of the gift, loan or repayment or whatever this may be.

    Hey there, thanks for going over my question i'm trying to gain info on a repair that i was contracted to repair by trade i'm a auto & body tech for a body shop located in chicago however i do offer my services for side jobs on my days off the shop i run a advert on craig's list chicago where i offer my services to the public i was contacted by a new customer who had bought a 2008 honda pilot exl from a auction for $7900 the suv was bought under a salvage title it was in a wreck front-end and side swiped the customer bought the suv with out seeing it in person i guess it was a on-line auction whatever the case maybe i always thought a salvage car could only be bought by a dealer or body shop but he managed to buy it when he bought the suv he didn't think that the suv would need as much work as it did because the pictures he saw didn't fully show the extent of all the damage every airbag blew out it needed a whole front-end including a/c condenser & radiator along with the fans etc he also knew that he him self couldn't get it titled because it was a salvage title so i explained to him that i could repair the suv and rebuild his title because the shop i work for the owner is cool like that i asked him and he said he would do it for $400 so i contacted the customer and told him that i could rebuild the title and the suv in-order for him to get it plated and receive a rebuild title i initially charged based on pictures alone $3000 this only covered the body damage (not including all airbags) just the drivers airbag and the rebuilding of the title when the car was shipped i went over there to check it out and it was all screwed up it was way more work than the pic's showed it needed all new airbags the headliner was blow-en down there was a ton of frame damage and a ton of missing parts the car was basically rigged in-order for sale at auction the car wasn't even drivable i had to tow it out of there i don't own a tow truck so i had to hire someone so when i got the car to my garage i broke it down to see what it need i made a list called for parts and the parts alone came up to $2700 alone plus $150 for the tow so say $3000 i told him with parts and labor i would charge him $5500 he agreed and gave me the title a bill of sale and $3000 advancement he i asked for a bill of sale because the auction he bought the car from wanted to much info in-order to get a duplicate because there was no room for him to sign it over to my shop to rebuild the title so we agreed on the price and that upon completion he would owe me $2500 this was over 2 months ago the car has been fixed the title has been rebuild and i tried contacting him going to his house e mailing him etc but i have yet to get a call e mail or a visit from him my boss is hounding me for the $400 the tow guy is also calling me i owe some people who helped me pull the frame because i don't own a frame machine plus all my labor that i put into it the parts even ran a lil more than $3000 which i paid for out of my pocket my boss told me that this guy already owes a lot of money on storage alone and that i have a few people to pay off that maybe i should just sell it to pay everyone off and to ensure i don't lose money i know if i wanted to do that normally i could file for a mechanical lean and gain owner ship over the car but in this case i have the car the rebuild title made out to my shop and a bill of sale so hears is my question if i was to put it up for sale is it illegal could i get in any kind of trouble with the law do i even have the right to do so i know my boss is a money hungry kind of guy and it seems like he maybe trying to talk me into it but before i can even think about it i would like to know if there is any risk involved ? plus i don't really want to do this to the guy but i haven't had any word from him for over 2 months so i don't know if hes arrested or fled the country or what please let me know what you think and respond thanks a lot for reading this long post but i'm really in need of some dam good advice from someone who could shed some light on my situation thanks a lot and have a good one

    Normal people do not walk away from a 10 grand investment , and drop off the edge of the earth for two months. That said, you sound like at least a square guy trying to do the right thing, in a business that is cuttrroat and all about money. A lot of people would have dumped that guy on the floor and taken the money, which says a lot more about your honesty and integrity than anything else. good, do not lose the fact that you have a heart and a conciense. If your contract with this guy is not in writing he would have a difficult time proving anything no matter what you do. He has turned over all the documents to the car to you. The vehicle is fixed, do you know what he planned to do when it was finnished? Was he planning to sell? If so and you do what needs to be done aside from giving him his investment and profit back. then you fulfilled the contract. Can you sell the vehicle, satisfy the debts (if your boss wants storage for two months, try to work a deal, after all, you did all the hard work. Point out to him, this is the first time doing business with that guy, if he likes how that went, he may come back with more cars? so more money for you and your boss correct?) If you sell the vehicle, can you get your cut, pay off the tow, and the frame guys, your boss, and still recoup the guys 10 grand investment ? plus a profit? after all none of this would have happened without him. Keep the money in a bank where its accesible if the guy shows up? and if possible put the dates the work occured for the tow truck, or the frame work as a reference point more than anything (and include the date it was paid off.) Aside from that letting the storage fees go beyond what is normal looks odd even though the guy disappearing does not help. best of luck ace. lets hope the guy is ok.
