    ON Canada - you need to see your lawyer on this. My experience with a past client, as this issue will arise for a property co-owned after a divorce, they were advised to sell the property, split the profit and part ways. A lawyer would be able to give you a better opinion on this matter.

    My husband left me on the delivery room table! He sold all our furniture, my car and broke the lease on our apartmet, donated all my clothes to good will. He kept all the money from all our belonings. He even sold his car, quit his high five figure job, then left an envelope at my mom & dads house that contained, his s.s. card, all his credit cards, cell phone, drivers license, medical cards any thing with his name on it. And he was gone. The baby and I had a little savings, nothing else, no home, clothes,car. Thankful my parents took us in. My husband is now a John Doe some where far away from me.

    If my husband moves out, i will not be able to pay the mortgage on my own. he won't be giving me any money, but his name is still on the title. do you think i can qualify for some type of mortgage reduction, since my income won't be as much? i live in az, if that matters. just trying to find out what i'll be able to do so i don't lose my house. i may be able to get a roommate so that would help of course. any help you could give would be great! thanks people!!!!!

    No, this would not qualify you for any reduction. You still took the banks money and you still have to repay it. It sounds like you need to sell this one and buy another one that you can afford.

    Children. the wife doesn't remember that she signed a mortgage loan. she can't continue to pay for the house so she files bankruptcy on it and moves thinking his children own the house. unknowing to her his kids without a refinance get a new smaller interest rate with the mortgage co. they sign their fathers name and the step-mothers name to the documents for this. so....... who owns the house? the step mom & kids or one or the other.

    This doesnt sound legal, so I would defiantly check with an attorney. When a couple have a mortgage together, they both SHOULD sign a survivorship deed, in case one dies, the house goes to the other spouse, this would have trumped any will. There is no way what these kids did was legal-and I can not believe the mortgage company would have accepted this. This will make the step mother legally responsible for this loan also. Contact an attorney immediately!

    Q. When someone dies and leaves an unpaid balance on their home mortgage, who pays it?

    According to the will my husband cannot sell the house unless his deceased fathers girl-friend chooses not to live in it. there is a balance left on the mortgage, and the will states that she can live in it as long as she wants, but she doesn't have to pay rent,but she is obligated to pay the taxes, insurance and up-keep.

    If there is a mortgage, there is likely to be mortgage life insurance that pays the balance in the event of the death of the purchaser. That being the case, as previously stated, the insurance company pays the unpaid balance. There would be no debt. In the unlikely event there is no mortgage life insurance, the estate pays outstanding debts. In some states, the deceadant's heirs can be saddled with the debt. If your husband is held responsible for the mortgage and he does not want to pay, then tell him not to and let the bank foreclose. That should make up the girlfriend's mind about moving within 90-120 days.

    My husband left just over a week ago and i have found out he has been seeing another woman. i don't work as i have been looking after our 2 small children so he pays all the bills. he won't sit down and talk to me about money etc so i don't know what will happen with my next lot of bills which are due in a few weeks, we have a mortgage etc to pay. he seems to want to start his new life with this other woman and not face up to the responsibilities to his family, what can i do about this? i have been to see someone about benefits so they should start coming through soon but are only enough to cover half the bills. the mortgage is in joint names as are a couple of loans and there are some just in his name too. i am worried that i will end up defaulting on the direct debits next month as i don't even know if his wages will still be being paid into the account cos he won't talk about it. i don't want to lose the house as it is mine and the childrens home but i really don't know what to do. i know i can go through legal channels but if he is totally uncooperative i don't know how long it will take so what do i do in the meantime for money? any responses are welcome as i am at my wits end now and can't sleep. my kids are only 3 and 1 and i need to make sure they are provided for.

    You need legal advice...there are things that can be done to help you until you can get on your feet and support yourself.. Although I support SAHMs, your situation is a good example of why a person should always have marketable job skills to fall back on (male or female), because you never know when you're going to need them... My mother was an SAHM for 20-something years until my father left her with 2 teenage children...she had no way to support herself and her kids and it was very difficult for a while...she did get some spousal support, child support for one of the kids (the other was just turning 18 but not quite out of high school), and she put herself through Vocational Technical School to get her LPN to become a nurse so she could support herself (and her kids until they left home)...she didn't want to be a nurse, but that was the career field she felt would best support her and high chance of being able to get work and stay employed...she's 74 now (this happened back in her 40s) and is just now fully retiring after having worked part time the past few years as a CNA for some extra money...

    Q. Am i overreacting? my husband didn't pay the mortgage this month!!?

    My husband decided last week that he wanted some "rims" for his car. i told him i didn't think it was a good idea, because we just had a baby and was out of work for 3 months and we just bought a new suv. so basically our savings were pretty slim. and we are planning a vacation in the spring and moving to a new state in the summer. but when i got home yesterday, he had them on his car. i didn't say anything, cause i was too mad. but i checked our account and noticed he withdrew $500 for them and when i called him, he said he didn't pay the mortgage and he would pay it on monday, but that means we would be paying our mortgage and daycare($750) on the same day, with leaves almost nothing in our account until the end of the month. so i told him that he was the most irresponsible selfish person i ever met and since he wanted to make decisions on his own, maybe he should be by himself. and i'm done.. he also spent $300 on speakers in dec. despite i didn't get paid, which put us in a bind. i am working now. and going to school full-time to provide a better life for my children but when we take two steps forward he pushes us 4 back....and we have a 5yr old..and i do everything around this house..i'm just thinking i am better off by myself.

After you administer you beating call over you family as they may laugh at him causing him much embarrassment and distress. Then you make him return hubcap to the local merchant as you family continue to point and laugh at his misery. After this is complete administer one more beating so celebration dinner with you family can commence. Warn him if he ever buy hubcap again without approval the beating you give him next would be his last. This man has not tasted the wrath of an angry woman so it is time for you to give him that taste.

    If the only income is a retirement/disability for the husband and he leaves the wife and heads for parts unknown what are the wife's options? the income is direct deposit into the husbands personal bank account. the home is worth less than the mortgage. she has no income and can't work because of mental illness. husband has endured enough. the stress of nearly 30 years with a bi polar wife is literally killing him. her car payment and bills will no longer be paid, nor will the mortgage payments. he's had it. advice for him or her? he asks what the penalty could be for an old man with serious heart disease? i sense that he has just given up with her. the penalty for abandonment.

    He should have done it in a better way. She should be on disability. She needs a good attorney for that. Otherwise she's on her own now. Good luck.

    My husband and i had the most fabulous relationship both before we were married and after. at least up until he was deployed for 18 months in which he came home half way through for a two week leave. at that time, i became pregnant and found out a few weeks after he had returned to afghanistan. we were both thrilled and he was able to get home 2 weeks before the birth of our daughter. we are now reaching the two year mark of his final return home. it has been a very rough two years as he adjusted back into this life here. he has gone to counseling a handful of times but does not enjoy going. since his return, the "old" person i used to know is not here. he has been diagnosed with ptsd and is depressed, has a lack of energy, no drive, no eagerness to do something or make things work, lack of emotion towards me, friends and at times family, etc. three weeks ago after returning from the counselor "they" had decided it would be best for him to move out because he just didnt love me the same anymore. it has been three weeks now and i am absolutly devasted! yes he is a different person but i married through good times and bad! i am at a loss and feel left with a house, baby, job, bills, yardwork etc etc etc. he does continue to pay the mortgage and see our daughter but i want so desperatly to continue to work towards making this work. any ideas for what i can do?

    I am a therapist and in addition to your husband having PTSD, your husband is clearly extremely depressed. When one is depressed they lose interest in everything as you have described and feel numb to most emotions. I wonder if he is mistaking this numbness for a lack of love. I am not sure what that means they decided he did not love you anymore. I hope he means this is some realization he came to because a good therapist would not tell a client what to do or decide anything for them. They only help a client understand what it is they want for themselves. And if he has only been there a handful of times, I am not sure how they could have reached this conclusion so quickly. If your husband has not seen a psychiatrist, see if he will. He may need anit-depressants to help him improve his mood. Anti-depressants take at least two weeks before there is any noticable change, but it takes 4 to 6 weeks to get the full effect. If he is on one and it has been at least 6 weeks, and there is not any change in his mood, he may have to try a different medicaiton. If he is against this, explain to him that he does not have to suffer and that taking an anit-depressant is no different than someone with high blood pressure taking medication to control it. Taking medication has nothing to do with strength of character. Also see if your husband will go to couples therapy with you. Does it help if your remind your husband of who he was? Many families are facing these issues. Service men/women go through a lot of emotional trauma and many feel guilty about things that occured over seas. Of course they all cope with things differently and have different issues. But a huge component of depression is often guilt. Maybe your husband feels guilty about what went on when he was gone (was he in the position to kill people?) He may feel he does not deserve a good life anymore. Maybe he has just re-evaluated his life and wants to live differently in which case I am not sure what you can do. Is there a support group in your area for military wives who are expereincing the same thing? if so get invovled with it. Best of luck to you.

    I am scheduled to deploy for iraq in mid june of 2008. my wife is due to give birth to our first child at the end of june. right now we rely on both incomes to pay the mortgage and other bills. while i know she can collect benefits like maternity leave for six weeks, i am concerned for what happens after. i would love to know that she is home caring for our newborn safe and sound while i concentrate of what i am doing in iraq. we live in nj and i know all states differ.

    Suck it up, Drive on, and MOVE OUT...you are a Military Family. Sorry, but I just don't have any sympathy for families who don't know how to plan for things such as this. I just don't understand how people in the Military feel they need to get Food Stamps and WIC!
