    We applied for an assignment due to ongoing issues with our rental unit. We are also being heard at the Rental Tribunal as part of the issues in the home. The other day the owner put the house up for sale. That is obviously going to make assigning the home that much more difficult for us......any direction on how we should proceed with this?

    Our landlord has not told us the home we rent is in foreclosure. i found out through notices addressed to him in the mail and through a website listing our home in foreclosure. as it is we pay rent a month in advance and have decided to pay on time instead so that we do not lose a whole months rent if asked to leave. sorry to say we do not trust our renter because he has not been honest with us. when this home sells, how long will we have to find a new place? also, shouldn't the bank be getting our rent money...especially if rent is more than his mortgage? i am really just concerned about what this means for us and options available? anyone ever been in this situation?

    Nothing at first. You have 30 days to vacate the property. if the sheriff shows with less than 30 days notice you demand to go to court and be heard by a judge. Illegal evictions are not ok but they pay ohhh so much money when you sue. Oh and call the local news too so they can film you getting dragged out... spin is everything. If you have been given notice that you are being evicted you can review your options with an attorney but foreclosure usually trumps a lease. I would absolutely hire an attorney and begin legal proccedings against your landlord for breach of contract and fraud. Additionally you will probably want to place a lien on the property for the amount of your security deposit because if you don't you'll have to sue to deadbeat landlord for that money. I don't know your state specific law but in California the law is as follows: Defaulted owners in the property after your date of possession are given three days notice to quit or pay rent. Month-to-month or less-than-one-year renters get thirty days. Renters with a lease of one year or more get sixty days to pay rent or quit. Good luck

    Nothing. You do not have to move. The lease goes with the property and the new owner is required to honor it. You have the same rights as before. They cannot change anything to the lease until it expires.

    "The new owner could not give you any notice at all..."



    The buyer of the house must honor your lease. If you had a 3 year lease, the new owner could not give you any notice at all; except to tell you that he would not be extending your lease. If you are month-to-month, the landlord must give you a 30 day notice prior to the "periodic due date" for your rent. So if he wants you out by December 31, he gives you written notice by November 30. If the landlord is squeezed by the buyer, it is legal for you to ask for money in return for moving out quickly. Most landlords would pay for your cooperation. Only you can know what that is worth.

    I recently bought a rental property. 2 weeks before closing, i was told that one of the renters was being evicted for failure to pay his month to month lease. at closing i was assured that he was gone. but he wasn't. i have never met the guy, and the property was sold to me as thought that side was vacant. turns out the prior management had never signed a contract with him at all. no one has heard from him in almost 2 months. some of his things are gone, but not all. he has no phone or contact information. we are treating this situation as an abandonment. the question that no one can answer for me is how long do we need to store his stuff before we can dispose of it. is selling it an option once that period is reached? any help would be greatly appreciated. thank you in advance.

    I don't know about Texas, but here in MA, it is 9 months. It happened to us when someone abandoned their property in my 3 family house, but I wasn't about to get sued over it, so to be safe, we called our local courthouse and they told us 9 mos.- after that, we had a yard sale and reaped the benefits of having had that stuff in our house, unwanted for all of that time! We never heard from the person again either, but it is better to be safe than sorry where real estate is involved. You wouldn't want a legal battle or lien placed on the property.

    I am a renter thinking about purchasing a townhome or condo in my neighborhood for about 3-5 years, selling and then finally moving into my perm. home in the same neighborhood. my rent is increasing from 946 to 1011 a month and instead of wasting that money, i'd like to put it toward a home. problem: no savings, poor credit history, fico score between 499-526 from all three credit agencies 35/k a year, 6+ years with my job, and the loan amount i'm looking to finance is between 164-219/k. i figured it would be cheaper for me to buy instead of renting which i'll be doing for the next 3-5 years if i can't get a home loan. i know my credit situation is bleak. how long will it take to ramp my fico score to at least the national average and what other advice can anyone of you give for a first time home seeker looking to buy in the near future? what can i do for the next year to get my score up? oh i live in houston, tx btw.. thanks in advance!!

    For buying a house Credit History is much more important than credit score. Often, the lack of credit history is equated with bad credit. You should be aware that lenders will go through your credit report once you apply for loan for buying a house. Therefore you should polish your credit report. Anyway, in order to establish a good credit history and at the same time risen your credit score in a short time do following things: 1) Close all of your credit cards but one. It reflects in your credit report and it is a very good sign. For instance say that you have 5 credit cards with $1000 credit limit for each. Therefore you are responsible for $5000 of possible debt. But when you close 4 of them, now you are only responsible for $1000 of debt which lowers the level of risk of lending money to you. 2) If you have any loan, like car loan or any balance on your credit cards, try to pay more than your monthly payment for 6 months or something. I mean say your monthly due on your car loan is $150, try to pay $250 each month. Lenders can see these trends in your credit report and they see that you’re a responsible borrower. If you don’t have such loans, I suggest getting a $3000-$4000 loan and paying it off in full in 5-6 months. You might pay $200-$300 of interest but you will save thousands of dollars in your home mortgage and interest rates.     Renters will be leaving the state on that date. i want to sell it when they vacate it but i don't want to put them out early. i also don't want it sitting empty for long. when should i put it on the market? can you list it 3 months early and say they buyers can't take possession until 8/1/10?

    You may place the condo on sale at anytime you so desire. In the sales contract you could add that the sale is contingent upon the expiration of the current lease. You might also place this is the contract to sell if you plan to use a real estate agent. Therefore it will be listed for sale with the new owners occupancy on or about 8/1/10. When you list the property you must make sure you have some type of agreement with your tenants, so that your real estate agent might have access to show the property and take any pictures to market the property.     I am trying to sell my home in burbank, ca . my husband just passed away and his sister that was a guest that never left and ended up staying in an unpermitted guest unit now only stores her stuff in it,will not abide to many dates that we have agreed upon. since there was never a contract or rental agreement and she never even paid any rent, does she have renters rights and could this be a storage issue since she the house has not had hot water for months and there is no gas in the unit and it is wall to wall storage? she does spend some time in the unit since she is seeing the guy next door and comes back and forth. but if you ask me the house is not habitable and does not have hot water and gas. she just goes there and smokes.

    If she was living there she would. But storage has no rights, it is abandoned property and you can do whatever you want with it.
