    My brother just passed away with no will, no money etc.(In B.C. Canada) He does have a clunker of a car parked on the street that will have to be sold asap before it gets towed.. How does one go about this? I have all the necessary papers as well as the last transfer papers from ICBC...I understand it is not my car to sell.

    Here is the situation. i live in canada, i am the primary caregiver of my mother. she has a credit card in her name only with a debt of roughly 4k. 2 years ago she used it to buy me a new computer. if she dies, am i responsible for the debt? we are both on disability and have no insurance or savings, living month to month on our disability. will they come for our tv and computer? can they garnish my disability? okay, an edit in response to the first response...and i don't want to sound like uncaring or anything because we have been preparing for her death for quite some time. we live together, can they not come and take the things she/we purchased on her credit card? i mean it wouldn't be a huge deal, but i worry about someone coming to take the very few things that we/i do have.

    When a person dies, all of their assets and liabilities go into their estate. Any assets (stocks, bonds, bank accounts, property) have to be liquidated (sold for cash) to pay any debts. If there are not enough assets to pay the debts, then the debts should be paid proportionally with each getting the same percentage of the balance paid. The computer was given to you as a gift. It is yours and cannot be seized to pay her debt, even if part of the debt is from the purchase of the computer. If the TV is hers it would be sold to pay her debts, but if she gave it to you before death, it is again yours. Unless you have signed for the credit card or other debts, you cannot be held liable for them. They can not touch your assets or income. Edit. Credit cards are unsecured debt, meaning that they can not come and take anything from you. There is no lien (legal claim) against the property.

    Q. What's the worst if i abandon my credit card debt for about 5 years?

    Very simple. a chance at a great job has come up but it will take me out of the country and it will basically be like i am dead for the next five years or so. i want to take the job but i'm worried about what will happen regarding the credit card debt i would be leaving. i know that it will go to collection and my credit rating will die, i don't really care about that since there is a good chance i won't be coming back to canada and where i would be going i would never need credit. a former employer said just abandon it since in 7 years out of the country my credit would be at zero anyways and as i said, i don't care about my credit rating. i'll stop rambling and get to the point. should i abandon my credit card debt, is there any way it can result in my passport being revoked? i have not ruled out paying off the debt, it's just that where i will be the government doesn't make it easy to send money out of the country and travelling into a major city each month would be prohibitively expensive and time consuming. okay, i'm not in any way saying that i will never pay my debts off. after the conclusion of the minimum 5 years i will have more than enough money to pay them off. as for all the nice little things, find my ex and ask her how much she is enjoying them, because i sure as hell can't find her, i'd love to get her into court for giving me these debts before vanishing. again, computer to pay the bills. my pay would be in cash, not direct deposit to my canadian bank account. as i originally stated, the government makes it extremely hard to send money outside of the country i'll be in. how can i pay my bills via computer if i can't get the money to my account on a regular basis?

    Without passing judgment I will point out one thing, I'm not sure about Canada but in the U.S. if a person leaves the country the statute of limitations on their debts is put on hold until they come back. Your debt's will not show on your credit report but your creditors may very well still be able to sue you if you ever return.

    I just lived that situation two years ago in the State and this is what happened to me. I didn't pay one single debt that my husband had outstanding for a number of reasons. First two of his loans had the insurance on them that is offered, secondly I just kept sending the credit card statements back in the mail with the words 'return to sender- deceased" after six months of that they all just went away. Lastly after paying the funeral expenses out of the life insurnace that I was sole beneficary of anything that was his (like last paycheck etc) went into an estate account. I was going to pay some of the bills that were in his name, but I was told by my lawyer that the estate had to pay me back for the funeral since it came out of my pocket. So to make a long story short any money in the estate account went to me to cover the funeral (which wasn't even enough to cover that by the way) and everyone else didn't get anything. I strongly recomend everyone has a will in place and that all bank accounts are joint and life insurance policies have a beneficiary named . This was a very difficult 7 months of my life due to him dying unexpectedly without a will.

    In canada, if a relative dies who is left to take care of remaining debt such as credit cards, car payments, etc. does that get left to the wife, or children? how much does it cost to bury or cremate in canada. the reason i ask is because since canada handles its peoples medical costs, i'm wondering if they also pay for death expenses.

    No the Canadian government does not handle the death expenses ,it taxes it.My Grandfathers funeral cost $10,000 plus tax.That was in 1993.The estate is responsible to pay off the debt.So yes the wife is left to pay the bills.Most loans have insurance with them so it may be payed by the insurance.It is very important to have the money to cover your funeral so you do not leave your family with all the expenses.The only time the government will pay is if someone dies and has no family or money.They will pay to dispose of the body that`s it.

    Q. Do i have to pay the deceased's taxes if she died in debt?

    My late mother died with a debt of over 10,000, and this was the amount that wasn't insured. i was able to get the credit card companies to back off, but can't seem to get revenue canada to cancel her back taxes owing. when i called cra they said to simply fill in a request for release form and so i did. i sent it along with proof of her lack of funds as she only had enough to cover 1/2 the cremation expenses. they seemed to think i was disputing that she owed taxes, which i'm not. i know she owed it, i just don't feel i should have to pay it if the estate is in a debt situation. so i'm back to square one. i am sure i've read that i'm not liable for the estate's debt, but can't seem to find the correct form or department for cra to cancel the amount owing.

    You mother and her estate but not you are liable for her debts. You can't take her property ahead of her creditors. Canada Revenue just needs documentation to show that the debt is not collectible. In the USA, funeral expenses would take priority over other debts. I suspect it is the same in Canada.

    Q. My dad is having a really hard time making ends meet?

    He only makes $20,000 cad or so a year he has to provide for four people, me, my little sister, my mom (his ex-wife), and himself yes my mom should be providing for herself, but she can't get a job she recently got out of school and she could be an lpn now, she has 3 years experience from when we lived in the us but she hasn't heard anything from where she applied my dad has been looking for part time and has applied at about 6 places now, multiple times he hasn't heard anything he's over $2000+ in debt with the credit card company and bc hydro we have no heat in our house and winter is coming, up here it can get to about 30 below zero, making our house uninhabitable unless we have heat, but my dad owes bc hydro over $700. he can't keep up with the rent, it's about $750 a month i can't get a job because i don't have a sin, or any picture id, plus i wasn't born in canada, i was born in the us i'm only 13 and i don't know what to do i wish i could help with money and stuff but i can't since i can't get a job all i do is worry about money, and it really interferes with school some days i don't want to get out of bed because i feel awful sometimes i think it'd be better if i just died, then i wouldn't be such an expense and i wouldn't have to worry anymore i have anxiety attacks at night, and it takes me hours to fall asleep i'm always so scared that we'll get evicted or that we'll freeze to death in the winter or something or that it'll be like this forever, always struggling all the kid's parents at my school make so much money, most of them are very wealthy people and don't have to worry about a thing i have no one to relate to and there's nothing i can do to help anything or make anything better there's a little hope in my mom getting a job since she'd be making over $20 an hour, compared to my dad's $15 an hour so that isn't bad but she's only applied to one place and it's been 2 or 3 weeks and she hasn't heard anything she's never motivated to do anything, she's an alcoholic and a huge pothead plus she's been unemployed for years if somehow my mom magically gets a job then i don't think i'll worry anymore, but i don't see that happening she needs someone to push her all the time or she'd never get anything done i'm sooo scared i don't know what to do at all everything's so awful i can't imagine it being any worse but it is getting worse and that scares me so much :( what do i do? is there anything i could do? also i didn't know where to put this question...

    First, I think you should share this with your mom: she needs to know how her inaction is effecting you. In the US, LPNs can work anytime, anyplace, so if she's only applied one spot, she isn't really trying to do her share for the family. Second, ask her for help finding a job of your own: lots of 13 yr olds have paper routes, baby sit, etc. If you don't have the necessary paperwork, ask her or your dad to help you get it. Once they realize how dedicated you are to helping the family, they may step up their own efforts. Third, if either one is wasting money on cigarettes, booze, cable TV or multiple phones when the family doesn't have heat, call them on it: they need to get their priorities straight.
