    Q. Please offer any advice on how to get my house sold?

    I had my house listed last year with an agent from jan-july, had 3 showings all that time. then we put it up for sale by owner in the fall, had 1 showing. we always got good feedback, just that the home is on a main road, but it's also on a nice lake. we have now relisted it for a really good deal, and we are willing to walk away from closing with nothing to move on. do you have any ideas of how i can get this house sold, or make the main road have a lesser impact? aside from just waiting? the front has a solid wood and brick fence to shield the traffic. we are at 6% currently for commission.

    Q. We need help with our moving situation.?

    We are closing the deal on a new home in a few days. we currently rent an apartment and our month to month lease term was from december 2008-december 2009. the landlord never re-upped the lease (not our fault) and now we'd like to move. are we required to give the landlord a months notice for a lease that expired? i wouldn't think so considering the lease is "dead" also, the people selling the house aren't ready to move yet so we're supposed to choose a day that will work for us and them. the closing date being so soon doesn't give us anytime to move out, but that isn't our fault. the sellers didn't find a place they liked until 2 days ago and they've only just put an offer on it. this infringes on our moving. we would have preferred to move by the 1st, but now that won't happen. we don't want to wait until august. so *do we have to give a months notice? we no longer have a lease (not written or verbal) *can we pay a half a months rent? we were thinking of telling the landlord we'll be out on the 15th of the july that. it's almost a month's notice as it is. we still want our deposit back, and we're not breaking any agreements, since like i said our original lease said "month to month" (not a 1 year lease or anything) and it is now expired. we just really need to move, we can't lose this place, and we can't afford to pay for both places either.

    Even if your lease expires, state laws require that you give proper written notice to vacate. Also, since your renting by the month (not week or day), you must pay for the full month July. "Almost a months notice"; will not cut it. You must give a full rental period as notice.

    Q. What should my plan b be?

    We sold our house in order to buy a place with more play room for the kids. we close june 30th and have to be out by july 4th. we have an offer in on the only house we have interest in that we can afford, but if that doesn't pan out, we need a plan b. we have a family in our church who has offered to let us stay in their downstairs (that is never used by them), but we have a 1 yo and a 3 yo and i would feel like i was imposing horribly. i'm think i'll move home (1.5 hours) and hubby can live with the family, then the kids and i will come stay with him at their house on the weekends. or should i just suck it up and stay with the family the whole time?

Your a mother that is one of the hardest if not the hardest job there is! dont let anybody tell u that u are failing by leaving or staying! You should not leave ur children unless there is fighting within the house hold. children need the comfort and support of both there parents.no matter what the situation , part of being a family is sticking together through the good times and the bad. being an adult means not running when things get hard, and u struggle. tuff it out lean on ur husband for support! he will be there , together make a plan! things always seem worse when ur first confronting the situation... sometimes we need to just let life unfold. and stop trying to control everything because honestly we cant! things will get easier things will get better ..in time. they say god will only give u as much as u can handle. i hope this helped u in some way!     Q. I won't be able to close on my first home on the date stipulated in the contract. what are my rights?

    First time home buyer. i am under contract. the closing date was stipulated in the contract to be on/before july 21. the seller is a bank. actually, beazer homes sold the house to the bank, and then the bank rented it back to beazer homes to use as a model/office. that's what the house is- a model. it has never been lived in. so i am supposed to close by the 21st. i have already contacted my apartment peeps and told them i would be moved out by then. they already have a new renter lined up for august 1. my realtor heard from the seller's agent that they have not signed the seller's contracts yet. the listing agent was very apologetic. apparently, the seller (the bank) isn't even communicating with their own listing agent. the seller's agent told my agent that they would understand if i wanted to "move on". i've already paid for an inspection, put down earnest money, reservation fund, and am emotionally invested in the house. what are my rights? i want this house!!! no, we are under contract. the last piece i need from the seller is their signature on the seller's contract. the seller accepted my offer, with earnest money. i had an inspection 4 weeks ago. my finances are all in place. the only thing we need to move to closing is their signature on the seller's contract. this is due to the fact that the seller will not be present at closing, just their agent (as i said, the seller is a bank, not an individual). my agent did tell me that when a bank is involved, the process can be slow. for instance, it took them 2 weeks just to accept my offer. it's possible that i will still be able to close on time, it's just that the seller isn't communicating with their listing agent. it is unprofessional as my agent called it.

    Some illegal immigrants bought homes with a false social security number, Realtors and mortgage reps were aware of that and the borrower signed a affidavit allowing the bank to cross references with IRS to verify their earnings and legal status .Others bought homes with tax id number only, some banks agree to give them a loan with tax id number regardless of their immigration status.( The banks, were suppose to keep the loan in house, and not to sell it in the open market) Some bought homes under a program called no income no asset verification, they inflated their earnings in order to qualify for a mortgage, other wise they would not qualify to buy a dog house. Now the good times are over and the properties are on the market, because they can't afford the payments. On the other side, the people who misled them are enjoying La Dulce Vita with a huge savings account, and the investors are trying to figure out how come they have the short end of the stick. The illegal aliens served a purpose, now is time to send them back and let the legal immigrants come in, they have been waiting for a long time PS Illegal aliens are criminals by being here illegally and by supporting illegal activities.

    Q. Refunding earnest money on home in houston, tx.?

    I am selling a home and have a question about earnest money. the buyer signed a contract on june 20, 2007, the closing date listed on the contract was july 31, 2007. the buyer put down $1,000 earnest money, and paid a $100 option fee, and the home status was moved to option pending, ( so we had hardly any showings after that). the home was appraised on july 12, 2007. the home was inspected on july 20, 2007, and the inspector noted a few small repairs, all which could have been completed for under $500. on july 24, 2007 the agent contacted my agent and said that they wanted to terminate the contract because they didn't want to wait on the repairs to be completed. they are now requesting that we give them their $1000 earnest money back that the title company is holding. do we have to do this or should we be given these funds because we took our house off the market for this buyer and they backed out? what does the option period / $100 fee mean?

    The option fee is yours to keep. The rest depends on what the contract says. If it is contingent on the inspection, and the problems are material matters (heat, electricity, plumbing, roof, safety issues) then they have an arguably good point. If they are cosmetic, or could be fixed easily, they are simply looking for a way to avoid the contract. If they are right, they would probably win in court, and you should give them their money back. If they are just trying to avoid the contract, you would probably win and should keep it. Offer them half. They'll probably take it.

    So i have been friends with a guy for 2 years. we know everything about each other. we dated briefly last year but distance go tin the way (2 hours apart) we always keep in touch, never have stopped flirting. close connection we both say. finally we struck up a connection again few months ago (no weve never had sex) i decided to move there for work and friends and he was crazy happy. well i havent been able to sell my house in order to move. i only have a little bit of equity but i need that in order to rent a place/move to his city. he knows this and just keeps complaining whne will i finally move and to paraphrase him ' so both our lives can begin because we are so good together'. this guy says pretty much im precious to him, he sees himself marrying me having kids. problem is is that ive explained that i would love nothing better to be there right now. i said i have to work a big project for work for all of july and wont have any time for him because i will be making the money in order to move there. i then 'joked' unless he wanted to loan me money. i only quipped this because he had just boasted he made 19k last month and really wants to burn thru some money. his reply was oh he still has credit debt from last year and really wants to buy some new beach wear. well okey dokey then. its his money but if he wants to run around spending it he shouldnt be upset because im working hard round the clock to move there. he doesnt have a mortgage or car payments to worry about either (his parents bought him both) am im being too hard on him ? im just frustrated because i care about him a lot and think he can be so sweet/smart/funny. but he chooses to blow his money on 200 haircuts and other silly stuff and im just scraping by until i move (i have a great job waiting for me$, but am in a catch 22) ive mentioned this to several friends and they say this is a good test of how grown up he is (he is 35) and if he truly cares about anyone other than himself. so should i give him a break or dump him ? (i give him a lot of breaks by the way) sigh. i mean he is going to the beach tomorrow and im working straight thru until august 1st! insight ?

    Red flags blowing in the breeze. He made 19k last month. NOT investing it. NOT saving it. Wants to "blow thru it." Never had a mortgage. Never had a car note. Why? Becuase mommy and daddy paid cash for both for him. His parents (at 35? REALLY?) are basically, at the bottom of things, still supporting him. He's a kid. A little kid. A 35 year old little boy who has no ideas at all about maturity, commitment, responsibility. Can you really imagine him being the father of your children? You really ready to be a "single parent?" Maybe the fact that your house won't sell is GOD'S way of telling you to stay put. Maybe the fact that you get so much work so easily where you ARE is GOD'S way of telling you to stay where you are. WHY DIDN'T IT EVER OCCUR TO LOVER BOY TO HAVE YOU MOVE IN WITH HIM????????????????? Red flags, blowing in the breeze. Ignore at your own risk.

    Q. Help,i bought a new home 2yrs ago & now builder is asking for 30k more?

    We purch'd a new home in '06-lot #3&4.1st closing-nov 07,then moved to mar07.in march,we received notice from builder,someone in adjacent subdivision claims part of land in lot next to us is theirs&builder was extending closing another 120days.we were told in march that property in dispute was not part of our lot but city wasn't allowing him to build our lot either.1mnth after this..our lawyer is disbared and we need to look to new lawyer (our builder knows this) in may we find out that the lady who is causing land dispute has 1 more opportunity to dispute&she had until may9th. builder said he as to wait to build so,if she wins,he may have to cut our lot size.she decided to dispute a 3rd time.now builder says cuz he can't build home by july he's giving us our $$ back but if we want house, he's charging 30k more.he knew of dispute in 06 & didn't sell lot 1&2 but sold to me not disclosing.he's now building my lot now&will be ready in sept/oct..how builder do this & chrg me 30k more???

    He can probably do this because the conditions of the lots changed, raising his cost, so he is backing out of the agreement. If it was his agreement you signed for the expected purchase, then you can bet there is an outclause for himself. If you feel jilted, then get a civil trial lawyer. However he has already willing offered you all of your money back, so what else do you think you deserve?. Common sense dictates that unless you can "proove" he broke your agreement illegally, or did something malicious, then you don't have a leg to stand on. Get over it, and move on.

    Q. Trying to make a decision about moving my family to brazil, please help?

    Hi, i am looking for some advise:) i feel like i am being pushed and pulled in two different directions and i cant make a solid desiosion and i feel like pulling my hair out! i have been with my brazilian husband for 8 years now, we have a 5 year old son and 1 year old twins. our current situation isn’t the greatest, we live on the third floor in a two bedroom apartment, it’s a large apartment but non the less with the twins getting bigger and bigger we have outgrown it. my husband owns a pizza shop and works about 80 hours a week, thus he is only here one day a week if that. with the economy business is slow and i am a sahm so i have begun selling my crafts and such online and out of my house (www.littlelillylove.com) this has brought in money for me and the kids to play around with, so that we can get out of the house. life is stressful feeling like a single parent a lot of the time, so my husband has been really pushing us towards moving down to brazil. there we will be able to buy our own home, have many trustable babysitters (7 sister in-laws) and if needed we could have someone come in and help around the house as my husband already owns a taxi company down there and has a lot in stocks. he also would like me in the future to open a store selling all my children’s accessories after we get on our feet (as a good percent of my sales now in the u.s. is within the brazilian community) i have been to brazil three times and really do enjoy it but the thought of living there scares me. my mom is here and she is a huge part of our lives, she is very close to the kids and is a huge financial help when it comes to the three kids. everytime the discussion comes up about us moving she freaks out and manages to completely talk me out of it. my friends are all here but we are all busy living our own lives and the main communication with all of us is face book and online so they are supportive. also my husband is as cheap as cheap can get, here we work around it, i have my own time and my car and if i want a pair of shoes or an outfit for the kids i don’t fight with him about it i just go get it. in brazil at least for a while he will be in complete control as i am still learning the language. maybe i’m over analyzing everything but i’m just so nervous. i know i’m grown, 27 in july and need to live my life with my family and do what’s best but i hate that my mom will be hurting and then if it doesn’t work were will we be, coming back here with nothing and three kids…so scary… please can anybody offer me any advice as an outsider? thank you we stayed there for a few months back 4 years ago and it had its pro's and con's but i always knew i was coming back and only had one child. and i say in complete control only because when we were there before it was a fight when i wanted to buy a shirt.... he says that it was like that back then because we had an overwhelming amount of bills (because i had surgery down there when we were there so we were paying that off)
