    Q. I am buying a condo and the advertised appliances, fixtures and finishes are not mentioned in the contract. the developer says its a standard contract?


    You must have a real estate lawyer in order to close the deal for the condo so it is best to contact one today and ask this question. it should be easy for them to give you guidance on this subject. My non-professional opinion is that a contract is negotiable from both ends, if there is no mention of appliances then they do not have to provide appliances. You can ask that they include it in the contract or if dont include it then they dont have to give you appliances on closing.

    -owned corporations aren't deliberately making bad loans because mortgage loans are government backed and this would allow them to steal from the u.s. citizens via organized crime? china has threatened to sell off u.s. treasury notes and u.s. bonds and we know many foreign corporations own business in the u.s. a. and contract with the government. isn't this tantamount to treason on behalf of the u.s. government and literally taking money out of the hands of u.s. citizens? why should we bail out the stupidity of the subprime lenders? do they bail us out? no, they simply take our houses and our money. we're still paying for the s&l bailout. i say let them sink. i don't give a rat's butt what happens to them. the u.s. citizens will rebuild and will save the country -- not the government -- it can't even do its job as is evidenced by the failure to ensure safe infrastructure, safe food, deal with illegal immigrants etc. why not let the business pay for its own mistakes?

    Actually, I agree. Let them fail like any other business that makes stupid decisions.

    Q. Foreclosure,deed in liu, or bankruptcy? also will i lose my job?

    We are three months behind on our interest only mortgage payments. it was difficult this last year since my husband and i lived in separate places due to work and had seperate living expenses. we paid a high mortgage payment on the house and rent for the apartment. now we had decided to file for bankruptcy and stopped making payments, but now i find that i may lose my security clearance and job if i file bankruptcy, and i'm under contract with my job. i have yet to clarify that, but my real question is, is foreclosure/deed in liu better than a bankruptcy? a government financial advisor stated foreclosure would be much better than a bankruptcy chapter 7. we want to open up businesses in the next 3-6 years, and buy another house in that time frame also. after filing bankruptcy it was projected that our credit score would go up 50 points right away. will a foreclosure really kill our credit by 100-150 points and if so, how soon can we start seeing an increase with responsible habits?

    A foreclosure hit is about 260 points, all together. I would be surprised if you were able to keep your security clearance with it. You will NOT be buying any house in 3-6 years, more like 10. You should be OK opening the business, as long as you do not need a loan to do it. If your bank will accept a deed in liu you will be MUCH better off....but they are not likely to accept it with you refusing to make your mortgage payments. You really need to call your lender and try to straighten this out.

    Q. Should pres. obama rescind the davis-bacon act to lower wages and create more jobs?

    On a talk show the guest was talking about how an electrician in philly earns about $33 an hour, but due to the davis-bacon act would earn $55 an hour on one of the government stimulus contract jobs. according to this person obama could override this bill and thus pay the normal rate which would leave a surplus of money, enough to create another 168,000 jobs. if this could be done, then that 168,000 would not be on unemployment, they probably could pay mortgages, thus helping the housing market and be able to have more purchasing power in their communities. with the extra cash in the communities it would help and might create more jobs. if right should we contact our representatives in washington? if the going rate is say $33 vs the $55 , that means they could save $33 an hour and use that cash to create an additional 168,000. if the original deal is suppose to creat half a million jobs and add thats it's like an additional 25% jobs. that's not a droop in the bucket by the way and better than nothing and considering many of the soutthern and mid western states don't pay the $33 an hour, it would be a wind fall no matter how you look at it.

    Even if Obama could do this, would you want him to do it? The surplus you speak of is a phantom number without a basis of fact. If there were openings for people at the lower levels, private concerns would fill them with employees. You hire only the people you need to meet the demand for service or production. If a contractor needs twenty people to do a job, he will hire just the twenty he needs. Let's say you have a business and you contract for a job for $10K. You have 1 week to complete the job or get fined for every day you are late in completion. You can do the job with 10 good top technicians if you pay them $60.00 an hour. You can get 15 less skilled people for $40.00 per hour, but it will take 1-1/2 weeks to finish because of mistakes and to clean up the punch list. You are now paying $2000.00 a day in late penalties. Which would you do, pay a better class of worker or chance the fines? I know this because I have worked construction with the best and the worst of them. Remember, you get what you pay for. The less you pay, the poorer the quality. Once wage controls are accepted, when will they come for your wages, how much of a cut will you be willing to take? This is more government interference in private sector matters and should not be allowed.

    Job loss and injury caused us to fall behind on our mortgage payments. the bank wouldn't work with us and began foreclosure proceedings after 30 days late. we cannot afford our current home. we are trying to sell, but the sheriffs sale has happened, our time to sell is limited. we have located a different home that is 1 1/2 times cheaper & will allow us to make much lower house payments. we have some money to put down (the bank wouldn't take partial payments, work out repayment plan etc..) but we need to finance the balance for this different home. our credit is terrible now because of this but we need a home for our family & children...are there any loan programs (government or traditional) out there to help us get into this home. we tried going contract for deed but the foreclosure co. wants to cut the home loose (the home we are trying to buy is a foreclosed property that needs repairs but the payment would be $100's less than we pay now) -any guidance would be appreciated.

    Talk to your bank, and talk to a loan broker. I have used both with good results. Your real estate agent should be able to suggest a good loan broker; that's how I found mine. He put together a reasonable package (it wasn't cheap), and two years later we refinanced into a much more reasonable mortgage.

    There is a bit in an episode of "Arrested Development" where Ma-be asks her uncle for help writing an essay on "The Old Man and The Sea." He says he is glad to help. She hands him the book and says, "Well then read this, write the essay and remember it has to be in MY OWN WORDS and let's put a four-syllable limit on it." The point here is that YOU read this material and then write what you learned is such a way that there is evidence that it sunk in. How would you suggest that WE write this in YOUR OWN WORDS?

    But: the more i reflect on what has happened in the last few years, things such as wall street learning the 'slice and dice" mortgage scam and the no bid contract deals for haliburton, the more i realize that we are silly not to take everything we can get that is not nailed down. our republican friends have the volume at full blast, screaming that some poor person might get something for nothing but now even dumb me has caught on. while fortunes fit for a king were being fraudulently made selling and financing houses to people the thieves knew could never pay for them, bush fixed the tax system so the really big thieves could skate with a lower tax rate than the garbage truck driver. now they are getting their thongs in a wad that some single mom who lost her job as the receptionist at the countrywide home loan office when it closed is going to be able to keep her unemployment benefits while she goes back to school to try to learn to get another job. so do any of you agree that if we have any sense at all we better take advantage of every dime we can get from government handouts and grab anything else the republicans didn't steal on their way out. of course, we can't get the big bucks like bank of american and wells fargo, but let's at least get some food stamps and a free semester or two of school.

    If you were a fish, chances are it would be a carp. You think like a bottom feeder and the problem with your scenario is the vast numbers of free loaders you are proposing to grab a piece of the pie. I would not call you a problem solver by any means. We already know about the Washington DC parasites who practice "don't do as I do, do as I say", but they aren't only Republicans. Your boy Obama has pissed away more money in three months than Bush during his entire presidency. Just the number of bonuses paid to AIG would make Bill Gates blush. Those houses you refer to, well the foot print on that little scam is almost exclusively democratic. If you want names, here's a few to swirl around in your blender, Clinton, Emanuel, Dodd, Fwanks, Pelosi, and their ilk. I too have the good fortune of a home all paid for, but do they ever really let you off the hook ? My annual $7500 property tax bill just came in the mail, due by June 1st, or it's off to paupers prison for me. But, that's just life under Obama, I guess.

    Family a exercises restraint and self-discipline, working and saving and studying and praying so as to stay together and be careful in their discriminations about with whom they associate and to what sort of influnces they expose themselves. through toil, sacrifice, pain, and creative enterprise they succeed, and their children are subsequently provided with ample material and emotional support--they enjoy many and excellent opportunities--socially, educationally, and in terms of careers. etc...they are "privileged," because family a has made good choices. family b is reckless and wild and degenerate, observing no real discretion nor discrimination about chastity nor sobriety, declines to develop their intellectual faculties, wantonly indulges themselves in all kinds of sloth and irresponsibility, and fails to develop any kind of work ethic or financial prudence, remaining insolvent and dependent on welfare & the largesse of others. family b's children are likely to be illegitimate bastards, their parents either divorced or never married to begin with, and starved of sustenance in terms of encouragement and all manner of nourishment, including intellectual development and financial backing...the abject abuse and neglect they endure translates into severely limited and inferior opportunites for higher education, social engagements, and business...they are "disadvantaged," because family b has made bad choices. the government steps in. the government confiscates the property of family a and gives it to family b, so that there can be "equal opportunity." the children of family a are denied jobs and admission to schools, and are even disparaged in the media and in corporate "diversity" training seminars, while the children of family b are actively recruited and awarded coveted slots in schools and companies, offered mortgages and government contracts, even when they do not merit selection based on performance criteria or character traits--all in order to achieve "equal opportunity." why do we assume that it's just a given that "equal opportunity" is some kind of sacrosanct principle of fairness? why do we automatically assume that all inequality is due to some past instance of economic oppression, instead of the result of free exercise (or failure to exercise) the principles of liberty, of free will and choice, of proper discretion and prudent discrimination? by insisting and enforcing that everyone have equal opportunity, aren't we really enslaving the best of us under the tyranny of arbitrary marxist egalitarianism, and removing all incentives for superior conduct, creativity, and careful discrimination? by "family" i intend to include extended family, racial group, religion, etc.--people who, by association with the character of the predominating members, either benefit or suffer from the discrimination of association, for better or worse, with the primary family members. by "family" i intend to include extended family, racial group, religion, etc.--people who, by association with the character of the predominating members, either benefit or suffer from the discrimination of association, for better or worse, with the primary family members. 4 minutes ago i see the founding fathers' defense of "equal rights" as distinguishing the rights of all men from the erstwhile "divine right of kings" in their battle to overthrow the monarchy and establish self-government by consent. it amazes me how many ignorant liberals actually believe that eeo/diversity/affirmative action programs do not actively hire and admit and recruit less-qualified minorities over more qualified white males. it is simply a fact, and the entire thrust of such programs from their beginning to this day, that under- and unqualified minorities and women are sought out to replace better qualified white males. when minorities repeatedly prove themselves unable to pass standardized tests, the tests are declared "biased" and thrown out--even after exhaustive, expensive efforts and aggressive participation from minority leaders to remove questions that are allegedly "biased", minorities inevitably underperform on such exams, and so of course "disparate impact" being the culprit, standardized tests are abandoned and eventually all standards go out the window as we plummet firther and further into a third-world dystopia. a corporate monopoly, while highly undesirable, is far better than a statist tyranny.

    maybe, but are the examples in your descriptions not just well educated creative ways of inflating the effects, to justify your standpoint......(slavery is over, no handouts) my personal belief is the people that have the most privelage, whether earned or not, will do just fine. life isn't always fair. and the people that milk the advantages of things not earned, will ultimitly live a life not to be envied anyhow. my point being, yes it is ridiculous, but if it makes some to a majority of the population happy let em have it. win some, lose some. ps. i enjoyed reading your question. i thought it was very insightful and well written, even though i don't agree with it 100%

    Q. Bank declined mortgage, now what?

    My mom and dad recently got divorced and my dad is not giving up any financial support. my mom has work with the government and she is the owner of a small business but there is no secure contract, so she is living in an apartment. we recently thought of the idea of purchasing a three unit home, living in one unit, renting out the other two units and with that money we would be able to pay most (if not all) of the mortgage along with some utilities, the rest, she would be able to easily cover with what she makes and with her small business. we think this is an excellent choice for her because it would be securing her financial future (if she ever wanted to move she could rent out all three units and make a little more profit, or she could simply sell the house and would get some money back) she also has some money saved up she could use if the units weren't rented. the bank declined the mortgage however stating that since she doesn't have a secure job they can't take that risk. what should we do or where could we go to keep fighting for this? my mom is a responsible person who doesn't just jump in to things, she has excellent credit, do you know of any other options that maybe would accept our mortgage? or are there any other options for us?

    with out contracts to prove that the income will continue for at least 3 years no one will lend her the mortgage needed. The other thing is the fact she will become a new landlord and in this case the rents cannot offset the note in any way till she has been a land lord for not less than 2 years I am a mortgage banker in TN
