    Q. What are california labor laws concerning part time employees working full time hours?

    Powered by
I am a part time employee and for the past 12 weeks i have been working full time hours. i was told by another employee that after 9 weeks, by california law, my employer has to make me a full time employee. does any one know the law on this or where i can find it? i have searched the web and called many different numbers, and have gotten nothing. thank you.

It could be unlawful under child labor laws. It could be a breach of your employer's policy or agreement you have with them. Just what is it exactly you're talking about?

    Q. How much should i be be paid for holiday i accrued whilst working full time after changing to part time hours?

    Powered by
Before going on maternity leave i worked full time and did 7.5 hours per day. after my maternity leave i went back part time and now work 5.5 hours per day. the question is, when i take the holiday i accrued whilst on maternity leave should i be paid 7.5 hours or 5.5 hours as my employers say it is the latter?

"Unless your employer is very nice..."

if you leave, and you don't work I don't think you would be paid, unless your employer is very nice, which is slim and none. Generally no.

    Q. Part-time working full-time hours?

    Powered by
Howdy! i have been working full-time hours at my job, but i am "officially" a part-time employee (so basically working the hours with no benefits!). is this legal? does there come a point where you can claim full-time status? i live in canada and have looked through the employment standards act but no luck. anyone? thanks!!

"In the eyes of the employer you were hired on as part-time..."

Not sure if Canada has a law allowing you to make the jump or not. In the United States an employer has the right to keep you part-time. In the eyes of the employer you were hired on as part-time help up to forty hours a week. Talk to your boss and see if their are any full time positions available. If he or she says no maybe it is time to look for new employment.

    Q. For three years i have been a part time worker, working full time hours.?

    Powered by
After being denied the chance to become a full time employee due to the fact that i am a college student and my manager felt that it would be best that i work full time hours while remaining part time so that i wouldn't flip flop back and forth between full and part time whenever my school schedule changed. for three years i have not flip flopped but continued to work 40 hours per week. recently after looking at the upcoming schedule, i realized that my hours are being cut from 40 to 25 hours per week. neither of my managers felt the need to let me know about the change, and when i asked they said that the new annual budget for 2009 didn't allow me to work full time hours because i am a part time worker. why is it that this year is different from previous years? when it was beneficial to the company my hours were ok, but now that theres a full staff, im no longer needed as a full time worker. can my hours be changed without even a months notice? they didn't even give my time to be able to find a new full time job.

"Yes your hours can be changed without notice..."

Yes your hours can be changed without notice. They can be changed even for full-time workers (there is no law in the US guaranteeing anyone hours).

    Q. Part time status working full time hours.?

    Powered by
I work for a medical transport co and my status is part time but i work full time hours.is there any laws in wisconsin that say if you work full time hours that the co has to change you to full time?heck by sat night i will have 102 hours for a two week period.i talked to some of my full time co workers and they are ticked because i get way more hours then them.any help out there??

"The overtime for working more than 40 hours in a work week..."

The big difference between full time and part time is benefits. Most companies pay things like health insurance, sick time, holidays, and vacation for full time employees. How long has this been going on? If it is short term because someone is out sick, then you can just enjoy to additional pay and the overtime for working more than 40 hours in a work week . If it has been going on for some time, then the company is trying to avoid paying benefits and you need to talk with them. Also, what do you want? Do you want to work full time? Do you want to work part time because you need time for other things? In lots of situations, employees tend to gripe amount themselves and speculate about "THEM AND THEIR MOTIVES", but the employees don't go to the boss to discuss the situation. You and your co-workers need to do that, perhaps together.

    Q. Part-time and full-time work hours?

    Powered by
What are the hours that make you a full-time employee and the hours that makes you a part-time one? is weekly pay only for part-time work?, how high does the pay rate go for hourly work till it reaches to salary pay? this question is referring to jobs in dallas,tx.

"(so they don't have to give you benefits or overtime unless you work 40 hours..."

Most companies consider a full time employee anyone that works MORE than 35 hours a week, although legally a full time employee is 40 hours a week. (So they don't have to give you benefits or overtime unless you work 40 hours, although some employers are more generous). Part time is anywhere from 10-20 hours, where 20-25 is the most typical. As far as how often you get paid, this can be every 2 weeks, twice a month, or weekly no matter if you are full time or part time. There is no "maxiumum" pay for hourly or non-exempt work. Some non-exempt employees (like paralegals) can make $30/hour. The amount you make doesn't switch you over to salary, it depends on your job title. If you have more questions, I can explain in greater detail.

    Q. Why does my manager make me work full time hours when i am a part time employee?

    Powered by
With no benefits, and nobody will let me work part time hours. is this legal?!!!

"No one can make you work full time hours..."

No one can make you work full time hours, you can refuse but you may not have continued employment there. If there is a reason that you can only work part time, you need to tell your manager that you are not available for certain times or days. It is legal to have a part time worker work a full time (or even overtime) week, there is no law that says that limits the hours of a part time worker. What is most likely happening is that this is a busy time of the year, either because full time workers are taking vacation time before the end of the year, where they will lose it, or because of increased holiday business. They do not want to make you full time, because they may not need you all of those hours when business gets slow again.

    Q. Part time costco employee working full-time hours?

    Powered by
I work at a costco in the northwest plus i am a fulltime student at the local college. i was hired part time with a min. of 24 hours a week, but here is the problem; they schedule me 35 hours plus a week and won't move me to full-time status because everytime i get close to being moved to full-time my hours drop down to 24+ hours a week. my question is; is what they're doing even legal? what can i doto make them stop? working long hours has taken its toll on me and as a result my grades are suffering. just want to know if this is normal for retail, do employers really feel the need to suck every peeny out of their employees regardless of what the effects are?

"How many hours per day or per week can an employee work..."

Whether it's normal or not, it is legal. They only thing you can do to make it stop is talk to them to see if they can work around your schedule, or find another job that is better suited to your schedule. http://webapps.dol.gov/dolfaq/go-dol-faq.asp?faqid=323&faqsub=Work+Hours&faqtop=Wages+%26+Work+Hours&topicid=1 Question: How many hours is full-time employment? How many hours is part-time employment? Answer: The Fair Labor Standards Act (FLSA) does not define full-time employment or part-time employment. This is a matter generally to be determined by the employer. Whether an employee is considered full-time or part-time does not change the application of the FLSA. http://webapps.dol.gov/dolfaq/go-dol-faq.asp?faqid=322&faqsub=Work+Hours&faqtop=Wages+%26+Work+Hours&topicid=1 Question: How many hours per day or per week can an employee work? Answer: The Fair Labor Standards Act (FLSA) does not limit the number of hours per day or per week that employees aged 16 years and older can be required to work.
