    I'm thinking of investing on commercial property. however, i still don't know what happens when an existing lease expires! does the landlord pay back the amount of lease to the tenent? if so, is it calculated according to the current market value or is it as much as was paid in the first place?

    The landlord grants or sells the lease to the tenant. Say the lease is for 10 years. The tenant pays for the lease and probably annual rent , maybe with 5 year rent revisions (nearly always upwards) .The tenant stays in the property until the rent expires. Unless he renegotiates an extension of the lease he must vacate the premises and that's that. Of course while the lease is running the Lessee could sub-let to another tenant or sell the remaining lease to someone else at a premium, or possibly at a discount, if the Head Lease allows it. In a commercial lease it would preferably(from the landlord's point of view, be a fully repairing and insured agreement. I.e. the lessee has to maintain and insure the premises and leave it in the condition it was in when the lease was first granted. The building freehold is owned by the landlord or by a mortgagor. Obviously the freehold lasts for ever. Some mortgages have a value covenant or threashold.value. If the value of the property falls below a certain figure the mortgagor could foreclose on the mortgagee.

    I inherited a property in 1997 that a business occupies. the tenant told me i can't change the low rent that's been the same for 13 years. but the lease expired in 2004, had an option for renewal under the original lease, but i received no written notification as described in the original lease (made with the original owner) i don't understand these things, and need a smart agent. who is the best person to help me? a lawyer? a real estate agent? i don't want to over-inflate the rent, just fair market value. how can i make sure the person is looking out for my best interests in a small town with a good 'ol boy network? thank you for your help!

    I'd hire a property manager who specializes in commercial property. They can either provide full service or any reduced service as you desire. There will be a fee for negotiating a new lease, typically about 3 - 6 months worth of rent for a 10 year lease. Fact is, if the lease has been month-to-month since 2004 you can pretty much raise the rent as high as you wish. Since you're the landlord, don't expect anyone to provide you with any notice. You are driving the bus and it's up to you to stay on top of your properties! If there was an automatic renewal clause in it and you didn't provide the required notice of intent to change the terms of the lease you may be stuck with a renewal at the original terms.

    it used to be the lease expires, either you negotiate a new lease or loose the house however that canged arund 15 years ago, and IIRC you will then own the frrehold after paying some nominal amount to the freehold owner. if you are in any doubt get professional advice before you buy.. your lawyer should be able to advise you

    We never signed a new lease and the landlord wont fix anything we have told him time after time, but he still wants us to pay rent. there is no binding contract what can i do or should i do? we have never discussed any agreement with him, we had to hunt him down to pay the rent,

    if your paying rent he or she should repair whatever is necessary. I'm pretty sure there are laws about that.

    Q. Can an apartment complex remove an immenity of the property during the lease?

    I live in an apartment complex that was purchased by another company in december. my lease expires in july. the new company began some remodeling and removed the workout room that we had. although it was small, with only a few equipment it was just across the parking lot which made it convienient and one of the reasons i chose the complex. the company arranged for us to get discount memberships at a nearby health club, but i'm now having to pay an additional $20 for this a month where before i didn't have to pay for a workout facility. is this legal? are immenities covered under leases, or does it just include the actual apartment you're living in?

    Unless the immenity is specifically stated in the lease (as in Lease holder will have unincumbered access to workout facility from 10am to 10pm) they can add or remove immenity's at will (most leases state just that, they can give or take away at will). I would also watch out, it is common when a new owner comes on the scene and starts making improvements they are planning on hiking rent when the leases come up for renewal. Start asking around or check the owner's website to see what they are charging at similar properties...so you are not caught off guard when renewal time comes.

    Q. Can the property owner i rent business space from require me to give 60 days notice after my lease expires?

    I am currently renting an office suite in florida, and am looking to relocate. i informed the manager of the property today that i would be looking to leave for january, and was informed that i was required to give 60 days written notice. this was never told to me, or pointed out during the signing of the lease. the lease expires on 12/31/2008. what are the legal ramifications if i choose to leave for 1/1/2009? can they bring me to court or keep my security, even though the lease is up?

    it's up to you to read the conditions of your lease at the time of signing , which is why it's always advisable to have a real estate agent who specializes in commercial leasing, to assist you with leasing. Some leases have a 'roll over', so that if you don't formally give notice prior to the end of your lease, it is automatically assumed that you will be extending your lease. Usually, this would be a "+" on your agreement, like 5 +1, meaning you leased originally for 5 years, but there is the option for an additional year. If you didn't give notice by 60 days (or whatever) prior to the end of 5 years, you are automatically rolled over into the additional remaining time. *Everything* in the business world requires advanced written notice, and as a business person, you would do well to read all contracts and to deal with anything in writing anyway. If you leave prior to the term, you can be liable for any remaining time left on the lease, which could be 60 days (the amount of written notice time) or any remaining time on your "+". It's hard to say over the internet, especially when it sounds like you don't understand anyway. They can ideed bring you to court, or withhold any security, depending on your contractural obligations.
