    Q. I am separated from my husband and he wants to buy a house do i have to sign?


    Im having the same problems live in texas home is in my name husband doesnt want to pay any bills I pay all the bills which are in my name bcuz he didn`t wants any in his name. nor does he wants to get a 2nd job. We have no kids together. I never changed my last name I want him to leave he claims he will. Can I file a quit claim to get him out of my house. Since we hve I still claim my maiden name. He is basically a mucher. Hes a barber he didnt qualify for the loan nor did he want to be part of the process I had to borrow $ for my earnest $ etc.

    Q. Bought dream house. problems before closing/move in a week. real estate and property scam?

    Toronto, ontario, canada. just purchased a older house (everything newly redone but house is 40yrs old) in july. suppose to move in on monday. lawyer calls and tells me about our neighbours water and sewage pipes run underneath our front lawn (real estate agents leave this out of the details). lawyers tells us to not close on monday until this is resolved. if we don't close the deal on monday then the owner will sue. if we close on monday and the neighbours pipes burst its "our" fault and they can sue. what to do? lawyers knew this in july and didn't inform me until today. real estate agents left this out of the details. my lawyer tried to contact the owners lawyer and they haven't responded because its not their problem anymore. help!!! i'm homeless and i'm supposed to be moving in on monday! don't know what to do! real estate agents are also leaving out stuff in the contract (signed in washer and dryer, water softner as is, etc.)

    What to do? ........Lawyers knew this in July and didn't inform me until today. Real Estate agents left this out of the details. My lawyer tried to contact the owners lawyer and they haven't responded because its not their problem anymore..... walk away. Contact the bar; get his atty censored. same with the agent. RE agents have a minimum duty to be HONEST. available to help further

    Q. Renting damp basement apartment?

    I am living in a basement apartment of a house. the apartment was closed up over the summertime because there wasn't anyone living in it. the first couple of weeks it felt pretty damp and i ran my dehumidifier constantly. i figured because it hadn't been aired out etc. that it would clear up. well i have now been living in it for five weeks and the dampness hasn't gotten any better. i can't hang my clothes in the closet or leave them in the dresser drawers without them being damp the next day. i don't think this is normal. also my bedsheets and blankets feel damp and sometimes the furniture does too. i didn't sign a lease with the apartment. the agreement was that i would stay until the end of the school yr (april). my dad wrote up an agreement on a normal piece of lined paper just stating that we would pay the rent for those months, but we don't have an official legal document. do i have any legal obligations to stay here? i live in ontario

    Barry is correct, this belongs in the Canadian RE section. IF Canadian law is similar, as I think it is, if you have any written agreement to stay x months that was signed by the landlord, conditionally, you must stay...... however, it seems as though you have a living environment that is unnatural and that can make your lease voidable. i do not know what type of expert handles dampness environments but your landlord knows or should have known about this. I would leave the unit as what you got was not what you sought, or agreed to; a clean, safe, HEALTHY place to be. YOU have PROBABLY a constructive eviction. get back to me if you seek further help

    Q. Rental lease questions and court issues! please help!?

    I live in canada, ontario and me and my friends have signed a lease to rent a house for 12 months and each of us are paying for our own room. we all signed our guarantor forms individually with our parents, however each of use signed the lease. now there are some issues with this house. there is mould on the carpet, walls, cabinets, windows. the air is extremely heavy for me since i have asthma and hay fever. the vents/ ducts are filled with what looks like droppings/ faces/ mould/ food/ cobwebs and many other things. some of the doors don't open properly and the previous owners left the house in a poor condition and the landlords did nothing to properly clean and fix the house. the floors were also very dirty, mould on the stove and the previous tenants had apparently spilt what looks like syrup in the fridge, also there is used razors in the washroom everywhere (that isn't a big deal but it just adds to all the other problems) unfortunately one of my friends decided to clean up majority of the mess and not address it to the landlords, so i don't know whether our word can be trusted. my family and i contacted the landlords ( there are two of them) and asked them to take care of this since the condition of the house is not suitable for my health. i was literally only able to stay in the house for 30 mins before i felt like throwing up and getting dizzy. my other roommates are ok with it since they don't have any extreme allergies and health conditions like i have. the landlords replied in return telling us that since one of them is a health inspector, they find the house in perfect condition and we are just overreacting. we tried contacting them several times and we were ignored. we contacted the agents that help find us the place and they never contacted us back, ever! previous to moving here we were also told that in order to get this house we were supposed to pay the first and last rent in advance and give the landlords 10 post-dated cheques or we would be fined hundreds of dollars, not get the house and our two (first and last payments) won't get refunded. now war are a couple of students, and we are not familiar with any of this stuff so we were scared of losing the place because it was close to our finals and we needed to get a house quick, and if we were to get a place to rent it would be during the school year since two of my friends live outside of canada. so we gave in our cheques, and then we were given our lease from the agents. i know that we should have had our parents come and help us but we live far away from our homes, and its difficult to have them come down all the way to the city we live in during our school year. so our parents were not able to properly consult anything with us before we signed the cheques. after we took the time to look over the long lease many months have passed and we had already payed for 4 of our months. there were some very fishy things going on in the lease and what our landlords have done. first of all the house had to be in a good condition for the new tenants, it obviously isn't. i also forgot to say that one of the windows in the upper level does not open, apparently its been stuck for years. this is against tenant safety rules. second our landlords were to do the repairs in the four months that we were gone, and they have done nothing! its the only four months where we aren't in the house and nothing has been fixed. so it will be difficult for us to have repairs done during our school year. and he gave us an unsafe , filthy bbq for us to use but in the lease it says that tenants are not allowed to use any bbq in the backyard and the landlords can severely punish us(fine us, and other things) if we do not follow this agreement. now, we weren't aware of this at all! at lastly, in the lease it says that tenants are not obligated/ forced to give post-dated cheques to the landlords, unless they are comfortable with it. we weren't comfortable with it, we were forced into without being knowledgeable of the lease rules and regulations. so after trying to terminate my lease so that my other roommates don't have to pay for the cleaning, we decided to bounce my cheques. the landlords are telling us that they can take us to court and that everyone of us are responsible for it. we are all paying for our own rooms, and we have our own guarantors that are responsible for our own rent. now, we have tried to do the formal way of terminating our rent but they never replied back to us, and have in fact ignored several of our calls, letters, and messages. the landlords are saying that he will take all of us to court if i don't pay for my own share. is he right or wrong in this? if he hasn't been doing his job can he actually do that? are my friends in danger of being sent to the court? and is this case in my advantage or his? they said that they tried renting my room to someone else but the market is very busy at t also previous to signing this lease, we were told by the tenant (she was the sister of the landlord) and the agent that the landlords were very trustworthy. all of the mess was out of view, the stains on the floor were covered with rugs and furniture. the house did not smell like it does now, since the house was actually very cold and the girl (sister of the landlords) was cooking food for both times when we came to see the house. i moved out so that my roommates don't have to pay extra for cleaning since the landlords said they won't spend a penny on this useless matter. i'm therefore in another place paying my new rent. what can i do so that i don't have to pay for two rents, and that my friends do not get sent to court?

    You should file an application(s) at the Ontario Landlord and Tenant Board. http://www.ltb.gov.on.ca/en/index.htm 1-888-332-3234 or 416-645-8080. You can do this even after you have moved out. At most board locations there is duty council available; these are lawyers who provide free advise to tenants.You can also retain your own lawyer or licensed paralegal to represent you.

    Q. Very big issue involving cats and our new landlord, what should i do?

    This is kind of a long story but i will try to write it in brief: i'm 19 years old, and a month ago moved out of my parents house and into my first 3 bedroom apartment with other roommates. we first applied for the apartment sometime in the second week of may and we moved in june 1st. the apartment is "pet-free" because the previous tenants left the place in a not very good condition when they got kicked out, and they didn't take very good care of their cats so they left a big mess. we signed the lease and were fine with that because we don't have pets that we need to take. my parents decided that since i am moving out, that they are going to get a smaller place because the bills have been catching up on them lately and its not worth it for them to stay in a 4 bedroom house when they only need 2 bedrooms (a second one for my younger brother). they found one through a coworker and immediately accepted it because the coworker wasn't planning on doing a credit check or anything like that, and it was close to work. they don't have very good credit so they jumped on the opportunity. after seeing the apartment, they decided they were going to take it besides the fact that they have 2 cats, who i love :), and the apartment is a pet-free place because the landlord will be living in the apartment underneath them and is highly allergic. they knew i couldn't take them because we already agreed not to have pets, but they took it anyway. now they need to move out of their current house by july 31st, and the cats have nowhere to go. we have asked everyone we know, and nobody can take them. my older sister just split from her long-term allergic boyfriend, but he still is at her house quite often to watch their son they have together so she probably can't have cats for another year. i have discovered that a landlord cannot legally kick you out of a house for having pets or discriminate against you for having pets here in ontario, unless the pets destroy property, bothers other tenants, or bothers the landlord. and any clause in a lease involving the allowance of having pets is immediately void because of this. they are cats, so they don't bark, and they are neutered and have their shots and everything, they pretty much sit on the couch. they will not destroy property. i don't want to get on our landlords bad-side, but i am not going to let the cats be homeless obviously. i do not want them to go to some shelter where they risk being put down if not adopted. i do want them to live here. my question is, should i bring this up to my landlord and tell her she cant kick us out and just take them, or should i do something else? we have been living here for a month and we still have another month before the cats are out of luck, but the landlord hasn't visited us once yet so i would have to talk to her via email or cell phone. just to clarify, our landlord has no allergies to cats or any pets, they just had a bad experience and have decided against it. they actually live about 45 minutes outside of our city. it is my mother's future new landlord that has the allergies and lives beneath them, thus why she cannot take them with her.

    The best way to go about this is to talk with the landlord honestly and explain the situation. Advise the landlord that you will sign off on a pet damages agreement and offer an additional deposit to demonstrate your goodwill. Be empathetic with your landlord as he has simply had a bad experience with previous cat owners and is trying to avoid the same situation again. If he agrees to the cats living there, make sure you look after them responsibly and clean the litter box daily. The worst way to approach the situation is to threaten the landlord in any way. You definitely will not achieve your goal by doing so.
