    I got a home with septic system and had no problems. I also have a well on my property so I got a water quality certificate for the bank, thats all they asked for.

    Septic systems are not a problem for the banks. The bank may ask for an inspection of the system, but that is something you will want as well. No point finding out after you buy the house that it will cost thousands to repair.

    Contact the neighbor first. He may be unaware of the problem. Sounds like he needs to have his septic tank pumped out. If he refuses to do anything, then call the health department and file a complaint. You can call the city or county government offices for your locale and they will direct you to the proper department.

    Q. My neighbors septic tank is overflowing and coming into our yard. it is a rented property?

    The tenants won't give us the number of the landlord. they said they don't have the number. i think it's because they have more people living there than they are supposed to plus they drove a uhaul over it which made a big problem much worse. i called the code enforcement officer in our town who left them a "note" what should i do at this point?

    We are new york state owners and a neighbors got septic runoff on our property. need to know the proper people to contact in this state.

    First, contact the neighbors. They may not know about it, and be willing to fix the problem with no fuss. Best solution. The NYS environmental protection agency is the governing authority, but I'd just contact your community's codes enforcement officer to get it taken care of. - Stuart

    I bought some land with a 30 foot parish drainage easement here in louisiana on my side of the property line and my neighbor ran her drain line to the ditch on my property.does she have the right to do this.i was told so many different stories.

    Drainage is for rainwater, not the stuff that comes out of a septic tank. Plus if the easement has been granted to the parish, it has not been granted to your neighbor. Block her line immediately.

    Q. I bought a house, come to find out septic not on the property, who is responsible the old owner, or us?

    Bought the house six years ago, township did a land survey, most of my septic is not in our backyard but in our neighbors. shouldn't of this been disclosed when we bought our home? can we sue the previous owners for putting this houses septic on someone elses property?

    My mother had the exact same thing happen when she bought her house 30 years ago. Her lawyer advised her to just come to an agreement with the neighbor and not bother to go after anyone. You might put in a lot of hassle for a whole lot of nothing. When the septic needs replacing then you can have it moved onto your land. In the meantime, discuss it with your neighbors and have some papers drawn up with them giving you permission to have your septic on their property until it needs to be renewed. Often times, if you try to sue someone in a situation like this, you end up spending more money then if you ripped up the whole septic and had it replaced. It is just not really worth it. Good luck!

    Q. Can i sue in small claims court for a real estate title issues.?

    Can i sue in small claims court over a "marketable title" issue. i bought a house and found out the septic is on neighbors land and now they want me to move it. can i sue the previous owners of the house b/c they did not disclose this to me when i bought the house and they are the ones who put the septic on neighbors property.

    This sounds more like civil court to me. You won't recoop very much in small claims and you need to prove that he hid this fact from you. I do not recall seeing anything like this on the disclosure forms.

    My yard is a grade below my neighbors yard. and his is a grade below a vacant lot that is for sale. the lot for sale has a culvert coming off of it at the street and water comes both across my neighbors yard and mine when it rains. i just built a house and my neighbor that also get flooded didnt seem to mind water was crossing his back yard into mine(when it was a vacant lot) but now that i have a house on it water has come across his onto mine straight over my septic and i need to address this before it comes and issue. i have diverted the water with landscape timbers however with todays rain i see it is really building up water on his side and yes its still coming over to my side and the septic. i live in the county not the city limits in texas if this helps. thanks im trying to be a pleasant neighbor.

    If the natural runoff is onto your property, there is not much you can do about it. For example. If you live on the side of a hill and the hill was left intact and each house lot was simply leveled, then the natural runoff for the hill is obviously downhill. If the water from a lot above you runs down to yours that is just the natural flow of the water. About all you can do is put a wall and/or curtain drain or even drainage ditch on the uphill side of your lot with a drain out to the street. However, if the natural flow was away from your property and someone did some landscaping that resulted in an unnatural flow onto your property, you can make the fix it. For example, you live in a development where the land is relatively flat and the natural flow was towards the street. Then a neighbor put up a cinder block wall along the front of his property, preventing water from reaching the street. Since the water can not follow its natural course down to the street it has to go sideways. And if that sideways flow forces the water onto your property, you can demand they fix it. In this case, they will have to put a wall or curtain drain on the bottom side of their property to keep the water off of yours. So the first thing you need to do is to determine what the natural flow of water is for the lots involved.

    Q. My neighbor built a large shop on his septic tank and drain field without permits, should i be worried?

    We are downgrade of my neighbors house, he built the very large shop right on the property line and on top of the septic tank and drain field all without any permits!!! is there anything i need to be worried about for my property??? any help would be great thanks!!!! he did leave the septic tank cover available to clean out but its right up against the building

    He will he the one with problems when the tank needs to be cleaned out I don't think you will be affected with this clowns stupidity.
