    Q. If 2010 taxes filed late in june 2011 will july 2011 gstc cheque be late?


    No you will not get any gst cheques until you file your taxes. and then I think you will have to wait for the ones you missed until your refund is processed. I didn`t file my 2009 taxes until this year and I didn`t receive any gst cheques for 2010 but after I filed them when I got my return they were all there.
    Someone said: so if my 2010 tax isn done i wont recieve july gst
    pcmaniacporter said: no. you have to have your 2010 taxes done so they can determine how much to give you.

    Q. Question on unpaid va property taxes from 2 years and 3 states ago?

    My husband just got out of the military in july, and we just moved to texas. we've moved several times in the past few years.. probably about 5 x to be exact, and i haven't used the usps forwarding service until now, and now that i've done that, i'm getting $700 property tax bills from when we lived in virginia! they are charging taxes for every single year since 2007 along with late fees! we haven't lived there since dec 2007, but they are threatening legal action if we don't pay the $700. are we legally obligated to pay back taxes for every single year since we haven't lived there since 2007? how do i resolve this without a lawyer? i definitely can't afford one! ftr, our car and motorcycle that they are charging the taxes on have been registered with the state of maine since may 08, and are about to be registered with the state of tx now. how do i resolve this, and... just out of curiosity, what will happen if we just ignore these? what can they legally do since we are in a different state and never plan on going back?

    If your husband was domiciled in VA during his service, you owe the tax. It would not matter that you registered the vehicles in another state. If your husband was NOT domiciled in VA and the only reason that you were paying the taxes was because the vehicles were in your name or joint name (military personnel not domiciled in VA don't pay the personal property taxes but dependents do) then a copy of your PCS orders and the registration documents from the next duty station should be enough to get them off of your back. That said, if VA provides a limited time to appeal a tax and apply for an abatement and you've passed that deadline then there's little that you can do now but pay the tax. One more reason why filing a USPS change of address, as well as changes of address with the tax authorities, is so important! Don't ignore it. VA can and will pursue you across state lines for this. Your credit will be trashed and you'll eventually pay through the nose in the end.

    I owe back personal property taxes since 2003 my total due is 575 up until 2008 well i called to day to make arragments and they said it was to late that i may have to go to court , they might seize my car at any moment and take my paychecks until it is payed . i thought you had to go to court for any of that stuff to start happening but he says becuase virginia is a common wealth state they can do it at any time. do you think he is trying to scare me are those the type of people that say stuff to scare you or what im not sure i did get a letter a few days ago and it said if i did not make a payment by the july 23rd they would exercise legal action . any info would be very helpful but my main ? is i thought that you have to be taken to court 1st before they can start siezing my car and taking my pay check and the person i spoke to on the phone says no i have 100 bucks to bring them tomorrow but he says thats not good enough please help this is in northern va please help :( any advice or websites that can tell me about the laws about this would be reallly helpful please thanks in advance . fyi i know i ws wrong now 4 not paying it but to be honest i was younger and did not understand the seriousnesss of it .

    I live in Va they can gain possession of any thing that you own free and clear for back taxes and if it is owed on they can put a second lean on it and if you go to trade it off you won't be able to until the second lean is satisfied they can also take your state taxes to pay the back taxes also hope I have helped you out some and they will do what they say they are going to do to good luck with everything and they also can garnish your wages until the balance is paided in full

    Q. Legal rights -- utility pole on my property and easement issue.?

    We purchased our house in 2005. on the back edge of our back yard (total property is about 1/3 of an acre) is a very large electrical utility pole which sits entirely on our property. when we purchased the house we were never informed about an easement and it's restrictions, other than we could not obstruct access to the utility pole by placing any structures beyond the outside edges of the house. in 2006 we purchased and installed an above ground pool in the back yard and within the "guidlines" that were explained to us when we purchased the home. recently, we received a letter from the utility company stating that our pool was in their easement and must be moved or taken down. per their letter, they secured a property easement in the late 60's (the house wasn't even built until 1978) that extends over 3/4 of the way from the property line to our back door... essentially rendering our back yard useless. so, i have 2 questions. 1) should it have been disclosed to us that the easement exists when we purchased the house or, was it incumbent on me to find out on my own? 2) if i am forced to remove the pool, what rights (if any) might i have to charge rent to the utility company who's gigantic power tower rests entirely on the property that i've purchased and pay taxes on? we live in virginia. any insight to either of those questions or, the issue in general is appreciated.

    You are in Virginia,. I practice in California .. different states have different laws, so lets be generic. Ok.. lets start with #1 When you bought the property, you were prob. given a title report to review. Given that there was an obvious electric tower in the back yard, I would presume you asked about it (?) Today, many easments come in to being via the subdivision that creates the individual lots and that would be listed in the title report as an 'exception'. Likewise, if a previous owner of the land sold the right of easment it would also be shown in there. The year the house was constructed is not relevent to this right. So..... if it is NOT in the title report, and if you did not receive any disclosure on the matter you can likely submit this as a claim on your Title Policy (which your lender required you to purchase unless you paid lump-sum for the property or received it in another manner like inheritance). Title policies do not expire.. they are good for your ownership so go find it and check it and then act on it if the easement is not in there. Ok.. item#2 If the utility company has an easment they are bound by the requirments and obligations of that easement. Typically they have already paid for or been given the right to use the land so there is no rental due. BUT.. your search (exclusive of answer #1) begins with: a) Get a copy of the easement. The utility company will likely give you one or you can challenge them on their rights and then they will provide one . b) Read it. c) Read it again... d) Now you know what YOU can do and what THEY can do.. its usually pretty cut and dry but it often takes a couple of readings. e) THe good part is that if it was not disclosed or in the title policy, the title company may pay to relocate the pool or reimburse you for its construction and removal costs. good luck in both venues... .

    I'm in a bit of a peculiar situation; i lived in florida for five years, and florida has no state taxes. i then moved to virginia for six months in late 2007 and paid state taxes for viriginia. i then moved to afghanistan for a year. i did not buy any property in va, nor did i ever get my license or registration changed to va. also, when i voted last year, i registered and submitted an absentee ballot for fl. i was told that because of all of this, i'd be able to file a tax form that would give me all my va state taxes back. i don't remember the name of the form; can anyone help me out with this?

    We just moved to maine and our virginia tags are about to expire. i would just renew through va at their online dmv, but i owe property tax still and i can't afford to pay it until i get the stimulus check, and ours isn't coming until much later since we're getting a paper check. can i just go to the maine bmv for now and get new tags for the car? what will i need to get them when i get there? thanks!

    First you establish ME residency. See http://www.state.me.us/sos/bmv/licenses/residency.htm Then you change over your drivers license and car registration to ME, and you will be all set.

    Illegal aliens do take advantage of welfare programs in the US. Influx of illegals also contributes to lower wages for the unskilled in the US. My question is, how can most people I hear talking about this topic get so passionate about poor people illegally immigrating from Mexico and stealing welfare, not get at least as angry about rich cats in their own government who steal much, much more?

    Q. Capital gains tax on rental property and primary residence sale?

    In 1987 my ex husband and i purchased a home in ga. one year later he joined the military and we moved and the home has been a rental property. i foolishly paid extra on the mortgage, not knowing at the time that this would increase my capital gains tax. now, divorced i purchased my ex's interest in the ga home and i purchased a home in maryland in 2004 and may be relocating to virginia in dec 2008. are there any loopholes that would assist in lowering the capital gains tax on the ga home? i thought of refinancing the loan to a higher amount but i'm sure that would not work as easily as it sounds. also, would selling both homes and relocating to va help in any way? i read something that said if a second home was sold in combination with a primary residence then used to purchase another home, there could be a loophole for some... thanks!

    Some residents of mountain view are challenging the planned move of a day laborer center to their neighborhood and have enlisted the help of judicial watch, a conservative national group that wages legal battles against similar centers around the country where immigrants seek low-wage handyman work. the washington, d.c.-based non-profit which has a project called "sanctuary busters," has sued cities around the country, claiming that day laborer centers violate federal immigration law at tax payer expense, by hiring illegal immigrants. "we're researching the facts in mountain view," said christopher j. farrell, director of research for the group, a non-profit based in washington, d.c.. "litigation is certainly one of the options we're considering." wednesday night, farrell led a meeting with several dozen residents, "a public education effort," he said, about the work that judicial watch has done on illegal immigration enforcement. it has filed lawsuits in herndon, virginia and laguna beach, arguing that taxpayer money was being used to pay for the operation of day worker centers in those cities. chris newman, the legal director of a national group of day laborer centers, the national day laborer organizing network, dismissed the lawsuits as "baseless."
