    Q. What happens to mortgage debt if the debtor dies and there are other property owners not on the mortgage?

    My wife, her uncle, and her mom are on the deed of our house as joint tennants in common. her uncle has a mortgage on the property. he is the only person on the mortgage. her uncle just passed away yesterday. my question is what hapens to the mortgage? i am sure that the mortgage company will want to close the account and be paid for the debt. can they forclose on the property even though there are other property owners who are not signed on to the mortgage? will we need to re finance the motgage? will the mortgage company just put a lien against the property? will thet just file a claim against his estate? he was fairly wealthy and initially bought the property for tax prposes. he agreed to add my wife to the deed and took out the mortgage as a means of payment to him from her, as she had no credit. the agreement was that my wife and i pay the mortgage, even though it is in his name, and he takes the tax benefits. should we not tell the mortgage company that he passed away and just keep paying?

    The debt remains and passes to his estate. Before title on the property can be transferred through the probate process, the mortgage will have to be paid off or refinanced by the heirs. In the interim, the estate is responsible for the payments.

    Q. Putting a lien on the parents home?

    I was involved in a traffic accident where the person who hit me (at fault) is 35, uninsured, no job, living with her parents who 100% support her. i want to put a lien on the parents home for the damage i have to pay for my vehicle ($8,000). i risk the parents could try to sue me for a frivolous lien. my legal argument is: the daughter would inherit the property when the parents die, she has rights to the parents estate. ***i did find that if i was hit by an unemployed house wife who had no assets of her own, but was supported by her husband and lived in the husbands house, i could put a lien on his house. in this situation the parents are incense the "husband." anyone got any insight or comments on this or am i just blinded by my own anger in the situation? i'm in florida, oh, and the 35 year old dead-beat has a pretty long rap sheet for writing bad checks and shop lifting (on probation).

    You cant lien the house. There is no legal nexus between the defendant and the house unless she owns it. Inheritence is speculative and the possibility of inheritence does NOT create an estate in the subject property . You cant lien a prospective inheritence. In addition, before you could lien a house, you need a judgment and then an "abstract" of that judgment is recored on the land records. But it must be against the property of the defendant, not the parents of a 35 year old.

    I live in texas and i had a notice on my apartment today saying that they will be doing random inspections tomorrow. my lease says this: when we may enter responding to your request * making repairs or replacements * estimating repair or refurbishing costs * performing pest control or doing preventive maintenance * changing filters * testing or replacing smoke detector batteries * retrieving unreturned tools, equipment, or appliances * preventing waste of utilities * exercising a contractual lien * leaving notices * delivering, installing, reconnecting, or replacing appliances, furniture, equipment, or security devices * removing or rekeying unauthorized security devices * removing unauthorized window coverings * stopping excessive noise * removing health or safety hazards (including hazardous materials), or items prohibited under our rules * removing perishable foodstuffs if your electricity is disconnected * removing unauthorized animals * cutting off electricity according to statute * retrieving property owned or leased by former residents * inspecting when immediate danger to person or property is reasonably suspected * allowing persons to enter as you authorized in your rental application (if you die, are incarcerated, etc.) * allowing entry by a law officer with a search or arrest warrant, or in hot pursuit * showing apartment to prospective residents (after move-out or vacate notice has been given) * showing apartment to government inspectors, fire marshals, lenders, appraisers, contractors, prospective buyers, or insurance agents now what exactly does "exercising a contractual lien" mean?

    That means letting someone in to repossess property.
