    Q. If you are late with your payments and the bank refuses to renew the mortgage?


    This is bad. You may need to transfer to another lender and they would possibly give you a mortgage but with a higher rate. This is an agreement you did with the lender - pay your mortgage on time. Late payment once is not an issue if you talk to them but frequent late payments - you are lucky they did not call in the mortgage as say you are in default of your mortgage. Default means they can start the foreclosure process. If you are in Ontario and you have debts beyond your income, call me and maybe we can restructure your mortgage and debt payments to a more affordable payment program.

    Q. Impound for forgotten ticket=susp lic, had resolved w/ police dept, etc, bank refuses to give car to owner now

    A ticket was mistakenly not paid, car was impounded in los angeles. son took care of all issues regarding an abstract and license renewal, was waiting for the dmv to receive abstract for a total of 11 impound days. on day 12, son went to police dept to obtain release from the impound and was informed the financier, wachovia bank, had arrived an hour beforehand and took vehicle. all payments on loan are current and insurance and registration free and clear. bank would not return calls for 5 days or any information or how to obtain the car. after many calls, finally was told the bank would not release car, and would be selling it off at auction due to the impound. would not give any possibility of paying them the tow fees back or even discuss other than their "impound is why we are taking the car." were told by the bank legal department that the vehicle had been there over 30 days... clearly mistaken information. have any idea what direction to head? cannot even work w/o a car !

    Try legal assistance- a lawyer may be able to file, and block the sale. There are also free legal advice websites like freelegaladvice.com ---google for others. Keep complaining to the higher ups, take notes and document all conversations. Try the CEO of the bank. Bottom line is read your loan agreement, you may not have a case, even so try appealing anyway, you may get someone to intervene if your stress the hardship and poor customer service and how this would be a blight on their reputation and integrity. Also does your local newspaper or news have a citizens help line? Or write letters to the editors. File a complaint with the BBB. Research what State Department oversees and regulates wachovia and contact them to complain and enlist their assistance. Good luck!

    I was forced to exit my company by my partners about 2 months ago. now some of the commercial notes are up for renewal. the banks would like my financials do i have to sign on these renewals...or will they just have to refinance. is there going to be an issue with my credit if i refuse to sign?

    Do not sign the renewals without first talking to an attorney. If your partners financials are so weak that the bank will not extend the notes on their credit, you have avery substantial bargaining point. On the other hand, the bank might decide that they are so weak that it will call the niote and pursue YOUR assegts. You need legal counseling.

    Q. Us visa renewal denied?

    I got a visa to the us to attend my sister's wedding. i stayed and left within 3 weeks as requested. since the visa is valid for one year up to six months stay - i returned to the us again. my sister was having complication with her pregnancy because she's diabetic. the doctor ordered bed rest and was on the iv machine 24 hrs/day. i stayed up to five months - spent the holidays and saw the birth of my first nephew. the us consulate denied my visa renewal saying that i overstayed. i have a house, a large sum of money in my bank account, 15% ownership in a multimillion dollar family business. i have strong ties to my country but the us consulate is holding the five months stay against me saying that i can’t perform my work. they refused to accept the fact that with technology nowadays, i can telecommute. will the us consulate ever approve my visa again? will they ever get over my five months stay? should i wait 3-5 years to reapply? is there anything i can do? please advise.

    Since money is not a problem, hire an attorney. Don't do this yourself.

    Q. Renewing my german passport in the uk?

    I have a small or big problem (not sure how big it is). i need to renew my german passport in the uk and my appointment is on monday the 10th of may. i just went through the check list to make sure i have everything. now here comes the problem it is asking me for my deregistration from germany abmeldebestätigung. i do not have one as when i first came here i had to use my german address as prove of address at the bank when i worked as an au pair as the family i was with was not willing to register me under their address. i later moved and applied for a national insurance and registered to my uk address. i was until now never aware i had to deregister or i would have done so i there anything i can do or are they going to refuse me my passport renewal?

    My boyfriend is German and I don't think he's ever had a problem with it. The best thing to do is ring the Embassy and ask them.

    How does a subordination of mortgage provision in a lease help protect a landlord? i'm trying to figure out why a landlord would even add this provision in? if a rental gets foreclosed on, isn't it the bank that has to deal with the tenant and the landlord no longer has any involvement? how does a subordination of the mortgage clause help protect a landlord? a clause such as this ""16. subordination to mortgage this lease and all renewals of this lease shall be subordinate to all present and future mortgages on the house and grounds. in a sale of the house and grounds arising out of a court proceeding known as foreclosure, the holder of a mortgage on the house and grounds may end this lease. the tenant shall sign all papers needed to subordinate this lease to any mortgage on the house and grounds. if the tenant refuses, the landlord may sign the papers on behalf of the tenant" i don't understand what the landlord is trying to protect if it's the bank that has to deal with the tenant? can you shed any clarity? my lease is up for renewal and i'm definitely going to argue this clause, i want to his side before aruging to create a compelling argument.

    When you do a mortgage on investment/rental property this language is in the closing docs & the owner must agree. He is supposed to insert this language in all lease agreements. Most don't however. He is just covering his self.

    Q. (uk) can a party enforce you to sign documents without the permission from the court during a law suit?

    I'm an year 1 legal student and i came across this immigration case. (reason for this not being on the immigration category is beacuse it's now a law suit) the applicant made an application for a student visa renewal, homeoffice accepted the application, after-wards the case worker realized they couldn't process the payment as they couldn't read the last two digits on the application fee page. they sent a letter to the applicant stating that they couldn't read the last two digits and sent a new payment page, keeping the rest of the application. on the letter sent it was stated the date they received the application, however they sent back the letter and the new payment document to be filled on the exact date the applicants visa expired. therefore when the applicant would re-fill the payment page and send back, this would be after the current visa expiry date. they kept the application without a responce for over a year and stated that by then, his/ her university degree would have come to an end and therefor they do not need to be here and have refused the extension visa and have given no appeal right stating that the application was made after the expiry date. but the university had differed the course date due to lack of students and the applicant was still attending university at this point in time. the applicant files judicial review and the lawyer representing the homeoffice request he makes a new application and the application would be regarded as a fresh document without involving or carrying across any influence from the past application that was refused. and put a stop to the judicial review. the applicant make a fresh application, with all the evidence to support his university course, funds available etc. note that when the previous application was refused the passport was not released to the applicant, therefore the application was made without the passport but stating that it was with the home office. within the meantime the applicant was requested report and sign every once a month at a center 22.7 miles from his/her place of residence. recently they refused the application again, stating that the bank statement did not contain the required information. no detailed information on what it lacked.... after looking into the documents, i can assure that it did meet all the requirements, including the funds, details of the account holder and an authentication seal with the branch mangers seal and date on it. the applicant has now filed a judicial review, the homeoffice has failed to respond to their lawyer and the lawyer is now requesting more time to file a defence. the latest development is that now the place that the applicant is signing at, have told him/her that they do not have any information relating to his/her passport and are threatening him/her to sign a document that says the applicant lost his/her passport and would agree to go to the high commission of his/her country to obtain a new emergency passport. and this information was not put through the court, this was done without any advanced notice, only when the applicant visited to do the monthly signing.... luckily the application speaks for itself as the applicant has only signed the document and all the other information was filled into the form by someone else. the pages that were signed were blank papers attached to an application admitting the loss of the current passport and requesting an emergency passport. is it possible to obtain such information outside the court during a law suit? especially since the border agency is part of the homeoffice itself, any law suit against the home office should be notified to the border agency and they would require to demand any information etc.. in writing and keeping the court aware of the current situation, and to demand signing that you lost your passport and threaten with detention, for someone who has no criminal history? or have they just lost the passport and have no excuse and are trying to do the dirty work outside the court taking advantage of a vulnerable foreign student, hoping they would get frustrated and leave after paying a full university fee of over £25,000 ??? thanx for that compliment helen seven :) i wish i could add that comment on my cv :p actually i study corporate law, so i doubt if the lecturers are gonna be interested in an immigration related question. but this case was so interesting and i just felt that this was a typical case where people are using their professional capacity to intimidate someone who's on the "right" to cover up their mess.

    Don't your law professors allow questions? Maybe you should transfer to a more user-friendly law school. You've got more legal training than 99.99% of the idiots on this site.

    The Rothschild Cartel just gets down and goes after what they want, and they have the money to buy off officials and control information. Their total list of ugly deeds, would fill volumes. They have openly attempted a one world government run by them, in the 1800s, and they are still after it by hood crook and extreme devious actions. The attack Murdock because he's a threat and their propaganda hasn't worked. It would not surprise me at all if they set up the whole scandal by paying people to hack cell phones. I'm sure it's part of their every day procedure to spy on people. They could have easily extorted or bribed someone in Murdocks organization to pull this crap. They would guarantee an easy sentence and a huge pay off. The Rothschild Cartel's hold on the world is more significant than Capone's hold on Chicago.

    Q. Does playing online poker affect my credit rating?

    I play a bit of online poker...depositing about £100-150 a month to one particular site. sometimes i make a bit, sometimes i lose a bit but i play it for fun as a hobby. one of my colleagues mentioned that a friend of hers has just been refused credit because they can see that she gambles online...however, with this particular person we are talking thousands and not hundreds! my mortgage is up for renewal next year and i was considering stopping playing for three months so it doesn't show on the 3 months bank statements you have to submit...anyone think this is a good idea?

    I would suggest you send off to Experian or a large credit agency and get a copy of your credit file. It only costs a quid and you will know for sure. It will show any loans, credit cards bank accounts you have applied for and any defaults if you have any. Go ahead and do that for peace of mind. If anything shows up you will know well in advance and you can get things removed if they are unfairly affecting your credit. Best of luck.

    Q. My landlord is in the final stages of forclosure and landlord won't return our calls.?

    The property is set for auction in 30 days. we haven't paid him for this months rent(because he is avoiding us) our lease was due for renewal in jan. but was never signed due to his avoidance of all calls. and the property we are moving into wont be ready until 10 days after the bank takes over. my question is: what are my rights i feel we are just in limbo, am i in default of lease for not paying? we dont intend on giving him anymore money and will i be able to stay until our other property is available. las vegas nv. 16 hours ago - 3 days left to answer. additional details 14 hours ago nrs 118a.250 receipts for security, rent and other payments. the landlord shall deliver to the tenant upon his request a signed written receipt for security and any other payments, deposits or fees, including rent, paid by the tenant and received by the landlord. the tenant may refuse to make rent payments until the landlord tenders the requested receipt.     Your question about being liable for rent is Yes, you are liable for rent. Your rent is due whenever the lease states, as you, yourself state here. The thing about the receipt is that you have to ask for it, "upon request." If you do not normally request it then it is not expected and you would also owe any late fees. He can evict you now or even after you leave to recoop the funds, plus interest and all legal expenses and will win them in court. Your contract with him is still valid and enforceable regardless of his other contracts in which you are no party. His foreclosure does not give you license to violate the contract that you signed.
