    Q. Can you get denied after getting a approval with conditions for a mortgage?


    "Unless the conditions are not met within the specified..."



    Unless the conditions are not met within the specified time period and no there extenuating circumstances happen before closing, you should be able to get the mortgage. Issue is if they call your company and what you presented as your income is not the same as what company told the underwriter, they may decline you. If they suspect that the documents are fake, they may also decline you. You need to make sure that all conditions are lifted before the date it is due to avoid issues.

    Q. Can i keep the buyers deposit after they pull out last minute?

    House had a conditional offer, then the offer was firmed up as all conditions met. closing date was june 30, 2010 6pm. found out on june 30th, 2010 at 2:30pm approximately that they buyer is pulling out and doesn't want to buy anymore. lost out on previous business plans for the home. had it rented as a vacation rental for the entire summer and had to cancel everything when they purchased. all furniture that was purchased for that business, we didn't have enough time to sell it or try and recover anything because the buyers requested a super fast closing. a deposit was made by them and financing confirmed way back when the offered was firmed up. we've also found out that they have put an offer on another property a few houses down that went up for sale after the offer with us was firmed up. surely there must be some sort of compensation for lawyer fees and loss of income and upset that they caused with all this? also - this is in ontario canada.

    Check with a real estate attorney on suing for non performance is what you want to do.

    Q. Refi closing, second credit check done, made a purchase...?

    So i'll be closing on a refi in mid-dec. anyway i used my credit card to purchase a laptop ($1300) on 11/20. i just learned they might run another credit check prior to closing. so i disclosed this purchase to the lo but am weary of what she wrote me. 1 - credit documents expire on 12/6. does this mean a second check? lo wasn't sure if they already ran the 2nd check because we are clear to close. she said she highly doubts the new balance will show on the report. the closing date on the credit card is 12/10 and she doubts the info will be updated to the bureaus this month, probably not till january or feb. 2 - $1,300 purchase on an exsisting cc will not change my ratio (how does she know this?). only if i opened new cc's and started charging like mad or opened new loans for a car, etc... might cause a re-evaluation and freeze. 3 - since we are "clear to close" all conditions have been met (reserves re-verified a 2nd time, credit score high 825, d/i ratio fine, title clear, insurance pre-paid...) there is nothing to worry about. what do you think? i was kinda surprised at her email. i offered to pay off the new $1,300 balance since i have it in savings but she told me not to. she said its not worth it and it would not even reflect on a credit report this month nor would it change anything in my profile. comments? i was thinking of just paying the balance off but then again i think she's right, even if they do pull a 2nd chk say mid-december would it even reflect it in time???? her telling me the purchase won't change anything also makes me weary...

    The reason is Fannie Mae’s Loan Quality Initiative (LQI) rules which have resulted in lenders pulling last minute credit reports and additional verifications of borrower information. If you have racked up a big credit card bill before your closing, these last minute credit checks could result in a closing delay, pricing adjustment, or, worst, loan approval cancellation. You probably want to let the bank find out from you, rather than from the credit reporting agency. If you have the cash to pay it off, they'll let you pay it off, then close. Make all payments by check so you can document it.

    Q. Have you ever met slow crazy drivers like that?

    Today when i was driving back from road, some old dude was driving in front of me slow, under speed limit. usually on my roads, it is ok to drive 5-10 mph faster depending on road condition and area. once i tried to pass him, in the moment when i got by his side, then he accelerated a lot much faster above speed limit (40 or more mph!!) and didn't let me pass him. once i got back on line, he returned to very slow speed. geez. i was so frustrated by this crazy moron. i didn't not honk on him, but at least i showed him middle finger when at red light he was looking at rear mirror. then when he got on two lane main road, he drove on two lanes! then once he hit traffic jam, he skipped couple cars on left lane by driving on right closed lane! fortunantly i had soon for myself on right side another road, unjammed leading to my home. but geez this guy was crazy. woudn't you get very frustrated or mad if you met a driver like that? the speed limit on road was 20 but only during school period. i think otherwise it is at least 25. would you honk on them if you got frustrated?

    I live in Tyler, TX, home of the worst drivers around! That happens all the time, and I have people pull in front of me and slam on their brakes, but the most classic case was this: At 4 a.m., my friends were taking me back to my house from Lewisville. We saw a car going all the way from the left to the right lane and back again. I have more stories, but I'll spare you. Anti-psychotics really help : )

    Based on your three requirements, your best bet is the Sanyo Xacti VPC-HD2. The camcorder records 1280x720 HD video files in MPEG-4 format and allows you to transfer video via USB to your PC or to remove the SD card and transfer directly. You can connect to a television directly with HDMI. I have the older version of this camcorder and I am thinking of replacing it with the VPC-HD2.

    Q. Florida real estate escrow deposit, our funding was denied can we get the deposit funds back?

    We signed a contract to purchase the home, we had conditional approval. we attempted to meet all the conditions. we met them all and then a hurricane damaged the house and we had to extend the closing date until after the repairs were made. after four months, the repairs were made... then at the last minute our company called us and told us the conditions weren't met and we were denied. this took place in 2004. we have been attempting to get our funds back ever since. the sellers claim they should get the deposit funds back. we obviously think we should get them back. we filed in small claims and go to mediation on monday. they have hired an attorney, we didn't think we would need one in small claims. what should we do? who should get the money? help, we need an answer soon! if you need more details, just ask. thanks! standard "as is" contract.. the only thing that it says in the financing paragraph is that we have to give them a conditional loan approval in 10 days.. their attorney is saying that we are did not perform the contract as stated in paragraph s... we didn't get an attorney because this is small claims.. these people (the sellers are insane :-)

    I am not a real estate attorney. I am a Realtor in Florida. You were the Buyer, correct? What does your contract say about financing? Which FAR or FAR/BAR contract was used? Or, what did your Realtor include in the offer, which was accepted, regarding financing? If you haven't already done so, get a letter from the LENDER, not the loan officer or mortgage broker, stating clearly you did NOT meet all conditions resulting in the loan DENIAL. Why has this taken so long to settle? Did you have a Realtor involved? Typically, escrow disputes are pretty clear. Title companies typically will not take a position. They'll simply refer you to arbitration. Many, many times I've represented customers who've suffered a similar experience, i.e. sellers refusing to release the binder. A letter from an attorney has weakened the most stubborn sellers 100% of the time. Granted, the buyers I represented were in the right. I don't know all details of your situation, i.e. contract used, and 4-month delay. Disclaimer: I am not a real estate attorney.

    Q. How much longer for a clear to close?

    My husband and i are buying a home. we have satisfied all prior to doc conditions and our mortgage broker still has no word on when we are going to close this thing. the problem is the entire deal has been piece-mealed together. the broker has lost documents on several occasions, resulting in us having to re-send stuff 2 and 3 times. now that all conditions have been met, and we are waiting on closing docs, the seller has decided they want to pull out because the process has taken way too long. now all of a sudden the broker says he can get closing docs by wednesday or thursday of this week. does it really take 3-4 days to write up closing docs? i am really frustrated, because we obviously can't pull out now, but i have a feeling our broker is stalling for some reason, or not being honest about something on the lender's end. so we were expecting our closing docs yesterday, instead we receive an email...not a phone call, an email from our mortgage broker saying that the underwriter will not accept our statements showing that all accounts have been paid off. instead, they want a creditors letter from each account showing the full account number, stating that there is a zero balance. even though we have sent them our full account statement showing the payoff as well as the balance due as $0. we paid these accounts off 3 weeks ago. didn't they know the minute we sent them the faxes that the official credit card statement was not acceptable? why wait 3 weeks on the day we are to close to give us yet another condition? it's almost like they are just trying to find something to tell us no, but are running out of excuses. we even paid off a $35k brand new car that was a christmas gift. gmac sent them a payoff letter, but because they only show the last 4 digits of the account number. all of our credit card statements, etc. show the last four digits of the account number, but the underwriter is saying, well how do we know this is you, since it only shows the last 4-digits of the account number. our name, address, s.s. #, clearly match the account, yet they won't accept it. anyone else still want to say this is not about race?

    First, has the closing date expired? If so, the seller isn't obligated to close and you will loose your deposit. If the closing date hasn't expired, then get a closing and financing extension in writing and signed by both seller and buyer. Now, dates are important. Most contract allow X days to obtain a loan commitment with closing X days later. If the date for a commitment has expired then you are obligated to close, or again, risk loosing your deposit. I'm not trying be be negative, just pointing out the facts. You didn't say who the broker represents, but even if it's the seller he has the duty to treat you farily and honestly. If he didn't suggest the closing extension, then he has probably violated the Realtors Ethics and Standards of Practise. You state all conditions have been met, but have you received final mortgage approval? Completing the closing docs doesn't take long, but funding by the underwriter is what causes the delay. realtor.sailor

    Q. What is life like as a geologist? loads of questions!!?

    If you are a geologist i want to hear how your life is like. i don't care how long, the more detailed the better. i have no knowledge in the field, never met a geologist nothing outside of nat geo and discovery channel. my overall goal is to be a planetary geologist (study other planets) as my career. ------------------- i was first inspired to be a planetary geologist after watching a show on discovery called "95 worlds and counting" http://www.youtube.com/watch?v=7mes 8rl0igy and also thanks to the recent mind blowing photos of nasa's hirise http://hirise.lpl.arizona.edu/nea.p hp so i want to do the equivalent of what the hirise team must be doing. i was told to get a bs in geology. what should i know about geology? from taking my first class to what i can do with it? with the talk being about global warming can i assume there are jobs out there, or is it like astronauts where there are more geologist than jobs available? who is better to work with noaa, nasa, usgs or others? questions i have: (1) i read as a geologist your initiation is basically spending 5 years on a oil rig or (fishing) boat? how true is that? will i have to do that? (2) how hard is it to be a scientist working in antarctica? ..like is their a waiting list or something? i want to work there and experience conditions there as it is close to conditions on "other worlds." (3) i live in virginia, should i transfer to a college in the west to do this? do you think there are decent schools here or will i have more benefits if i move to the west, for example to arizona. (4) to be a planetary geologist are the other fields important? like meteorology and oceanography? are they defined as "climatology" and would these be at all relevant? (5) do you travel while in school for geology? like field trips of sorts? do you visit volcanoes and experience hurricanes? do you go to other countries? are there colleges known for this? (6) how math heavy is geology? does it require really complexed math? (7) is the workload of a geologist really heavy? is it a stressful job, i know you have to travel a lot sometimes. (8) in the next 5 years where do you see this field? and finally, astronomers have space.com, universetoday.com, dailygalaxy.com are there similar sites for geology? who should i know about in geology, who are the neil degrasse tysons and carl sagons of geology?

    (1) I started out my geological career by spending 6 1/2 years working on oil rigs (mainly off-shore but also at some on-shore sites). After initially finding the work very interesting, it became very boring & monotonous; I was pleased when my employer made me redundant due to a fall-off in the number of their contracts. There are many graduates that start out their careers doing many other aspects of geology. (2) Here in the United Kingdom, there are occasional opportunities to work there with the British Antarctic Survey. As for people from other countries, I don't know but I believe there are opportunities. (3) If you want to work as a geologist, you need to think about WHY an employer would employ you. In most jobs (except for work in Government Surveys), an employer is wanting to 'do' something that has the potential of making them money & they use geologists to reach that goal. This may be gold exploration (in the hope of finding a gold mine), oil exploration (in the hope of finding an oil field) or soil / rock mechanics surveys (in preparation for the building of roads, dams, large buildings). By all means study planetary geology but you also need to consider its relevance to the jobs market. My suggestion is to enrol in a school that has a strong mining or petroleum emphasis. (4) I don't know the exact answer to that question. You would need to talk to people from the USGS who happen to be involved in planetry geology. As a guess, I'd say that it would involve some climatology & meteorology. (5) Yes, there are a lot of field trips; I travelled to both Spain & Zimbabwe when I was a student but my main travelling has been SINCE I graduated. I've spent 8 years working in Africa, 3 1/2 years working in Central Asia, 2 years in southern Europe and 1 year working in South America (as well as brief tours in Canada, Mexico & the Far East). I have never visited a volcano (though that MIGHT be part of your future course) but I have experienced earthquakes in various parts of world during my work there. (6) Maths does feature in any Geology course but there is not such a heavy emphasis as in Chemistry or Biology. The mathematics is generally not very complex. (7) Work CAN be stressful & heavy; it depends on the particular contract. It depends on the time of the year and how much exploration money the company has available to spend. The main thing is whether you want to travel, whether you want to be separated from your friends working on some different continent for 9 or 10 weeks at a time. Raising a family under such circumstances can be difficult. (8) I see demand for gold exploration increasing (because the gold price is so high). I see demand for uranium exploration increasing (because there wil be a continuing switch from hydrocarbon to nuclear generated power) and hydrocarbon exploration will increase (as there is no established, practical alternative to oil / natural gas for many of its end uses). As for your final question, can't comment since I know little about astronomy.

    Do I think it is well written? No. Quite the contrary. You do not get a pass because you are sixteen. If you want to write, you are expected to know the conventions, regardless of your age. From the first sentence, we are lost in a sea of pronouns. The piece is riddled with errors in grammar and punctuation. The language is trite and immature. Clearly, you do not know how to write dialogue. The concept of "the adverb is not your friend" eludes you. Well written? No. Back to the drawing board with you.
