    Q. Does a landlord have to give notice of selling the property in ontario?


    We applied for an assignment due to ongoing issues with our rental unit. We are also being heard at the Rental Tribunal as part of the issues in the home. The other day the owner put the house up for sale. That is obviously going to make assigning the home that much more difficult for us......any direction on how we should proceed with this?

    IF YOU ARE STILL RENTING THE SUITE OR APARTMENT AND THE LANDLORD NEEDS TO SHOW IT TO PERSPECTIVE OR FUTURE TENANTS OR HE/SHE HAS TO DO SOME REPAIR OR JUST NEEDS ACCESS FOR SOMETHING TO YOUR SUITE, YES THE LANDLORD NEEDS TO GIVE A MIN. 24 HOUR NOTICE AND THAT HAS TO BE IN WRITING AND NEEDS TO BE POSTED ON YOUR DOOR OR GIVING TO YOU PERSONALLY. HOWEVER, IF THERE IS AN EMERGENCY SUCH AS A FLOOD, OR SOMETHING ELSE THAT REQUIRES IMMEDIATE ACCESS LIKE SMOKE IS SEEN OR SMELLED IN SUITE, THE THE LANDLORD DOES NOT HAVE TO GIVE A 24 HOUR NOTICE. ALSO, JUST SAY YOUR STILL RENTING, BUT YOU HANDED OVER THE KEYS BEFORE THE LAST DAY OF YOUR LEASE, THE LANDLORD CAN ENTER THE UNIT OR SUITE. ANOTHER TIME, HE CAN ENTER WITHOUT A 24 HOUR NOTICE IS WHEN THE SUITE APPEARS TO BE ABANDONED, BUT HE MUST BE POSITIVE OF THIS FIRST.

    I live in a duplex in california. it is my parents property, and we rent out the other half to a family of 3. aside from the incredibly stupid act on my mother's side of not having this lady sign anything in the form of a contract when she first moved in, my mother gave her a cheap rental rate and no obligation to pay bills. she has been living here since oct 2007( before we moved in), and we have had no problems. however, my husband and i decided that it is ridiculous that she not contribute to paying a portion of the water and power and gas bill. we decided that we would pay 70% of the bill and they could pay 30%. i drew up an agreement for a month to month tenancy stating the new terms and when my mother and i showed it to them, she practically went insane, stating that when she moved in she had to pay nothing but the rent and that she would not be paying any bills. i explained to her that times are different now and costs are higher, so she will have to be responsible for her portion of the bills (we had given her 30 day notice that this would happen). i also explained that by presenting her with a contract in which the provisions are stated, she has the option to accept it, of find somewhere else to live. yesterday, we had a huge argument regarding the "renewal" of the contract an she (very rudely) said that this is unacceptable and that she would be leaving in a month. i took it seriously, so i immediately presented her with a 30 day notice ( i am very big about keeping things in writing). she refused to take it, so i posted it on her door and she replied "that little paper of yours can just stay there because no one is getting me out of here in 30 days". she then stated that by law, she is permitted up to 90 days to vacate. i disagreed since there was never a lease drawn up and it was a month to month tenancy (my mother told her verbally in the beginning). finally, we changed it to a 60 day notice and she said it was fine. up until now, she has had it very easy. her unit is a 1 bedroom and bathroom with a full kitchen, dining, and living area. she has a large front yard, how own gated parking space right in front of her door, kept a pet in the home (she never asked us if it was ok and sort of hid the cat until my mother noticed and said it was fine), and has had her yard maintained by my mother herself (which i think is f-ing ridiculous). she only pays $800 a month and up until now, no bills. my husband and i are stuck paying for her water, power and gas. i am pretty familiar with the landlord/tenant laws, but i want to know what extra precautions i can take. how many of you have dealt with asshole tenants before? anything to watch out for? i am afraid she will try and screw my mother on the last month of rent. my mother and i are in no financial position to pay for anyone's bills. i'm not taking food out of my baby's mouth so this lady can live more comfortably. oh, and chatsplas, the only reason my mother had me move in is because she wants me to manage the property. so in fact, it is my business. and to get another thing straight, my mother is signing and delivering (with me alongside her) any notices. i am not stepping on anyone's toes. i simply will not accept having anyone try and take advantage of me or my mother.

    When she doesn't leave you will need to go to court and evict her and it could take months. Your mother should have simply raised her rent every 6 months until she was gone. If she raised her $50 every 6 months the rent would be 200 higher in a couple of years or she would move out. Charging her for a percent of utilities when she doesn't have a meter may not be legal. Making you pay your neighbor's bills isn't right either your mother should pay the utilities for both halves of have meters put in.

    Q. Tenant moved out before lease was up?

    I had a tenant that had been with me for two years and then she signed a new contract. she moved out after 4 months into the contract. i followed the moving truck to get the address of where she was moving to so that i could file on her for breach of contract & to confront her about leaving the duplex unit dirty and some damages were not taken care of. her daughter also moved out on me 5 months before that and they moved to the same apt complex. the daughter called 911 and 311. i was sitting on the stair way in another building waiting for the movers to move her in before i went and confronted her. i was given a warning for trespassing and my number was blocked from the apt. complex. the apt. manager told my tenant that she had the right to move and that i could not hold her and that all she had to do was give a 60 days notice. i have never heard of any such thing because you can not break a contract. she told me that is how their contract reads and mine too. mine does not read that way. they never even ran a reference on my tenant because they don't do that as long as the credit report is good. she was very rude and told me if i came back there that i would be arrested.& so did the police officer.this a a new place that is only 5 months old and very nice, but this is not the way you handle this situation. can i turn them into the board of realtors or something? i am 70 years old and have been managing property for 45 years and never has this happen to me. the daughter called me when i got home and left a very nasty message on my answering machine. she said they had the right to move and i there was not anything i could do about it and that she would file stalking and harrassment charges on me if i continued on with this. it was a very long message. is there anything i can do to the apt complex and to these tenants that are still under contract with me.?this in in texas. owners are suppose to work together and not against each other/ i actually never confronted them. i was over in another building. i mainly just wanted the apt. number & address to be able to file.

    If you are a landlord you need to get you act together and learn the laws. It's one thing to follow them and get the new address, but to get out and confront them. That was just stupid. No really what did you think they would do. Do you really thing they would just cut you a check on the spot, or just move back. Nothing was going to get settled there. I can't blame the new landlord for calling the police on you and blocking your access either. From the sounds of it you were a twit and are lucky you did not get arrested. If they did brake the lease and/or leave damages. You need to record that and keep receipts for the repair. Then you will have to take them to court and sue them for the damages and lost rent from the broken lease. Even after you win the court case you may have to force them to pay with a judgment and garnishment. Each one of these will cost you more money and you still may not get your money. You are a landlord this is your job, you get learn how to do it or you will get screw over. I'm not nice to deadbeat renters, but I even have less respect for lazy landlords. PS I'm from Texas as well and have been to court for renters issues several times.

    Yikes! Sorry to hear about your experience. I had a somewhat similar one when moving back to the city after college. I signed a lease and put down a deposit through an "apartment finder" only to find out a month before move-in that they got a higher bid from someone else and gave the apartment away. I ended up finding another place within a week using rent.com and moved in like 3 weeks later. I was really mad about losing the place I had hunted for but I ended up loving the new place so much more than the first one that I signed. The $100 gift card I got for using their service really wasn't much but it definitely was an added bonus! I know you say you don't want to rent but it may be a short-term solution until you can find a place to buy. As far as your previous situation... A lease is a legally binding agreement. I would find a real-estate layer in your area who will provide a free consultation and talk to them. They should at the very least pay for one of your moving expenses. If you signed a lease to start on a certain date I feel like they should also pay for your rental expenses until you can find another place of permanent residence. My fiance and I wish you and your daughter all the luck in the world and hope that you find the place of your dreams in the near future. Best of luck, let us know how things turn out!

    I recently posted a question about breaking a lease, but i will tell again and try to make it shorter in 2007 me and my boyfriend moved to va and it has been a nightmare! my boyfriend befriended a young maintenance guy when we moved here and things have been hell since... they were friends and had a falling out when he was on call and decided that getting drunk with the neighbor was more important than his job. we called in when our garbage disposal was jammed and he came over drunk and practically ripped our sink out of the counter top. he did not want to fix it then because he wanted to get wasted, and gave his word that he would be back in the morning to fix it. we called him countless times and finally around 1 he answered his phone. he asked if he could fix it on sunday (happened friday night), and i said no because my house began to stink due to the disposal being clogged and the sink hanging off the counter! we told him we were going to call the complex and get another person to fix it and he got so upset thinking that we were purposely trying to blow his cover and called us every name in the book and at that point i was pissed off! i pay near 1000.00 a mo. for a 600 sq. ft. apt, and no i will not tolerate him treating us like that, so you bet your sweet ass that i did in fact tell his manager the whole story! shortly after, we have been vandalized in such ways: 1. about a week after that, my fiancee and i were driving, wondering why his car sounded so loud. after we got home and looked, we discovered that his exhaust pipe was kicked off. called the property manager and she had the balls to say that becuase of the experinece we had with the sink we were trying to blame it on him to fire him. sp we called the cops and made a report. 2. a week later, my boyfriends car door had a puncture in it, looked identical what a flat head screw driver, and there was a lighbulb placed under his tire. we called the cops and they made a report. an investigator came out and he was fired shortly after being caught for steeling. after that, she offered us a 30 day notice (regular renter is 60, but because of our situation) for us to leave. we decided to stay because he was moving out in a week. he lived there, but becasue he was fired he was also evicted. we also got our locks changed incase he tried to make a copy of our key. 3. i know this might sound dumb, but in the summer (about 4-5 months later) we found a turtle in a pile of construction garbage. it was a really rare turtle, he was a box turtle, orange and brown. they are endangered. we had a scheduled maitanence call and the next day the turtle was gone. so, someone in the current maitanence position stole from us... made another report. 4. just last weekend, my boyfriend seen him when he was coming home from work talking to one of the current maitanence guys!!!! and he had a pit bull and threatend my boyfriend with the dog!!! the next day we notice key marks on his trunk, hood, and side of his car. called the police again, and took matter in our own hands and looked for other apartments and decided to give a 45 day notice to the apartment manage and she tried to tell us that when she offered the 30 day notice, things were different... what?!?!?! is she serious?!?! she said we had to give her a 60 day notice and pay a broken lease fee. we basically told her that was unexceptable, and after giving her all of the reports and pics of our damage, she offered to get in touch with some people and call us back. 5. oh yes, there is a 5!!!! just yesterday, my boyfriend comes home from work, and is home for 45 minutes and walks out the door to go to school. and he has a wonderful array of key marks on his front hood, to add to the others! made another report... meanwhile the property manager has not gotten back with us. and get this, we got a letter on a door, a typed letter from another resident stating that they saw the confrentation between my boyfriend and him last weekend and that later on that night they saw him walking around my boyfriends car, and that they startled them and scared him off. up until this point we never caught him in the act, but we knew no one else here and have only been here for a little while. we have no one, except him who would do that stuff to us! we wish the person would come forward and give their identity, but in the letter they stated that they lived alone and that theydid not want their safety comprimised or their property damaged due to the fact that they see the boy with employees all of the time... thinking that friendships will get in the way of professionalism. can they really hold us to a lease if we have all of this???? i know i said i would try to make it short, but my anger got the best of me and i had to let it out!!! feels good!!!!

    Return to the manager with the letter and the new police reports.If they deny you 30 days call the housing board for your state and present all your reports and the managers responses in writing to them.You may get it waved down to a 3 day with no penalties.Safety of you and your property comes first not landlords income.

    Q. I rent in california. had water leak, landlord wont fix. help!?

    So this past sunday, the angle stop on a toilet in my house gave out and flooded about 1/2 the downstairs of my home (approx 400 sq ft of living space). i have a newborn baby so luckily she woke me up for a feeding and i heard the water gushing downstairs. i spent the next 6 hours with a mop and towels trying to get all the water up. i emailed my out of state landlord and told her what happened. she called me an hour or so later and said she would call her handyman. he couldn't make it (doesn't work sundays i guess) so she gave me permission to get a home inspector friend (who also does mold remediation & contracting work) to come over and take a look. he determined that the angle stop on the toilet corroded and that the pressure valve to the house was busted. our water pressure was 130 while normal pressure is 60-80. this leak was not our fault. the plumber came and fixed the toilet and water pressure. the landlord gave us permission to rip up the carpet in my daughter's bedroom (next to the bathroom). we rented fans from home depot and had them run for 2 days to try and dry the walls out. my contractor friend came back 2 days later and tested the moisture levels in the walls... many read well over 18%. he gave my landlord a $1700 bid to open the walls and fix it the right way. she was floored, said she couldn't afford it, and wants her handyman to come and spray bleach on the walls and cross our fingers that mold doesn't appear. i have 3 children under age 5... i can't cross my fingers and hope for the best. i have a 2 year lease which expires dec 2010. what recourse do i have? can i give her notice that if it is not repaired properly i will need to leave? my lease reads that if a portion of my property becomes uninhabitable by no fault of my own, i have a right to leave with written notice. but if it is not fixed correctly, can i still leave? please help!!! thanks

    Your friend is a scum bag. Trying to scam your landlord. This repair should cost around 200, if that. Unless there was more then an inch of water the wall boards should be be wet, they are not all the way to the sub floor. Dry the carpets, spray a mild bleach solution on the base boards and you should be done. Those moisture levels are OK, the drywall holds moisture, this is normal and nothing to worry about. In fact if you ever buy a new home in CA you will run a humidifier for awhile, otherwise the air is true dry from the new drywall sucking up all the moisture.

    I recently posted a question about breaking a lease, but i will tell again and try to make it shorter in 2007 me and my boyfriend moved to va and it has been a nightmare! my boyfriend befriended a young maintenance guy when we moved here and things have been hell since... they were friends and had a falling out when he was on call and decided that getting drunk with the neighbor was more important than his job. we called in when our garbage disposal was jammed and he came over drunk and practically ripped our sink out of the counter top. he did not want to fix it then because he wanted to get wasted, and gave his word that he would be back in the morning to fix it. we called him countless times and finally around 1 he answered his phone. he asked if he could fix it on sunday (happened friday night), and i said no because my house began to stink due to the disposal being clogged and the sink hanging off the counter! we told him we were going to call the complex and get another person to fix it and he got so upset thinking that we were purposely trying to blow his cover and called us every name in the book and at that point i was pissed off! i pay near 1000.00 a mo. for a 600 sq. ft. apt, and no i will not tolerate him treating us like that, so you bet your sweet *** that i did in fact tell his manager the whole story! shortly after, we have been vandalized in such ways: 1. about a week after that, my fiancee and i were driving, wondering why his car sounded so loud. after we got home and looked, we discovered that his exhaust pipe was kicked off. called the property manager and she had the balls to say that becuase of the experinece we had with the sink we were trying to blame it on him to fire him. sp we called the cops and made a report. 2. a week later, my boyfriends car door had a puncture in it, looked identical what a flat head screw driver, and there was a lighbulb placed under his tire. we called the cops and they made a report. an investigator came out and he was fired shortly after being caught for steeling. after that, she offered us a 30 day notice (regular renter is 60, but because of our situation) for us to leave. we decided to stay because he was moving out in a week. he lived there, but becasue he was fired he was also evicted. we also got our locks changed incase he tried to make a copy of our key. 3. i know this might sound dumb, but in the summer (about 4-5 months later) we found a turtle in a pile of construction garbage. it was a really rare turtle, he was a box turtle, orange and brown. they are endangered. we had a scheduled maitanence call and the next day the turtle was gone. so, someone in the current maitanence position stole from us... made another report. 4. just last weekend, my boyfriend seen him when he was coming home from work talking to one of the current maitanence guys!!!! and he had a pit bull and threatend my boyfriend with the dog!!! the next day we notice key marks on his trunk, hood, and side of his car. called the police again, and took matter in our own hands and looked for other apartments and decided to give a 45 day notice to the apartment manage and she tried to tell us that when she offered the 30 day notice, things were different... what?!?!?! is she serious?!?! she said we had to give her a 60 day notice and pay a broken lease fee. we basically told her that was unexceptable, and after giving her all of the reports and pics of our damage, she offered to get in touch with some people and call us back. 5. oh yes, there is a 5!!!! just yesterday, my boyfriend comes home from work, and is home for 45 minutes and walks out the door to go to school. and he has a wonderful array of key marks on his front hood, to add to the others! made another report... meanwhile the property manager has not gotten back with us. and get this, we got a letter on a door, a typed letter from another resident stating that they saw the confrentation between my boyfriend and him last weekend and that later on that night they saw him walking around my boyfriends car, and that they startled them and scared him off. up until this point we never caught him in the act, but we knew no one else here and have only been here for a little while. we have no one, except him who would do that stuff to us! we wish the person would come forward and give their identity, but in the letter they stated that they lived alone and that theydid not want their safety comprimised or their property damaged due to the fact that they see the boy with employees all of the time... thinking that friendships will get in the way of professionalism. can they really hold us to a lease if we have all of this???? i know i said i would try to make it short, but my anger got the best of me and i had to let it out!!! feels good!!!!

    Put all this down in a document and sign your names to it, get a notary public to notarize it, and leave it in the manager's mailbox as you peel out of the driveway!
