    Good day Vernie, If you have registered the discharge with the land registry office, they would have a copy. If this is what you forgot to do and will be doing it after 15 years, you can approach your lender and find out if they have it in file. They would also point you in the right direction where to get the document in case they do not have it in file. It has to be available somewhere.

    Q. When do mortgage renewal papers get issued?


    ON Canada - lenders normally send notifications 3 months before the renewal date. You may even get a call from the bank about setting an appointment for you to come by and sign renewal documents.

    Wife and i are going through a foreclosure and im about to file divorce due to domestic violence by her. weve been married 1.5 years with no children and both names are on the mortgage and both on the title. property was purchased after we got married about 10 days. this is in illinois.

    I am guessing your wife may have quitclaimed herself off the title of the home because alot of people think if they do that, that they are not liable for the mortgage. We see this all the time on Yahoo Answers. An easy way to find out is to call the courthouse and see if that is what happened. If that is true, she is still equally liable b/c she is on the mortgage....she can't get out of that.

    Q. Does anyone know if someone signed one of your mortgage papers they we may of forgot is all of it void?

    We refinanced our home and to make it short we got our first bill and it was wrong so we tried to fix it and no luck so we didn't pay. they tried to forclose and when we got our papers have found someone signed my name on the note. we never received any paperwork from the time we signed for the mortgage. wouldn't our mortgage be voided? please help my husband and i refinanced and we signed everything in front of a notary and he didn't bring a set of copies with our copies, we called the loan officer and no answer so the notary called his boss and they said we would have our papers within one business day. still nothing to this day almost a year later. we got our first statment in the mail and it was 550 and we were supposted to pay 414 a month so i called they told me to just pay the amout and if it's wrong they will refund me i asked agian for our copies of the papers we signed nothing. so we didn't pay which was wrong i know. we got served with forcloser papers and in the papers was some of what we signed and then we realized that some signed my husbands name you can clearly see the differnce. some of the doc's in the forcloser papers are the only papers we have the we signed. i contacted the the finance company and they told me one missigned paper doesn't make a differnce. i think it does it's fraud isn't it? ok sorry to you all if i'm not that clear i'm a first timer not sure how this all works. i'm tring to clear up all your confusion. we refinanced no money out just a lower interst rate, yes we signed all our papers infront of a notary. as best i can guess is we forgot to sin one of the papers and instead of the nortary coming back out him, the title company, or the mortgage company must of signed it. and no we didn't make a payment to the mortgage compay because our monthly statement is wrong we have however stuck the orignal monthly payment from the beginning in a savings account. were not tring to get out of the loan we understand that we took out the refinance. we just don't think it's right for them never to send us our copies of the paperwork after request hundreds of times and now finding a differnt signature on the papers we did receive. i thought fraud was fraud a big no no.. i'm upset that when i contacted them on the issue they tell me one wrong signature is ok on something

    It does not sound like fraud to me. Although it sounds as if you are wanting to commit fraud yourself. It does not matter that you forgot to initial one of the 20 or so pages of your mortgage , your husband did and it is reasonable to believe that you did not initial by mistake, not because the bank was trying to hide any information from you. Your mortgage is not void. They gave you a chuck of cash, you spent it, and now is the time to pay it back. That is pretty simple.

    Q. Mortgage fraud? i signed closing papers with 5.5% interest rate. when my bill came, it showed 6%?

    I just bought a house and closing papers i signed showed 5.5% interest rate. when the first mortgage bill came in the mail, the payment was for 6% interest rate. all my papers have 5.5% interest rate and i think some sort of fraud occurred. any insight?????

    The note should be in your closing package. It will have the rate on it. If it says 5.5%, then the statement from the lender should also say 5.5%. If someone doctored the note while the loan was being sold, it sounds like some hanky panky. I would ask the lender to send you a copy of the note from their records. I don't know if it is possible that the rate was disclosed at 5.5% at the start of the process and then changed at some point later to 6%. That should have been re-disclosed within 3 days of the change or at closing whichever came first. I know from experience that if the rate on the note at closing was 6%, the change happened more than 3 days prior to closing and, therefore, it should have been re-disclosed prior to closing. Don't freak out, but get to work on it immediately. Good luck.

    I have been asked to sign a mortgage discharge paper so that my ex can refinance the house to pay out my settlement money. what is this form, if i sign it, am i signing over the house or any rights to any future money? thanks

    The mortgage discharge form is necessary for the the organisation that holds the loan over your property can, on settlement, pay out your existing mortgage and pay you what you are meant to receive from the settlement. I suggest, that you talk to your solicitor to ensure that your rights are being respected.

    Q. Does mortgage broker/lender need to get a paper signed by me(borrower) before they lock a rate ?

    I have got a gfe from a mortgage broker and i had seen the rate as 4.85% for 5 yr arm. 1) now before locking the actual rate, does the mortgage broker or the lender need to get me something signed from me ? 2) hoping i am not committing anything to the broker/lender after signing the gfe papers ?

    You should run from an arm like the plague! Have you not read of all the foreclosures in this country because those ARMS adjusted and put them right out in the street. Before they can lock you have to commit to them.

    I don't know how to interpret all the mortgage papers so i don't know if he co-signed. i'm going to miss this month's monthly mortgage, i just don't want him to have a bad credit because of me.

    you need to find the deed or trust documents. see who is legally bound to make the payments for the property

    My wife and i signed a mortgage papers. she signed the note and i didn't. she became ill, we had to abandon the house and let them foreclose. she's passed away and the mortgage company is after me threatening me with foreclosure and a deficiency judgement. can they get a deficiency judgement against me?

    Effectively, yes they can. They can foreclose the property because the property is the collateral for the loan. They can also obtain a deficiency judgment against your wife's estate, of which I would assume you are the beneficiary. Thus, whatever your wife left to you in terms of money (other than life insurance) is subject to a deficiency judgment.

    Q. I signed a mortgage with girlfriend, we remortgaged(both names on deed-hers on mortgage) am i liable at all?

    One thing i don't understand, because i'm on the deed, the lawyer had me sign mortgage papers....but i don't show up on the mortgage bill or in the mortgage holders database. and there's nothing on my credit report for the remortgage. she filed bankruptcy and her old house and this one were both discharged. we still pay our mortgage... never had bank say any different. lawyer say we can walk away anytime without it affecting me....is this true?

    If you never signed the loan docs then you are not liable for any financial obligations of the mortgage. The document you signed might have been a quit claim deed removing your name from the property since the mortgage loan was in your girlfriends name. This is the only document I can think that you might have signed. This would happen if your name was on the deed prior to your girlfriend applying for an being approved for the current mortgage loan. The other might be the deed as a courtesy to you and your girlfriend adding you to the deed after the closing of the mortgage loan transaction. If your name is not on the mortgage loan docs you would have no financial obligations to the mortgage company. Your attorney in this case would be correct.     Q. How can we get help for mortgage fraud. how to find a lawyer when a person is indigent?

    Don't know where to find help. my son who is developmentally disabled was conned into signing mortgage papers on four homes totaling over $1 million. he had great credit but was only making a little over minimum wage in a warehouse job when he answered an ad in a chicago newspaper saying he could make money by helping other people with poor credit get housing. he was naive enough to believe this. now all four homes are in foreclosure and we have nowhere to turn. we live near chicago.how could they give loans to someone making so little money? does anyone know where to go for help? he's been served with papers. we are retired and cannot help him much.

    Personally I would contact the district attorney. They should be able to press criminal charges, you or your son would not have to pay for this. We pay them via taxes to protect people like your son, I am sure they will be happy to jump all over this.
