    I am divorced and my ex had money taken from his pay to purchase US Savings bonds on them it states his name and then POD and my name when he dies who are they payable to me or his family and in pre divorce agreement he agreed and signed it to keep me on as beneficiary but it is not mentioned in final divorce am I entitled to that insurance money

    Q. Living in my husband's house. will i get kicked out by his kids from his ex when he dies ?

    Hi, i have remarried someone for 2 years and reside in ontario, canada. this marrige is the 2nd one for both him and myself, we both have 2 kids each, his are both over 20 yrs, and mine are both younger than 10, so we are 4,him, me, and my kids, in the house that my husband owns for 15 years. we are moving in 2007, so the house is for sale. the problem is that he is dealing with purchase & sale all by himself, not getting me involved. it seems that he is not willing to co-own the house with me...we both work and get income(him:me=3:2), we split the bills. the mortgage is on his name but there is still 20 years to pay it off. what if something bad happens to him...say dies, will i and my kids get kick out by his children? if that happens in 20 years, it means i will have split the household cost with him for 20 years, but my name will not show as co-owner. i find this very unfair. i tried to ask him about this only to make him uncomfortable. how can i protect myself and my kids?

    Your husband is being too unfair to you and it seems he doesn't love you enough to protect you. You have to co-own the house by hook or by crook. Otherwise don't pay anything for the upkeep of the house. Get him to make a will that states that his house will go to you. His kids are old enough to earn for themselves but you still have 2 young kids to support for another 20 yrs more . That's alot and a long time.

    Here is the scenario-the husband dies and then later on the wife dies with no will-the only family left is the step children(her husbands kids) will the state consider them for the house and property or will it go to the state.

    No cash to speak of but has 3 million in real estate. there is only a signed paper that states one of the lots will have a home built by the daughter and her husband and the profits will be split. there is nothing about any other house or property. no executor, va is a common law state.

    Hubby gets it. But if you want it differently, you need a will to stipulate this. Unless the home was purchased after the marriage, then it is marital property and hubby can contest &; win if you stipulate different in your will.     Wife's aunt paid down payment on house and wife paid for 1/2 of all mortgage payments for several years. wife's children are now adults. husband's defense is that he provided most of financial support for kids growing up as they were with him from an early age.

    Q. Paranormal activity in grandmother's house since her husband died?

    Ok, my grandmother just turned 70. she lives alone now in a small house that she's lived in for over 50 years, and has a cat too. her husband died in 2007 from a heart attack, in the house. nothing strange ever happened in that house until he passed away unexpectedly. just weeks after he died, the weird things began to happen. there are several witnesses--my grandmother, her cat, her 5 adult kids who often visit the house, me, my mom, and several other family members. just weeks after her husband died, she was sitting on the couch one day watching tv and the door bell thingy on the wall (rectangle shaped thing) suddenly popped off and flew and landed in the middle of the room on the floor. the cat ran over and looked scared and sniffed around for a while. she left it on the floor for her 1 son to see that day. one time when i was there and talking to her, and heard something shaking behind me, and i turned around and the large plant that sits in a base on the floor was shaking all by itself. all the doors and windows were closed and there was no wind. twice within a week, her alarm clock reset to 12:00 am, and never did it again after. she received an email from "kenny culver", her deceased husband who never learned to use a computer, never had email. it was no prank, she doesn't have friends or family who would prank her like that. the email was blank, it just said it was from her husband. i still have pictures that i took of the email today. we were using the "ghost radar" app on the android one day and it spoke the names of two deceased relatives who had died but in their own homes, not in my grandmother's house. we often hear banging on doors and vents in the house when it's not windy out, and the chandelier she has in the dining room often gets brighter and dimmer all by itself slowly. there was once the sound of snoring coming from her bedroom when no one was sleeping in there. i cannot explain these things and neither can anyone else. they're not so severe that they need to stop, but these things haven't stopped since my grandfather died. there have been months where nothing happened at all, only to have numerous events happen a month later. i really don't think there is any logical explanation for these things. what do you think?

Spirits in limbo often don't want to leave loved ones behind, and I'm surprised he doesn't try to sleep in her room with her. My grandfather often feels my grandmother in his bed when he is missing her particularly. He is merely making himself known. You should try talking to him? Telling him about whats happening in your life. I'm sure he'd love that.

    My husband and i have a life insurance policy stating if either one of us dies our house will be paid off. he also has a seperate insurance policy through his employer stating if he is killed in the line of duty i will recieve benefits for the rest of my life. could a judge order me to sell my home and split everything with his ex? i had a friend who's father died and at the time he was re-married living in a nice home with his wife. a judge ordered this man's wife to sell the house and split the money with the daughter. since my husband is a police officer i worry all the time and want 2 b prepaired if he dies. my husband's ex-wife is very greedy and i am worried that if anything ever happens to him she will try to take everything i own. my husband and i have been married for several years and have a child together. he also has two other children with his ex. do they have the right to sue me and take me to the cleaners if my husband dies. or does the current wife have the most rights?

    Lots of states, if not all, have provisions that preclude a person from disinheriting their spouse and/or minor children. I do not know of any state which prevents a person from disinheriting their ex spouse. The best way to ensure your husband's wishes are carried out, however, is for him to execute a will. Assuming his children he had with his ex are still minors, I am sure he would want to provide something for them in his will. If he has a will that clearly sets forth his wishes for you to get all but what he specifically provides for his children, his ex will probably not be entitled to anything, personally. It is very difficult to overturn a will. He should also execute a durable power of attorney and a living will naming you as the person who can lawfully make any and all decisions during any period he is incapcitated. This will also make sure there is no dispute about his wishes should be become permanently incapacitated or on life support. A durable power of attorney would, among other things, allow you to sell assets to pay bills or for needed medical expenses. Absent that you would not be able to dispose of joint assets even if selling them were absolutely necessary. A living will outlines his wishes if he were to be put on life support with no reasonable chance of recovery. Next, you should make sure your home is jointly owned as joint tenants with right of survivorship. This ensures that your home will pass to you, by law (outside the estate) upon the death of your husband (and vice versa if something happens to you). You can actually do this with bank accounts, IRAs etc. In the alternative, if he has personal accounts by himself he can make them POD (payable on death) to you. This way they pass outside his estate as well. Next, make sure your husband does a check of all his paperwork at work. Even if his work life insurance names you as beneficiary, some people forget to change other benefits to a new spouse (such as funeral benefit, death benefit, unpaid wages etc). If he has not already done so, he should review all of his benefit paperwork to ensure his ex is not named as a beneficiary on anything. Finally, I recommend you see an attorney to ensure that your and his assets are protected. ` I am guessing that he/she will tell you much the same but of course will be most familiar with Ohio law and be able to advise you as such. All of the things I have discussed are things of general application and it is very important to ensure all your plans and documents conform to Ohio law. In particular he will be able to advise about the rights of children from a former marriage to inherit from a parent who has remarried and has other children . Seeing a lawyer and getting the appropriate advice and executing the appropriate documents will give you peace of mind. It will be worth the money for the peace of mind. Before you go see the attorney, make out a list of questions you want to ask. Bring copies of your insurance policies and the deed to your house and any other documents you feel necessary to answer all your questions. Also bring a copy of the divorce judgement/settlement agreement. Tell your husband to "Be careful out there"
